#MontcoPa jury has been deliberating fates of Keiff King & Lisa Smith, #Abington couple accused of roles in the fatal beating of Smith's 4 yo son, Tahjir, for just over ONE HOUR now.
Defense lawyers Francis Genovese, who represented Keiff King, & Carrie Allman, who represented Lisa Smith, suggested prosecutors don't have sufficient evidence to support 1st-or 3rd-degree murder convictions. Genovese & Allman argued neither King nor Smith intended to kill Tahjir
“He had no specific intent,” defense lawyer Francis Genovese argued on behalf of Keiff King during his closing statement to #MontcoPa jurors. “There’s no reason for him to have any hatred, ill will or malice toward Tahjir.” King & Lisa Smith accused in fatal beating of 4 yo boy
Defense lawyer Francis Genovese suggested jurors consider lesser charge of involuntary manslaughter, which is a death that results from reckless or grossly negligent conduct. Involuntary manslaughter is punishable of up to 5 to 10 yrs in prison.
“My client, Mr. King, was reckless. My client, Mr. King, was negligent in the actions he took that night. That doesn’t make it murder," - defense lawyer Francis Genovese argued on behalf of Keiff King, accused in fatal beating of 4 yo #Abington boy. #MontcoPa Court #trial
Defense lawyer Carrie Allman, who represents Lisa Smith, argued, “Outcome does not equal intent.”
“The evidence presented did not establish intent. What happened to Tahjir that day should not have happened. But that wasn’t what was intended that day,” defense lawyer Carrie Allman argued during her closing argument on behalf of Lisa Smith.
Defense lawyer Carrie Allman argued Lisa Smith & Keiff King tried to discipline 4 yo Tahjir, poorly, but that they had no malice, did not intend to kill & never thought the discipline could lead to death.
“It was discipline that got out of control,” Allman suggested.
But #MontcoPa First Asst. DA Edward McCann Jr. scoffed at the defense suggestions. “This is not discipline gone bad,” McCann argued to jurors at #trial. “They didn’t have a stopping point until Tahjir Smith was dead”
“It was a course of conduct in this case, more than one act over a course of time,” #MontcoPa First Asst. DA Edward McCann Jr. argued to jurors during his closing statement at #trial of Lisa Smith & Keiff King.
“We have two people who were involved in months of abuse of a 4-year-old boy…who was ultimately killed by them,” #MontcoPa First Asst. DA Edward McCann Jr. argued to jurors during his closing statement at #trial of Lisa Smith & Keiff King.
Testimony revealed 4 yo Tahjir Smith suffered bruises, black eyes, broken bones & burns, culminating in alleged Jan. 2018 beating that ultimately ended his life. “It shows you the hardness of heart they had for him, the malice they had for him" #MontcoPa Prosecutor Ed McCann Jr.
“This was a child who was in really, really bad shape. They watched him die,” #MontcoPa First Asst DA Edward McCann Jr. argued to jurors at #trial of Lisa Smith & Keiff King, who are accused of fatally beating Smith's 4 yo son Tahjir.
#MontcoPa First Asst. DA Edward McCann Jr. said 4 yo Tahjir Smith wasn’t a child who saw “monsters” in movies or read about them in books. “He lived with two of them,” McCann argued to jury at #trial of Lisa Smith & Keiff King, who are accused of fatally beating Tahjir
