I hope during the remainder of JWs testimony, the 4th court of appeals and even the ohio supreme court makes a clarification as it pertains to each witness opting out. It appeared to me there is a discrepancy between what the 4th ordered and the 12c deal. Bottom line, whatever needs to occur to prevent a mistrial is the correct call. Let the higher courts figure it out. Deering held a hearing, made his ruling and now on to the supreme court or not. He fulfilled his requirements.

I want to see JW squirm qs much as qnyone but not to the detriment of the trial on appeal. Jmo

I think that ship sailed yesterday when deering continued with Jake's testimony. Effective immediately means just that. Now. Not tomorrow. Deering disobeyed a higher courts ruling.

No he actually didn't. In the end he did what was called for to circumvent it...legally. We may not like the arguments used but he did, what he was told in the order, what he was allowed to do.

There's not going to be any mistrial over the hubbub yesterday. The only time "mistrial" was mentioned was in a tweet. Besides, the Court of Appeals cleared it all up today. It's all over and done with till the next person opts out.

Jurors just went to lunch. Toward the end of the morning session, Jake said it was his maternal grandmother's decision to confess to her role in forged custody documents that prompted Jake to do the same.

After Rita Necomb (Angela Wagner's mom & Jake's grandmother) came forward, Jake Wagner said, "To me, it felt like it was the answer I was looking for at the time.. an answer from God."

Jake shared the regret he felt about the #PikeCountyMassacre during a brief convo w/ his dad, co-defendant Billy Wagner. Jake said he told Billy he "did not" feel regret, which Jake said today was not true. He said he told his dad this b/c he worried about Billy being suicidal.

Jurors also saw, for the first time, the weapons used when Jake says he and his family executed a plan to kill 8 members of the Rhoden family in April 2016.

ALSO OF NOTE: Jake Wagner described being taught (pre-homicides) how to evade law enforcement when he & his family committed crimes. He said he was taught to be "respectful" of police but that he "was to hide something, to hide it plain sight."

PERSONAL OBSERVATION: One of the strangest things I've deduced from Jake Wagner's testimony is how little it appears all 4 Wagner co-defendants talked about the #PikeCountyMassacre after it happened. Jake said they talked about the investigation, but that seemed to be about it (save for a few conversations here and there, like the one I mentioned a short time age between Jake & his dad Billy).. Talk about compartmentalization. #WLWT #PikeCountyMassacre

It said that the judge had to hold a hearing to determine whether making a witness testify on camera or audio would have any detriments. He listened to the media lawyer, the prosecutor and JW's lawyer make their arguments. Then when it was time for the defendant's lawyer to speak, the judge's lawyer on speaker phone quickly called a 5 minute recess in chambers. Judge came back and JW's lawyer brings up the peril to his safety in prison if he testifies on camera or audio, then the prosecutor echoed that and said we can put on witnesses about that. They put on one witness, a prison guard who happened to be in the courtroom (for i believe JW or GWIV?) who basically said yeah "snitches get stitches" elaborating on how difficult it can become for a prisoner if they testify against cohorts especially if it's family. Judge ruled JW being recorded would put him in peril and may make him testify in a way that could be a detriment to the defense.

That's what I heard...not once did I hear the word mistrial. Maybe that was what GWIV's lawyer was going to bring up, the lawyer on speaker phone nipped it in the bud and it was only spoken about in chambers? I don't know.
I get the snitches and stitches. But in this specific case, would there be no honor among inmates? Can they really be angry at him for turning against family who did that?! Further, he tried to save all of their necks with the plea he did negotiate.

What I really want to know is weather Nash said "according to your proffer George went to protect you" or if he said it as a statement that he wanted Jake to acknowledge it as the defenses version of things. That wasn't made clear.

Yes it was a court case where the parents wanted to protect a juvenile. That was the precedent case that determined the opt out, of every witness being given the option. That's what was being discussed today during the hearing.
I can see JW not wanting in published on the internet so that when SW is older she won’t be able to pull it up and see him say what he did to her family . IMO

The Fourth Circuit Court of Appeals "clarified" its order today, essentially saying "never mind" to the idea of holding hearings.

Deering ruled however that making Jake Wagner to go on camera would change the possible fairness of the trial, because it could change how he testified. The hearing also included testimony from a member of the STAR team of the Department of Corrections.

The appeals court later Wednesday clarified its ruling, stating no more hearings were needed regarding the opt out question." So essentially this issue is over.
 
That’s why I’m so taken with the podcast I found. Remember how one reporter (I think it was Angenette) said Billy told Jake something along the lines of “kill Hanna and/or Sophie”? But it was only one reporter who reported that, right? Well, this podcaster Noticed it too so she got several of the reporters on the phone to get their version and cleared it up, then she explained it on her podcast.

She basically starts with the exact same info we get, then chases her questions down for clarification. I know it’s starting to sound like I’m promoting her but I had no idea who she was until I ran up on the podcast about a week ago & decided to listen again last night. I’m planning on listening again tonight, it was that helpful for me. It might be helpful for you.

I think what is helpful is she has a source in the courtroom also. After the trial day is over they talk and she has the tweets from reporters and I think she gets clarification on those and any additional notes the person in court has. Did you hear the part about Nash saying so George was along to protect you? I really want to know if that was said as a statement or as something that was in Jake's proffer.

I still see Angela and Billy as being primarily responsible for the outcome. They are some pair. They got together, conceived 2 boys, and didn't prepare the boys in any meaningful way to be independent of them. The damage these 2 did!! Yes, both boys are responsible, too. But the only way to stop a cycle like that is to leave that family unit. MOO
 
No problem. I think you probably pretty close to correct on the rest. The Appeals Court decision really didn't make much sense. The law allows witnesses to opt out. I've never seen a law like that, but that doesn't matter. The Appellate court put the burden on witnesses to assert that right. But further more, the motion was brought by media, non-parties to the case. And the issue is a decision made by witnesses, also non-parties to the case. The Appellate Court decision was threatening to derail or at least inhibit a major criminal case because of an argument between non-parties. I wonder if the Trial Court's attorney or someone from someone higher in the Ohio Judiciary didn't send them a message saying "what do you think you're doing?"
Here is PrairieWind on the Appeals Court kerfuffle from way back on p. 26, in response to a question about mistrial and why the Appeals Court might have re-thought what they did: "The Appellate Court decision was threatening to derail or at least inhibit a major criminal case because of an argument between non-parties." (I know we are all--i think--disappointed not to hear Jake's testimony but the judge could not allow the rules for that testimony to change midstream.)

He's just peeved that RJN was first. He wanted to be first and to make his confession land on the anniversary of the deaths. I firmly believe that. No proof, but it's just a gut feeling I've had. He's had nothing but time to figure it out.

It seems to me that Jake still feels the outcome was the only option. So his testimony seems cold because he might still think what he did he had to do to protect Sophia. He feels sorry he ended their lives maybe.. but he thinks the motive was just. His parents still have a hold on him. He wanted to see them one last time. He loves his mother. He wants George to be able to go home. Man, it's like he owned up to what he did in a matter of fact way and that sounds cold as ice, but I don't think he's lying. I think he has either completetly put what he did in a box so he is able to talk about it.

I really don't see him lying to say George was there if he wasn't.

Jake Wagner is about to resume testimony in the #PikeCountyMassacre Trial of his brother #GeorgeWagnerIV. Late start for a hearing related to media access.

Lots of drama in the #PikeCountyMassacre trial of #GeorgeWagnerIV this morning as his brother Jake took the stand for the third consecutive day. After two days of responding to questions with spare, limited answers, Jake Wagner admitted regrets for the killings. 1/9

On Monday, Jake Wagner told jurors he killed five of the eight Rhoden victims, shooting them in the head, sometimes multiple times. Today, he said he never talked to his mother or brother about the homicides. But he did talk to his father. "It was very brief,." he said. 2/9

"He was frustrated with me because of what he had, per se, been made to do because of me, and asked if I regretted doing the homicides," Jake Wagner said. 3/9

Special Prosecutor Angela Canepa asked Jake Wagner how he answered his father, George "Billy" Wagner III. "I told him I did not," he said. "Was that true?" Canepa asked. "It was not," Jake Wagner replied. 4/9

Canepa then asked why he did not admit his regret to his father. "To make him feel better," Jake Wagner replied. "I felt that if I told him it ... could have caused him to have more misery. It could have led him to commit suicide." 5/9

Under questioning, Jake Wagner said he decided to admit his guilt after his grandma Rita Newcomb admitted her involvement in covering up forging of custody documents in the case. "I felt like it was the answer I was looking for at the time. It was an answer from God," he said.6/9

Canepa then showed the jury 16 photos of weapons and ammo used in the shootings and recovered from buckets of concrete. On Tuesday, Jake Wagner said he cut up and tried to melt the weapons; his father helped fill the buckets; the whole family helped deposit them in a lake. 7/9

Wednesday morning started with a hearing called by Judge Randy Deering related to a media request challenging the "opt out" option for witnesses. The judge denied the request. 8/9

Proceedings were also interrupted for about 10 minutes by a visit from local fire officials. They removed folding chairs installed this week to accommodate the growing crowd. Jake Wagner remains on the stand under questioning by Canepa. 9/9
Canepa asked what else Jake Wagner hoped to get from his deal with Ohio. "If at all possible, one last family moment with my mother, brother and father, if they were permitted," he said. 4/13
n his first 90 minutes on cross exam, Wagner IV attorney John Parker quickly moved to two key points: 1. His client is facing the death penalty; 2. Jake Wagner is not. "He did not fire a shot, did he?" Parker asked Jake Wagner about his brother. "No," Jake Wagner replied. 6/13


I would love to be there to see George choke him to death.
