No Bail for Suspect in Lower Manhattan Office Tower KillingBy Matt Dunning
UPDATED Jul. 20
The Staten Island man accused of murdering a cleaning woman in a Lower Manhattan office tower was denied bail over the weekend after being arrested near his home on Friday, July 17.

Police say Joseph Pabon, 25, wrapped Eridania Rodriguez’ head, hands and feet with construction tape and July 7 and left her to suffocate in a ventilation duct of the office building at 2 Rector Street where they both worked. Pabon, a handyman and elevator operator at the building, was arrested July 17 after forensic investigators matched skin cells found under Rodriguez’ fingernails to his DNA, according to court documents. He pleaded not guilty to the charge of second-degree murder at his arraignment July 18, and remains in detention. Pabon’s attorney, Mario Gallucci, could not be reached for comment. Pabon’s next court appearance is scheduled for Thursday, July 23.

Thank you for caring about this case - it is local (downtown manhattan) and has really touched many here. The victim reminds me of so many hard-working immigrant people in this town, just trying to make a better life for themselves and their kids.

Please overlook the horrible ny post-style headline on this link. It did contain some information I hadn't seen before - that she pressed hard enough to LEAVE A PALM PRINT on the perp, and that she was found with a GOLD CRUCIFIX TAPED TO HER MOUTH.

RIP Eridania

Hi CityLady - it has touched us Uptowners too as Eridania lived in Inwood just two blocks from my apt. I am glad they caught this guy - he didn't make it too hard for them, did he? The first and biggest mistake he made was to leave work early and not come in the next day. Idiot.

I was very glad to see Eridania's murder made headlines and was on the local news. She was an immigrant and she was in a low income bracket and too often the news ignores their stories.

Some of the comments in the Post story are just so ignorant and mean-spirited. Saying things like Pabon shouldn't be charged because Eridania was an immigrant. This is why I avoid reading the comments.

Can Extreme Surveillance Keep Us Safe?

Eridiana Rodriguez vanished during her shift cleaning the office building at 2 Rector Street in Lower Manhattan's Financial District on Tuesday night, July 7. After four days, one hundred police scoured the building and discovered the body of this mother of three the following Saturday, bound with tape and stuffed into an air duct on the 12th floor, which was under construction and had restricted access.

I am unclear about criminal charges but why would Pabon be charged with 2nd degree murder and not first. Would the fact that he had been harassing/intimidating previously indicate a premeditation of at least some sort of malice? I guess what I am asking is he at the very least intended to violate Eridiana that night, given his previous behavior, so why doesn't this premeditation of a crime that leads to murder get a Murder 1 charge? Hopefully somebody will understand my question, I am extremely ignorant in this area, so if this is a stupid train of thought, feel free to tell me!

The girlfriend of the elevator operator charged with killing a cleaning woman stood by her man Saturday - appearing at his Manhattan arraignment.

Lisa Marie Blumenberg sat stone-faced as Joseph Pabon, 26, was ordered held without bail in the murder of Eridania Rodriguez. Rodriguez, 46, was found stuffed in an air duct inside the Rector St. office building where she and Pabon worked.

How do you stand by your man in such a case?? Is she scared for her own life if he gets off? Does she actually think he is innocent?? Does she not care that he is guilty?? I just can't imagine.

Nice leggings there g/f. You look just about as trashy as he does.......

Jesikah1, I was wondering the same thing. Why 2nd murder charges? Maybe someone with legal knowledge could explain? TIA!

Pabon had been arrested in April for beating his girlfriend and throwing a bowling ball through her car window, according to daily press reports. In addition, Pabon’s former wife had obtained orders of protection against him.

So Pabon was married at one time. Hmmmm! Seems as if Mr Pabon has a problem controlling his temper.

NY grand jury indicts man in skyscraper slaying

A grand jury has indicted a New York City office-building elevator operator in the killing of a cleaner whose body was found in the skyscraper's ventilation system.

Attorney Mario Gallucci said Friday that Joseph Pabon (puh-BOHN') has been indicted in Manhattan. He says he is not guilty.

Suspect Joseph Pabon told cops he left work early July 7, the night 46-year-old grandmother Eridania Rodriguez went missing, because he had diarrhea and vomited repeatedly - but later admitted buying beer that night.

Pabon, 25, told detectives he didn't know why he drank alcohol if he was so sick.

He also said he washed his clothes and ate a steak and fries in bed when he got home to Staten Island, despite having a bout of stomach flu.

............

Inside the courtroom Pabon's sister, brother and girlfriend, Lisa Marie Blumenberg, sat, and, at one point, laughed. Across the aisle, a dozen of Rodriguez's family members sat quietly weeping

He said the mom had repeatedly complained to family members that Pabon had been harassing her at work, sneaking up on her from behind and taking her to the wrong floors when he was working as an elevator operator.

..........

Pabon's lawyer, Mario Gallucci, said the scratches on his client weren't relevant. "They were nothing. They're not the scratches of somebody for their life," he said.

Pabon was ordered held without bail pending his next court appearance on Sept. 18

Quinnipiac psychology professor Carrie Bulger said, “There are about 17 homicides per week in the United States at work and only 8 percent of them are worker on worker.”

Bulger also said that workplace homicides are not common, but they do happen.

In July, Eridiania Rodriquez, a cleaning lady at the World Trade Center, disappeared in the middle of her shift. Her body was discovered four days later stuffed in an air conditioning vent and her co-worker Joseph Pabon was arrested and charged in her murder.

Family members of a murdered cleaning woman whose body was stuffed into an air-conditioning vent are suing.

They're blaming her gruesome death on a lack of security, the building owner, and the management company.

I was thinking of this poor woman today. I found this old article from December of last year.

Unfortunately, I could find no news reports on whether her accused killer has been tried.

Remembering Eridania Rodriguez...RIP!

Staten Island's top attorneys weigh ethics and personal convictions in deciding to take on the most heinous cases

Gallucci said he's received numerous death threats.

Some of the most vicious taunts have arisen from his defense of Joseph Pabon, a New Springville resident accused of killing a co-worker in Manhattan two years ago. Pabon's case is pending in Manhattan state Supreme Court.

Gallucci said he tries to shrug them off.
