There goes that theory..lol.. Is it true Jeffrey was on the board of directors that decided to let James move in? Also did Jeffrey send bouquet of flowers to all of the tenants? I also read that the tenants all hate him now. If he is high up on the board they could probably ban together and sue him for emotional distress.

Its not fair that all those people had to be put in danger so he could have a play toy. One of them could have been robbed or worse.

Early on, I did read that Jeff sent flowers to the other tenants. When I read about the tenants "hating him and wanting him out of the building", it sounded like it was about James, not Jeff. IMO.

The safe thing is bugging me also. What could have been in there? They can't hush the whole world. There will be leaks. Their silence is creating an insatiable curiosity in many people.

Fingerprints? Dilion's story included that Comunale was trying to leave when he was stabbed. I have read all nice things about his character, nice guy. When they were all out, were Dilion and GM talking their guy/friend James, making fun of his lifestyle and set up with Comunale. With the safe, is it possible, Dilion and GM were stealing from James? From a combination of events, Comunale said buds you guys are thieves and I want nothing to do with this, I am leaving and this set forth a killing.

Another theory is Dilion knows some drugs are kept in there and ratted this out in hopes it will hang all further on his semi buddy, James.

The entire story and case has changed from the beginning, multiple times. I think it is probably stranger than fiction and this is why they are having a hard time solving it. I do not always trust eyewitness testimony. If a tenant only knows another from simply passing and nothing else, seeing a guy from a
distance taking off in a garage in their car, their brain may automatically register it as the guy who is always driving the car. Unless the hair was completely different, platinum blonde, goth guy, older gray haired...

Since the beginning the story has changed 3 times from detailed descriptions of what went on.

First James was out with them all night and was partying with them in apartment all morning///now James was not out with them and did not party with them and the girls.

It was printed as fact in beginning, James clothes had blood all over them, and some blood in apartment (very little blood to the eye in apartment) and blood in garbage///Now blood is not on James clothes, but found on Gemma's clothes and the significance of amount of blood found in apartment changes depending on story. The initial police recollection was very little unless you knew to look for it.

First reported the murder occurred because Comunale spurned James advances///now James killed Comunale over cigarettes.

The charges were changed and dropped and bond changed and dropped, and then a new suspect brought in all of a sudden.

Of course with a history burglary, Jame's bond will be more and for the fact it occurred at his residence, if not for this he would have had the same bond as the others. I do believe his being in jail may help him more than hurt him because if he is truly innocent, it gives him more time face to face to give his story and give them a feeling of whether he is telling the truth.

Even if I am very wrong with my own theory and gut feeling, I hope the true facts come out. I worry because Gemma's dad was a former attorney for years and mayor of New Jersey, there will be a WHOLE LOT what ifs when it comes to fairness of equal justice and no cover ups (evidence spoiling or placing evidence to charge the poor kid from Florida with no father because he has had a restraining order on his father for many years) for the prominent son of a former mayor. You can get a feel of the family feeling better than and more entitled than others by incredibly asking the judge to let their son go on vacation to London with the family over the holidays and gasped and upset when denied this. The judge was like excuse me, a kid is dead here with blood on your sons shirt and your placing more importance on the boys need and entitlement for a vacation.

I know many will not agree with me and I understand, but this is my gut feeling. I think this is a stranger than fiction story and from the beginning it was just thought, it is the James kid no doubt.

Early on, I did read that Jeff sent flowers to the other tenants. When I read about the tenants "hating him and wanting him out of the building", it sounded like it was about James, not Jeff. IMO.

If James got out on bond, they do not want him living there anymore. The rich have that luxury. Most criminals can move back to their residences when on bond, neighbors have no choice if they do not have the luxurious entitlements as these residences do.

Jeffrey lied about his burglary offenses to get him an apartment there, but I am sure in that huge building there are white collar burglar's who have spent time for stealing from corporations, stocks, Wall Street, white collar thievery, and the residents have no problem with these criminals.

Throughout the evening, I question if the girls were all about Comunale around Dilion and Gemma. There would be some jealousy initially and then something happened back at the apartment, the jealousy + " " led to a 14 times stabbing, which shows a hatred toward a person known to the suspect. James doesn't know the guy, why would he stab and ruin his great set up and life by stabbing a guy he does not know 14 times? I cannot get past this and with his expressing to cops, something another to: I have a great life, I have never hurt anyone, I wouldn't hurt that kid.

@Salsa I've read more than a few times Joey's company handles security for the Sutton. They could have wanted Joey to cause the cameras to blackout while they possibly stole the safe.

I think they were heading for a real break up after whatever transpired over the summer causing James move out. Could all of the expensive trinket's Jeffrey had
given him been in that safe?

Maybe that job James had was bogus and Jeffrey threatened to stop paying his rent I guess James felt he earned that stuff so he was doing what desperate people do.. desperate things

Joey may have thought he was just going to party and they tried to force him to do something he didn't want to. Jmo

In This concealment of a human corpse (plus other charges) and This Murder case, the only convicted felon living in the building that matters is James Rackover.

The other shareholders, renters and/or subletters residing in the bldg other than the elder JR (and he has not been criminally charged with anything) have nothing to do with this case.

Did he or LD alone murder Joey, or did both participate in his murder...the investigation is ongoing. It has never been reported that MG is involved with the actual murder nor concealment of the corpse. He has not been named a POI nor a suspect in the murder.

However, does the evidence released so far point towards both JR and LD being properly indicted & arraigned for the 3 charges of concealment of a human body, hindering prosecution and tampering with evidence? Yes, and IMO it doesn't look promising for either of them regarding those charges

This is the most interesting & logical theory I've heard so far.

It is my belief MG and Dilion killed Comunale and James was in his bedroom passed out. It was the shirt MG was wearing that morning that has the first reported blood all over it mixed with bleach. It was MG who changed clothes and the body was found in the roommates neck of the woods miles away. I believe it is stranger than fiction and I for now believe James was asleep and his very adamant statements of innocence may prove this. I am not on any tapes, look again please officer, because I know for fact I was sleeping the entire time.

Of course the two long time childhood friends and roomies will cover for each other and place the blame on the elephant in the room. I do hope the real truth comes out step by step, so an innocent man is not placed in jail. If James is guilty, and honest proof points to him without a doubt, then yes he should be imprisoned.

James was not with Joey the entire night. I do not think he would trust some guy he does not know and has had no time to accurately gauge to mess with security equipment. They were partying all night with girls until 7am, Grey Goose Vodka and cups found. This does not describe a planned caper in the night matrixing their way to steal from a safe.

I read it last night. I will find it when I have more time, but it was mentioned in one of the many articles I read.

Interestingly I found this quickly looking for it:

Police believe Comunale was killed Nov. 13 at a luxury Manhattan apartment after a night out with friends. Authorities said the popular 26-year-old Stamford man was stabbed 15 times before his body was taken to Oceanport and buried in a shallow grave behind a flower shop —about a mile from Max Gemma’s home.

I still think something was brewing at the party. Why were the girls ushered off in such an untimely fashion? They got there at 4am and were escorted out around 6am.

Maybe Joey wouldn't go to the party without has friends.. If the fight started then, I think Joey would have bailed with the girls. Im pretty sure those girls don't know too much.

I tend to agree that it wasn't about stealing jewelry or anything in the safe; IMO I don't see any of these guys being interested in stealing jewelry. I think it was an altercation exacerbated by a long evening of alcohol and/or drug use. Also, the location of the body makes me lean toward LD being the main perp in this situation. I don't see James knowing the Oceanport area all that well, let alone thinking of a spot to bury a body there. Just my opinion so far, until we find out more details...

I haven't read anything about him being obnoxious, pompus, or arrogant. His ex girlfriend did not have anything terrible to say about him and he left her for his life in New York. She did not mention any violence, he was a jerk, or he treated her badly. He may be all those things you said, but I haven't heard it from anyone yet.

She did mention that it wouldn't surprise her if James sold his sexual services to a man. That might not be the biggest slam in the world, but it does imply he was willing to use someone he wasn't interested in for the money.

They would confirm/identify (along with the cab drivers) who the individuals are who got into the 2 cabs and entered the bldg (along with video & employees behind the desk) with them at 4 AM. And what drugs were being used if any that eve and by whom...

She also wouldn't be the first ex-partner/ex-lover to either not know or deny that their ex was bi or gay

Just because James saidhe didn't know and had never seen Joey before, doesn't mean its true. Just because LD said MG wasn't involved, doesn't mean its true.

Blood, bloody clothing, bloody sheets/towels, evidence of bleach, blood splattered on walls were all found in and around James' apartment, the luggage cart and cadaver dogs got a hit on the car James was driving.

LE arrested and charged JR, LD, and MG with crimes related to Joey's murder.

There's also that pesky gasoline Chief of Detectives Boyce stated was found at the burial site, as well as the pesky either evidence or a witness that saw James and Larry adjusting the surveillance cameras in the bldg's basement

The 3 females may OR may not be able to state whether MG had changed his clothing and had begun to nod off on the couch prior to their leaving the apt with Joey & Larry
