My gut says that Billy Wagner will spill his guts. He has nothing to lose at this point.
He can't spill his guts because he is going on trial in May and trial is his only hope to get out and go back to Flying W Farm. A 4 million operation (total land and business and building assets) must be kicking himself.

I wonder what his defense will be at trial. He will also try to say he was not involved/or there and say that Jake, George and Angela or Jake was the only one that did this?

I will also look for the article that said his defense is that he lived away from Peterson Rd, wasn't even there to plan it. Not involved.

Yup.

And note...his phone was at Peterson Rd. that night. Weird he didn't leave it at FWF where he says he was staying. His staying at FWF does not preclude him from having gone over to visit. On one of the phone calls Angela says "Billy is here" and he went over twice a week with doughnuts for his grand kids according to testimony.

Also, their alibi is that all 4 were having a family movie night that night. Then Angela and Jake couldn't remember what movie they were suppose to say they watched.

So his not living with his 3 co-defendants means zero.

Makes sense that the plaintiff, DM, wouldn't want to live in the area where he's currently suing the County Sheriff and other officials for multi-millions. JMO


I don't believe that had much to do with him leaving, if any. He was in Ross County not Pike. Much more was going on but I won't go O/T any more than I already have. o_O
 
Waiting.........The judge ruled on Change of Venue Motion for Angela's estranged husband on 11/20/2023
so I wonder why he hasn't ruled on her Pro Se Motion? I assume he has to confer with her attorneys but this could simply be done over the internet - Zoom, FaceTime, etc...

If Billy's trial happens May 6th it will be exactly 8 years and 2 weeks after he personally killed 3 by shooting them, and helped to kill 5 more. 8 years is pretty extreme considering there has been only one trial before his and the other 2 co-defendants pled guilty....I remember Covid only postponing his hearings by a few months.

Local 12 Investigates: How much is Pike Co. prosecution costing? And who will pay?​

WKRC November 14th 2022 - From a year ago, the total is more now. Some expenses were not charged yet, and there would be expenses over the past year.

Local 12 used an open records request to get the invoices for the prosecution of all four Wagners. Some expenses may be missing due to incomplete documents provided to Local 12.


The costs so far are $3.38 million dollars and climbing.

Ohio state Rep. Shane Wilkin (R-Hillsboro) got more than $1 million allocated through the state attorney general’s office.

Brother Jake pleaded guilty to all charges last year and his mother Angela pleaded guilty to conspiracy and both testified against George in this trial. A conservative estimate for just these proceedings is more than $800,111. But his defense lawyers as well as the special prosecutor have not billed anyone for a few months.

Defense - $150 an hour.
Temporary housing for Angela Canepa and Andy Wilson - $3,600 a month.
Canepa earns $65 an hour and a Motion was put in to give her a raise.

The bills also include housing all four Wagners at separate jails.

These invoices don't show what George's defense team spent on expert witnesses as those were put under seal.

It took the judge quite a while to rule on Billy's change of venue, it may take him a while to appoint her new attorney's if he decides to do that.

Part of me wants to think that the county/state needs to put this behind them in some fashion at any cost. Attorneys move at a snail's pace all the while jacking up their bill. How much cost is racked up by all of the delays. JMO

Yes, Covid 19 restrictions are over. They should be able to make some progress and get Billy's trial completed. The county and state payed a lot of money (was it $10,000?) for a consultant to organize all the evidence for the defense attorneys.

Remember the time defense attorneys accused Angela Canepa of not giving them discovery evidence? As it turned out, the defense attorneys had given AC the wrong type of portable hard drive to use for transferring the digital files.


Discovery, and the huge amounts of it, also were a topic of discussion during Angela Wagner’s brief pretrial Wednesday. Deering said it was his understanding that four terabytes of information still need to be delivered by the prosecution to Wagner’s defense team. He ordered the defense to present prosecutors with the appropriate equipment for transferring all that information by July 15. Prosecutors then will be responsible for getting that information into the hands of defense attorneys by July 21.

The pre-trial hearing centered on the issue of discovery, with the defense calling for the appointment of a discovery coordinator. The coordinator would compare the evidence the state has against what the defense has, and vice versa, and make sure each side is properly prepared for the trial.

According to the defense, the coordinator would also compare what discovery evidence the other three defendants in the case have and make sure all sides have the same evidence.

The judge set a Jan. 31, 2020, deadline for the defense to present a motion to the court about the appointment of a discovery coordinator, with a Feb. 11, 2020, pre-trial date set for the judge to rule on the motion.

The Court notes that, although it has been suggested by counsel for the Defendant that the appointment of a coordinating discovery attorney, or "CDA," in this action may be needed, in order to assist the parties by ensuring that full discovery is provided and in helping the Defendant and State of Ohio organize the discovery material for effective pre-trial study and presentation at trial, the Defendant had not filed a motion in this action requesting the appointment of a CDA as of the time of the pre-trial hearing this day.

Yes, that's it. I'll go back into the threads here tomorrow and find the notes from the later pre-trial hearing when Judge Deering approved the expenditure. It's probably in the Pike Co Court of Common Pleas docket notes, too. IIRC, they had all the digital video and audio files catalogued according to which parts were going to be played or shown at trial, etc.

JMO and IANAL, but the state shouldn't have to pay to duplicate that work for Billy's trial, too.
