Are we to believe that one social service agency after another felt the Tutkos posed no threat and the day would come when violence and starvation eventually would disappear like magic from the household? That kind of pathology doesn't cure itself.

What I find reprehensible is that their attorney KNEW the court was going to remove the children and so he advised them to move out of the court's jurisdiction so they moved to another state. imo, the attorney knowingly endangered those children and should be prosecuted for child abuse.

Interesting angle, and I agree that the attorney's actions are negligible, if true (maybe not in law, but morally so). I wonder at what point does a lawyer's "agency"/duty to represent a client override public safety. I hate lawyer bashing, but it's worth the discussion. Codes of conduct usually apply in professional settings.

There are attorney codes of conduct and ethical duties and it is time courts enforced them. There was a court hearing scheduled so what reason did the lawyer give to the Judge for not holding the hearing? Did he lie to the Judge and claim he didn't know where they were? He knowingly placed those children at grave risk.

It is worthy of discussion because we have children dying all over the country because their abusive parents keep changing "jurisdiction" so that CPS can't find them. Instead of contacting police, CPS just drops the case. This case and Colton Turner are excellent examples. Instead of giving these lawyers a free pass, any lawyer who advises a parent to kidnap their children and take them to another jurisdiction should be prosecuted for child abuse. This case was a parental kidnapping because the court was going to award custody to the State.

A couple charged in the starvation death of their 9-year-old son were ordered Thursday to stand trial on charges of criminal homicide after a hearing in which a police detective described discovering the child’s decomposing body.

Harrisburg District Judge Barbara Pianka also ordered Kimberly and Jarrod Tutko Sr., to remain held without bail following a 90-minute preliminary hearing in a cramped courtroom at Dauphin County Prison.
 
How tragic - the little boy would have had a difficult enough life anyway because of his disabilities, and then for his parents to leave him to die like that - horrific :( Rest in peace, Jarred.

I wonder if the little girl who was in a vegetative state and apparently close to death is okay now. Where I live, a child in a vegetative state would be in a hospital or nursing home so they could get specialist care. How long had she been in vegetative state? Were no professionals coming round to check on her? Very strange situation.

He is said to have had Fragile X syndrome, a cause of autism. The coroner's report noted that Jarrod had an empty stomach and badly rotted teeth; he died from starvation and child maltreatment syndrome.

Shoeman's sometimes graphic testimony added disturbing details to the prosecution's well-publicized contention that Jarrod Jr. died of abuse and neglect at the hands of his parents. His words, and photos that McCormack entered into evidence, prompted occasional gasps from members of Jarrod Tutko Sr.'s family who attended the hearing at the county prison.

The handcuffed and shackled Tutkos sat within a few feet of each other, separated by a burly security officer, and never looked at one another during the proceeding.


Jarrod Sr., 38, sat behind his lawyer, Chief Public Defender Bradley Winnick, and spent the hearing either with his head in his hands or staring at the floor. Kimberly, 39, was visibly nervous and jiggled her legs as she conferred with her attorney, Anne Gingrich Cornick.

On the third floor, where the little boy lived, he said he found mothballs and an open can of deodorant. The bedroom door locked from the outside, Shoeman said, and the lights didn't work.

The only furniture in the room was a TV bolted to a table in one corner, the detective said. The TV's screen was smeared in human feces, he said, as was the light switch, door knob, walls and a stuffed toy rabbit that was lying on the floor.

Jarrod Sr. later told him the rabbit belonged to his dead son, Shoeman said, and that Jarrod Jr. "would bite that when he was mad."

Shoeman said he also saw maggots on the third floor.

Shoeman said Kimberly Tutko was the one who called 911. She told him she rarely, if ever went to the third floor of the home, where Jarrod Jr. lived, because of her asthma and chronic obstructive pulmonary disorder, he said.
McCormack noted that, after her husband's arrest in August, Kimberly Tutko was seen on TV giving reporters tours of the home's third floor. Kimberly Tutko was arrested more than a month after charges were filed against her husband.

Ariana Tutko was taken to the hospital for medical concerns the same night her brother's corpse was found, the detective said. "I was informed she was 12 hours away from death," Shoeman added.
"He deserves to rot in hell," said Tutko Sr.'s aunt Elaine Sargent, who had traveled from Shenandoah with two of her sisters to attend the hearing. "It's disgusting. Both deserve to rot in hell ... for a long, long time."

Defense attorneys Anne Conick (Kimberly Tutko's) and Brad Winnick (Jarrod Tutko Sr.'s) declined to comment after the hearing.

Thursday morning, Jarrod Tutko, Sr.'s aunts minced no words in expressing what they want out of the judicial system.

"We want justice to be done to him. Both of them," said Helen Tyson, an aunt of Jarrod Nicholas Tutko Sr.

Tyson, accompanied by two of her sisters, traveled from their home in Shenondoah to attend the hearing. Speaking to PennLive prior to the hearing, all three agreed they were not surprised that their nephew was facing criminal charges.

"He's a sneak and a liar," said Donna Bowen, one of the aunts. "That's how I felt about him when he was a teenager."

Jarrod Tutko Jr.'s mother has said he suffered from Fragile X Syndrome, a genetic disorder. Coroner Graham Hetrick has said he has yet to verify that. The boy weighed 16.9 pounds when he died alone, locked in his feces-covered room without working lights.

That information led us to a letter - written in the spring - to Commissioner George Hartwick predicting how this new program will result in the death of a child.

During our investigation we obtained this letter, sent anonymously by a CYS employee to George Hartwick, the County Commissioner who oversees the agency. The two-page letter, sent three months before Tutko’s death, predicts a child will die due to these agency changes.

Time for an update for this case that captured so many of us when it broke.

When asked whether Vriens's retirement was at all related to the Jarrod Tutko Jr. case, Richards Harinath said she couldn't comment on a person's reason for retiring.
The county's Children and Youth Services department came under scrutiny after police on Aug. 1 found the 9-year-old boy's decomposed body at his home on 2119 Green St. in Harrisburg. He weighed less than 20 pounds when he died, and his parents, Kimberly Tutko and Jarrod Tutko Sr., are facing charges in his death.

Last update on the criminal case against parents is that the plead not guilty. Cannot find anything to indicate when they are expected to go to trial.
 
heartbreaking. Reading the GJ report. So much for mom being completely immersed with caring for ART that she ceded all caring for Jarrod to her husband. Poor overwhelmed mom was certainly not overwhelmed with teh task of caring for her vegatative daughter.

Those poor children. Every last one of them.
