The problem with her "giving agreement" is that she was reportedly drunk according to LE. She may have drank something willingly, or she could have been slipped something in the drink but either way, you cannot legally give consent if you are intoxicated.
She was adopted at 2 which means her biological father is not her legal father...so it was a 39 year old man and an 18 year girl having sex. It's gross and disturbing but not illegal.

I constantly questioned why they would be outside, in the park, drinking beer in the cold, if Dad's apt was just across the street. Then I read that Dad's got a girlfriend in the apt. If the 18 yr old girl in agreement with the interaction with Dad, then even though it's disgusting, I don't think it's illegal. AND it doesn't give the other perps permission for what they have done. Now if their video shows the girl making a statement that 'sounds' like she is in agreement, that's another whole story.
