9/1/18 Update: A Mahoning County grand jury indicted Arturo Novoa, 32, Andrew Herrmann, 27, & Michelle Lee Ihlenfeld, 27 on 48 counts relating to the death of Shannon Elizabeth Graves. Novoa already faces an aggravated-murder charge in the death of Graves. Hermann and Ihlenfeld, along with Novoa, face counts of tampering with evidence, abuse of a corpse, possession of criminal tools, theft of WIC program benefits, intimidation, obstruction of justice, grand theft of a motor vehicle, drug trafficking & engaging in a pattern of corrupt activity. Ihlenfeld was charged by the grand jury with threatening someone between Aug. 13 and Aug. 15 of this year. Herrmann and Ihlenfeld are not yet in custody.

The indictment said Ihlenfeld is the wife of Herrmann and they allegedly obstructed the investigation into Graves' death. On Thursday (8/30/18), the Grand Jury handed up new charges against him. Herrmann's arraignment is 9/4. Novoa is now facing 44 charges, Herrmann is facing 14 charges and Ihlenfeld faces four charges.

Plead not guilty; held on $1M bond.
Trial was set for Oct. 10, 2017; trial delayed to March 5, 2018 and then delayed to Aug. 6, and on July 5, 2018 delayed to today 10/22/18, now on Oct. 18, 2018 delayed again. Instead Pretrial hearing will be held on 10/22.
10/22/18 Update: Next Status hearing on 11/15.

*Katrina L. Layton charged with same charges had 2/9/18 pretrial hearing and pled guilty in deal to abuse of corpse & obstruction of justice; will get probation as long as she cooperates & testifies against Novoa at trial. She is out of jail (3/28/18) on a $20K bond own recognizance; next hearing 10/29. 4/24/18: Accused of contacting witnesses; Defendant advised that an additional condition of her bond is absolutely no contact w/any witness on case except her mother. Youngstown murder suspect appears in court before new judge

"A Youngstown man accused of a gruesome murder was back in court Friday, meeting the new judge who will hear his trial.

Lou D'Apolito was assigned to the case of Arturo Novoa, but he retired in December. Now, Judge Anthony Donofrio will hear the case."

"Andrew Herrmann and Ellie Ihlenfeld are accused of helping him.

The trial for all three is set to start June 3."

Prosecutors: Woman lied in freezer case


YOUNGSTOWN

Prosecutors with the state attorney general’s office are asking a judge in Mahoning County Common Pleas Court to vacate a plea and sentencing agreement for a woman who confessed her role in the death of Shannon Graves, who was killed, dismembered and stuffed in a freezer.

Assistant Attorney General Dan Kasaris also asked Judge Anthony Donofrio on Tuesday to reinstate a $1 million bond for Katrina Layton, 35, because she has not been truthful.

Kasaris said in a motion prosecutors have evidence Layton lied to them and that she had still been communicating with Novoa through notes smuggled to him in the jail.

Another term of her plea was that Layton not contact any defendants or witnesses in the case.

Kasaris said some of the things Layton was untruthful about include: authorities believe Layton was present when Graves was slain; helped to move Graves’ body into her own garage; she knew the body was being kept in a freezer; she helped Novoa with the cleanup after Graves was killed; and that she had been in contact with Novoa as recently as Feb. 14 of this year.
 
Thursday, May 30th:
*Final Pretrial Hearing for all (@ 9am ET) - OH - Shannon Elizabeth Graves (28) (Missing Feb. 2017, Youngstown; found in freezer July 2017) – *Arturo Novoa (31) indicted (8/8/17) with aggravated felony murder, felony murder, 3 counts of tampering with evidence (F3), obstructing justice (F3) & abuse of corpse (F5) (found in Arturo’s friend’s freezer). Plead not guilty; held on $1M bond.
Trial was set for Oct. 10, 2017; trial delayed to March 5, 2018 and then delayed to Aug. 6, and on July 5, 2018 delayed to Oct. 18, 2018 delayed again. Instead Pretrial hearing will be held on 10/22. 10/22/18 Update: Next Status hearing on 11/15. 11/15/18 Update: Next Pretrial hearings on 3/4/19 & 5/30, trial set for 6/3/19.
3/4/19 Update: Motions in limine due by 5/20 with 7 day response time. Final pretrial hearing on 5/30 and Jury trial on 6/3.
*Andrew A. Herrmann (27) arrested (8/30/18) & charged (9/4/18) with 11 counts of tampering with evidence, 1 count of abuse of a corpse, 1 count of obstruction of justice & 1 count of engaging in a pattern of corrupt activity. Plead not guilty. No bond set.
*Michelle Lee Ihlenfeld (27) arrested (8/30/18) & indicted (9/1/18) with 2 counts of intimidation of crime victim/witness (between 8/13 & 8/15 of 2018), 2 counts of obstruction of justice, 1 count of engaging in a pattern of corrupt activity. Plead not guilty. $300K bond.
11/15/18 Update: Herman next Pretrial hearings on 3/4/19 & 5/30/19, trial set for 6/3/19.
11/16/18 Update: Ihlenfeld next Pretrial hearings on 12/11, 3/4/19 & 5/30/19, trial set for 6/3/19.
12/11/18 Update: Ihlenfeld bond set at $300K. Restrictions: Not permitted to leave residence; have weekly drug testing, no drinking alcohol, no drugs, not entering establishments that serve alcohol, weekly NA/AA meetings, no contact with any witnesses or co-defendants.
3/4/19 Update: Both-Motions in Limine due by 5/20 with 7 day response time. Final pretrial hearing on 5/30, jury trial starts 6/3.
*Katrina L. Layton charged with same charges had 2/9/18 pretrial hearing and pled guilty in deal to abuse of corpse & obstruction of justice; will get probation as long as she cooperates & testifies against Novoa at trial. She is out of jail (3/28/18) on a $20K bond own recognizance; next hearing 10/29. 4/24/18: Accused of contacting witnesses; Defendant advised that an additional condition of her bond is absolutely no contact w/any witness on case except her mother. Def. ordered to deactivate & refrain from using any social media accounts. Bond is cont'd with all previously ordered conditions in effect.
5/29/19: Prosecutors with the state attorney general’s office are asking a judge in Mahoning County Common Pleas Court to vacate a plea and sentencing agreement for a woman who confessed her role in the death of Shannon Graves. And to reinstate a $1 million bond for Layton, because she has not been truthful.
