Jury seated for trial of Abington couple accused in child's death

NORRISTOWN — A jury has been seated in Montgomery County Court for the trial of the mother of a 4-year-old Abington boy accused along with her boyfriend of taking part in the boy’s fatal beating after he spilled his cereal.

Seven men and five women were selected on Monday to weigh the fates of Lisa Smith and her boyfriend Keiff Devine King, who are accused in connection with the Jan. 22, 2018, death of Smith’s son, Tahjir.

Four alternate jurors — two men and two women — also were selected for the trial. Alternate jurors listen to all testimony but only become a member of the deliberating panel if any of the 12 primary jurors can no longer serve.

Judge Risa Vetri Ferman, who will preside over the trial, will give the jurors opening instructions on Tuesday morning. Prosecutors and defense lawyers will then make opening statements to the jurors.

Boy, 4, was beaten to death for spilling his cereal, police say. Now, his mother and her boyfriend are on trial for murder.


When 4-year-old Tahjir Smith spilled his cereal on a January morning last year, prosecutors say, his mother and her boyfriend beat him to death.

On Tuesday, in a Norristown courtroom, the lawyers described for a jury the last terrifying moments of the boy’s life. They said the couple beat him about the head and body with their hands and a sandal until he fell unconscious in their Abington home, and then put him in a shower and ran scalding water over his body.

Lawyers for Smith and King said the couple were under stress at the time and did not intend to kill Tahjir.

“An outcome does not equal intent,” said Smith’s public defender, Carrie Allman. “Ms. Smith did not intend to kill her child.” :rolleyes:

Prosecutors said Tahjir’s death was the culmination of a long pattern of abuse. In fact, they said, on the night of the child’s death, under questioning by Abington police, his mother confessed.

The “Levi’s sandal” was found on the kitchen floor of the #Abington home shared by Lisa Smith & her boyfriend Keiff Devine King during the investigation into Jan. 22, 2018, death of Smith’s son, Tahjir, detectives testified.

Each #MontcoPa juror inspected “waffling pattern” on the sole of the flip flop, which prosecutors alleged matched characteristics found on 4 yo Tahjir Smith's buttocks during an autopsy.

#MontcoPa Detective Todd Richard testified Keiff King, during an interview, admitted he “whacked” 4 yo Tahjir Smith with the flip flop during a discipline session after the boy spilled his cereal. “He knew it was butt whooping time,” King allegedly stated, according to Richard.

Keiff King allegedly also admitted to striking 4 yo Tahjir Smith with a belt several months before the 2018 fatal beating. “I established the structure in the house. I brought the sternness,” King allegedly told #MontcoPa detectives, according to #trial testimony.

When #MontcoPa detectives asked Keiff Devine King why he struck 4 yo Tahjir Smith with a flip flop, King allegedly replied, “Tahjir would no longer respond to being hit with a hand.”

Defense lawyer Francis Genovese has completed his closing argument to #MontcoPa jury on behalf of Keiff Devine King who is accused of role in fatal beating of 4 yo #Abington boy. He argued King's alleged crime is more akin to manslaughter & not murder.

I guess the defense didn't call any witnesses - at least it wasn't tweeted.
 
They were "under stress" and "didn't mean to kill him". So, beating a child and scalding him is perfectly understandable. After all, the FOUR YEAR OLD did SPILL CEREAL!!!!

Geez, didn't these folks have a dog? Seriously...what is with people? Put them both in jail.
