The rape trial of a man charged with kidnap and murder in the Brooke Wilberger disappearance has been postponed because the judge removed himself from the case.

District Judge Michael Kavanaugh recused himself Aug. 24 from the New Mexico case involving Joel Courtney, according to court records. The case has been reassigned, but no new trial date has been set.

The trial was to begin Tuesday. The reason for Kavanaugh's recusal was not specified.

The office of Gov.Ted Kulongoski has requested the extradition of Joel Patrick Courtney, a New Mexico man accused of killing Brooke Wilberger.

Courtney, 39, has been charged in Benton County Circuit Court with abducting, sexually assaulting and killing the 19-year-old Veneta woman who vanished from a parking lot at a Corvallis apartment complex.

The extradition warrant has been sent to New Mexico Gov. Bill Richardson, whose office is processing the paperwork, a New Mexico governor's office spokesperson said.


Richardson will serve the warrant on Courtney when he deems appropriate, said Benton County District Attorney Scott Heiser. A Bernalillo County case is pending against Courtney, and he is not likely to be extradited to Oregon until that case is resolved, Heiser added.

Glad they got him.the .:behindbar I hope the tells them where she is so her family can bring her home to bury her. :( sounds like there will be more if they are calling him a serial killer.

A trial date in the New Mexico case has not yet been scheduled. It's not expected to make the court docket until spring 2006, said Bernalillo County Assistant District Attorney Theresa Whatley in New Mexico.

i just looked at the guy's picture....scary....he looks "normal". But i guess most of them do.....

Does anyone know where this Joel P. Courtney came from? I didn't see his name pop up in any of the other posts. And if the police think he did it, why can't they find her body?

I believe they found evidence in his vehicle that he had killed Brooke after he was arrested for attacking a lady in New Mexico.

Joel Patrick Courtney currently is incarcerated in Albuquerque, New Mexico. The FBI’s Violent Criminal Apprehension Program (ViCAP) Unit and the Corvallis, Oregon, Police Department are seeking information from all homicide, sex offender, and cold case units on cases in which Joel Patrick Courtney may be involved.

Courtney is a white male with a DOB of 6/02/ 1966. He has a goatee, wears two earrings in each ear, and is the suspect in the abduction and possible homicide of Brook Carol Wilberger of Corvallis, Oregon. She was abducted while working outside of an apartment complex on the morning of 5/24/ 2004 between 10:30 and 11:00. She was a 19-yearold college student, 5 feet 4 inches tall, 119 pounds, with blonde hair and blue eyes. She is presumed dead.

I just came to post this... it is scary!
Although the names of those victims have not been released, the FBI believes Courtney is a serial killer who targeted white females between the ages of 15 and 25, with blonde hair and blue eyes.

Courtney grew up in the Portland area and moved extensively. The FBI believes there may be victims in the following areas:

Albuquerque, NM
Anchorage, AK
Beaverton, OR
Bernalillo, NM
Cape Canaveral, FL
Cocoa Beach, FL
Grants, NM
Pensacola, FL
Portland, OR
Rio Rancho, NM

Well, ding it!~ LOL I guess the local article is not on the web yet, but SLC always does a great job on articles.

This is scary. One of the girls they say he killed is from Beaverton where I live. :eek: I wish we could do some research on who they might be. I'm ready to hit the hat, but maybe tomorrow I'll look to see in Missing if there is anyone who fits the requirements. One thing they said is that the girl in New Mexico looked just like Brooke. They all look very similar in appearance and age. At least it's something to go on, right!

Think I'll be spending a bit of time over here in the months to come. Bet we all will because I know there is a tender spot in all of our hearts for her.
