Roux: this is a factual question.

Roux you can't say your factual finding was wrong and we are going to find that it is a legal finding.

SCA I don't believe it was a factual finding. It isn't a positive finding of fact.
 
Ouch. Leach asking Roux to produce factual finding that OP genuinely thought his life was in danger. Saying that just because it was OP's version does not make it a factual finding - given that he was a dishonest witness.
 
Came to computer to do some work. Am resigned to a long night of updates instead. This is brilliant.

LOL. Leach saying the noise did not mean the door was just about to open.
 
How good to see Roux wriggle with discomfort. He got away with so much during the trial. Now he is arguing in an angry fashion with the SCA judges!

Roux refers to OP's anxiety and concedes negligence.

SCA did he believe he was entitled to shoot?

Roux: there is nothing to suggest this belief was not honestly entertained - that's a factual finding....that excludes dolus...

In only we had a competent judge for the trial, there would be no need for any of this, it would be all be done and dusted.
 
Basically, Roux is armed with two adjectives: 'factual' and 'genuine'; and he keeps repeating them in each sentence.

I think that's what Oscar's Uncle paid for. Not the verdict but someone inexperienced and who could be swayed by "remorse" and Roux's rhetoric. The downside for OP was that that also rendered her verdict legally flimsy.

Lol yea, I suppose next Roux will claim that OP didn't take the firearms course where he would have to have known he was not entitled to shoot to have passed it...
