Rep Matt Gaetz introduced a resolution to hold a former New York City prosecutor in contempt of Congress for refusing to testify about charges against former president Donald Trump.

The resolution requests that Mark Pomerantz, who worked in the New York County District Attorney’s office before resigning, be held in contempt of Congress for failing to comply with a congressional subpoena.

Former President Donald Trump tried again in a new court filing to get his criminal prosecution in New York moved to federal court, arguing the alleged crimes "took place while the president was in office."

Trump's attorneys accused the Manhattan district attorney's office, known by the acronym DANY, of "deceptively mischaracterizing and ignoring the applicable facts and body of law" by seeking to keep the case in state court.

I do have an evidentiary hearing on 6/27/23 for this case. Wonder when these oral arguments will be. Anyone have access to the court site? I do see it is a different judge, so no idea "where" to look.

On June 27 Hellerstein will hear oral arguments to decide whether to move Trump's criminal prosecution to federal court, where he has argued it belongs since the alleged crimes occurred while he was president.

*Oral Argument Hearing (@ am ET) – NY - *Donald John Trump (76/now 77) was indicted (3/30/23), formally arrested, charged & arraigned (4/4/23) with 34 felony counts of falsifying business records in the 1st degree & conspiracy in connection with hush money payments to two women before the 2016 presidential election. Plead not guilty. Warrant vacated, released on recognizance. Judge Juan Merchan
The counts cover 34 separate instances of a false business entry or record. Some refer to false entries into business ledgers. Others refer to false invoices or checks. All 34 counts against Trump are felony charges (class E) instead of misdemeanors.
Trump’s lawyers are Susan R. Necheles, Joseph Tacopina, Chad Seigel, Alan Garten & Todd Blanche. 4/3/23: Trump adds new attorneys to legal team: Hallie Jackson, Vaughn Hillyard & Adam Reiss. Court site has Gedalia Moshe Stern as attorney.

5/15/23 Update: Trump "has more than sufficient information to prepare his defense" & is not entitled to a written statement with additional details about the criminal charges he is facing, the Manhattan district attorney's office argued Tuesday, 5/15/23 in a new court filing. Trump is seeking a bill of particulars that would contain details about the prosecutors' theory of the case that are not included in the indictment. Trump is expected to attend a virtual hearing next on 5/23/23 in which he is to be informed of the terms of a protective order issued by Judge Merchan that limits his ability to share information obtained during the discovery process, which prosecutors will be sharing with the defense. Once Trump is informed of the protective order, prosecutors said they'll turn over "millions" of pages to Trump's team. "The production of these voluminous discovery materials further ensures that defendant is fully informed of the charges against him so he may prepare a defense," Assistant DA Becky Mangold said. That so-called discovery material, "will include grand jury minutes, grand jury exhibits, prior witness statements, financial documents, subpoena compliance & extensive additional materials," including witness emails & texts, Tuesday's filing promised.
5/23/23 Update: Trump attended the hearing virtually with his attorney Todd Blanche seated next to him. The Judge agreed the protective order would allow him to comment on the ongoing case before trial. Blanche said Trump was concerned the order violated his First Amendment rights to freedom of speech. But he said he had told his client that Judge Merchan did not intend to impede his speech & that the restriction was not a gag order, which would bar him from speaking publicly about the case at all. Judge Merchan said he did not mean to restrict Trump's ability to campaign & that Trump "is certainly free to deny the charges, he is free to defend himself against the charges." The judge said on Tuesday that if Trump violates the restrictions, he could be held in contempt of court. The restrictions on Trump concern grand jury minutes, witness statements & other materials that prosecutors are required to turn over to the defense to prepare for trial. Prosecutors have said the order was needed because of Trump's history of attacks on social media & the risk that witnesses might be harassed. Judge Merchan reviewed a protective order he put in place, barring Trump from publicizing, or even possessing, much of the evidence to be turned over. Trump cannot speak publicly about, or post on social media, any case material that had not already been made public. Some information, labeled "Limited Dissemination Materials'' by prosecutors, will only be available to Trump in the presence of his attorneys. Merchan told Trump that if he violates the order he can be sanctioned or fined, "up to a finding of contempt, which is punishable." Judge Merchan has set 3/25/24 as the start of trial. Defense deadline for motions is 8/29/23 & prosecutors get to respond by 10/10/23. A hearing date of 1/4/24 @ 9am to be held. Next evidentiary hearing on 6/27/23 & an in-person hearing on 12/4/23.
5/26/23 Update: Prosecutors in Trump's Manhattan criminal case have released to his attorneys a recording of Trump & a witness, whose identity was not disclosed, according to a document the office made public Friday. The document lists the dates of 34 instances between Feb. 14, 2017 & Dec. 5, 2017 when he allegedly falsified records. In a section devoted to electronic evidence that will be turned over, a prosecutor for Manhattan District Attorney Alvin Bragg's office indicated they have disclosed to the defense a "recording of a conversation between defendant & a witness." The section also indicates prosecutors intend to disclose recordings of calls between witnesses & others.
6/2/23 Update: Trump on Friday asked that Judge Juan Merchan overseeing his criminal prosecution in New York City to step aside, citing the judge's daughter's ties to a Democratic organization. Merchan himself will decide whether he is impartial. The defense said he can't be, because his daughter is an executive at Authentic Campaigns, a Democratic consulting firm that worked on President Joe Biden's 2020 campaign. There is a "need to assure the public that the judge who presides over this historic case is actually impartial," Trump's attorneys said in their motion for recusal. "This role cannot be fulfilled by Your Honor." Trump attorneys Todd Blanche & Susan Necheles also cited Merchan's oversight of a prior criminal case involving the Trump Organization, which was convicted of tax fraud. They said Merchan encouraged then-chief financial adviser Allen Weisselberg to plead guilty & cooperate against the company. The Manhattan district attorney's office has not formally responded, but was expected to oppose Trump's effort to replace the judge. The motion for recusal is the second attempt by Trump to move his criminal case out of Merchan's courtroom. He is also seeking to remove the case to federal court, a move that's opposed by the district attorney's office.
6/16/23 Update: Trump tried again in a new court filing to get his criminal prosecution in New York moved to federal court, arguing the alleged crimes "took place while the president was in office." Trump & the prosecutors have filed dueling motions over the appropriate place to put Trump on trial for allegedly falsifying business records connected to the 2016 hush payment to *advertiser censored* actress Stormy Daniels. Trump has pleaded not guilty to 34 felony counts. Trump has argued he was an officer of the United States when he was president & his case is best handled by federal court. There may be a more practical reason: If Trump's bid for the White House in 2024 is successful he could, in theory, take steps to make a federal prosecution go away. Manhattan District Attorney Alvin Bragg has argued Trump's alleged criminal conduct regarding his business records had nothing to do with his job as president. Instead, Bragg's team has argued payments to Trump's then-fixer Michael Cohen, who had written the $130K to Daniels, were solely reimbursements for campaign contributions & therefore not acts done under the color of federal law. Trump plans to argue the business records were truthful because the money paid to Cohen was, in part, "retainer," so Cohen could handle Trump's personal affairs while he was president. U.S. District Judge Alvin Hellerstein has scheduled oral argument on 6/27/23.

Judge Alvin K. Hellerstein will listen to the afternoon arguments, though he isn’t expected to immediately rule.
 

A U.S. judge on Tuesday said he would likely decline former U.S. President Donald Trump's request to move from state court to federal court a criminal case stemming from a hush money payment to a *advertiser censored* star.

"The argument is very clear that the act for which the president has been indicted does not relate to anything under color of his office," U.S. District Judge Alvin Hellerstein said at the end of a hearing in Manhattan federal court.

Hellerstein said he would formally rule within two weeks, but expressed what he called his "present attitudes" toward the case.
