4/23/18: Manhattan Supreme Court Justice James Burke severed the cases against murder suspects James Rackover, 26, of New York, & Lawrence Dilione, 29, of Jersey City, N.J., Monday afternoon. Rackover will be the first to go to trial beginning Sept. 24, after which a trial date will be set for Dilione. A third defendant, Max Gemma, 30, of Oceanport, N.J., who is charged with hindering prosecution & tampering with evidence for allegedly misleading police during their investigation, is expected to go to trial last.

Prosecutors offered a glimpse Friday of the damning evidence they plan to introduce at the upcoming murder trial of a “jeweler to the stars” lover accused of killing a Connecticut man.

Assistant DA Antoinette Carter said James Rackover, 27, allegedly stole thousands of dollars from his much older lover, jeweler Jeffrey Rackover, to pay off a drug debt.

He took $50,000 from Venmo, PayPal and Bank of America accounts in addition to a $30,000 watch, she said at a hearing to determine the evidence that will be admitted at the Manhattan Supreme Court trial slated to start Monday.

James Rackover, 27, is reported to steal thousands of dollars from his older lover, jeweler Jeffrey Rackover, to pay off a drug debt. And of assassinating Joseph Comunale (26).

Allegedly the defendant took $ 50 thousand dollars from the accounts of Venmo, PayPal and Bank of America of the jeweler, in addition to a clock of $ 30 thousand, as was said yesterday in a hearing to determine the evidence that will be admitted in the trial for homicide that will begin on Monday in the Manhattan Supreme Court.

Boasting that he’d beat the rap for the murder. James Rackover said, “They’re going to be like yo, this kid just f–king beat this sh-t like Rocky and he’s home, oh my god.”

Rackover made the prediction from the Manhattan Detention Complex after he was arrested.

“I’m going to get all the, a lot of respect, like, a lot of people are going to be like, damn, like, he did his thing, he like kept his mouth shut and f–king went home, like beat this sh–t, like, damn,” he blustered in the call, referring to himself as “Jimmy Guns.”

In another jail call, Rackover allegedly said, “So, I got good news, it doesn’t look like Larry is being a f—king — running his mouth in court, and trying to flip on me, so that’s good.”

Defense lawyers argued that the calls don’t prove anything and would inflame the jury.

But Assistant DA countered that the calls showed consciousness of guilt. The Judge ruled that they can come in.
