Just got an update: 50 pages of the jury instructions to go
Judge Deering is now reading the jury instruction for the 22nd of the 22 counts in the indictment for
#GeorgeWagnerIV
Now, Judge Deering is reading that complicity instruction that is so important to the state's case. It basically says that you don't have to be present or even have committed the actual act to be guilty of the crime.
The evidence has shown -through witness testimony- that
#GeorgeWagnerIV didn't fire a shot that night. Jake Wagner said he fired GW4's SKS at Chris Sr.'s home after George "froze.”
But it has often seemed like the state didn't want to concede that point. Jake testified he didn't see well at night. There was testimony that GW4 hunted at night. So, it seems like prosecutors still think he may have fired that night.
GW4 says he wasn't even there that night. And only learned of the murders the next morning. Jake and Angela Wagner said GW4 was a part of the entire thing - from planning to cover-up.
Judge Deering now reading the instruction about viewing an accomplice's testimony with "grave suspicion" because they may have motive to lie. It's up to the jury to determine the credibility of each witness
The 5 remaining alternate jurors have been instructed that they should remain at the courthouse during deliberations. Judge Deering says he's going to let the jurors set their own schedule
Deliberations will begin tomorrow morning at 8:30 a.m. in OH v.
