Did just one those umm animals record that? It is almost as if that err recorder recorded it after 1 or more of the animals raped her and are now making it look like something else. idk just guessing jmo

The problem with her "giving agreement" is that she was reportedly drunk according to LE. She may have drank something willingly, or she could have been slipped something in the drink but either way, you cannot legally give consent if you are intoxicated.

As far as the description of the video goes, it doesn't look like she said anything except mumble. Seems like the man is claiming that she said "yea" but NYT says the woman just mumbled. To me it would appear they were trying to justify their actions before the actions even began.

She was adopted at 2 which means her biological father is not her legal father...so it was a 39 year old man and an 18 year girl having sex. It's gross and disturbing but not illegal.

That's not true. The bio dad lost custody and she was adopted by somebody else. She moved back to reconnect with the bio dad. The 39 year old man is the bio dad.

I constantly questioned why they would be outside, in the park, drinking beer in the cold, if Dad's apt was just across the street. Then I read that Dad's got a girlfriend in the apt. If the 18 yr old girl in agreement with the interaction with Dad, then even though it's disgusting, I don't think it's illegal. AND it doesn't give the other perps permission for what they have done. Now if their video shows the girl making a statement that 'sounds' like she is in agreement, that's another whole story.
Sometimes I wish I never heard these stories.

NYT description of the video is that the woman is mumbling. It's the man who claims she agreed. Sounds to me like these men were trying to justify their actions. But it certainly doesn't appear from the description the woman actually said yes to anything. Even the suspects lawyer describes this as "non-verbal" response from the woman.
Basically, right now it looks that these five were in the park and saw this woman (apparently highly intoxicated) in the park with her father (regardless of what she was doing) and made father leave. And now they claim consent based on some "non-verbal" response of the mumbling and drunk woman? I find that disgusting.

According to WSJ article, two of the alleged perps are claiming the dad and girl were having intercourse in the park, see below.

"Two of the teens, in separate interviews, told investigators that the father and the daughter were having sex when they discovered them on the playground, a law-enforcement official said.

“They indicated that the father is the one who put her in this compromised position and they took advantage,” the official said, adding the suspects said that as they walked into the playground, “One of them says, ‘We’ll take it from here.’ ”

yes I took the phrasing differently than it has been punctuated. I took it to mean, "If the word you (woman) are saying is affirmative, then we are all now going to engage in sexual activity, which would confirm my earlier suspicions that you enjoy disgusting nasty intercourse in muddy public with fine gentlemen such as us."

Also I'm confused. I thought this was her bio dad who she'd recently reunited with after being adopted out as a toddler?

Possibly she is not saying much if anything because she is intoxicated, frightened and about to be assaulted after her daddy took off and left her to the wolves.

Even if the bio-father was not having sexual relations with her, it was still negligent and illegal to be drinking with her, in a remote section of a dangerous park at night in Brooklyn.
