Since the OP has not responded to these questions about her post, I’ll give my opinion about what she is implying, with apologies if it turns out I’m wrong.

It’s been quite clear that the OP is a dedicated Shacknai supporter, which is certainly her right, even though I strongly disagree with her posts and general tone. So what I believe she is implying in relating her experience, is that the defense attorney will contact the jurors, seeking information about their deliberations. If one juror is willing to sign an affidavit that there was misconduct, as the OP was, the judge may declare a mistrial for juror misconduct.

The implication in this carefully worded post is that she believes it is likely there was juror misconduct, and obviously hopes there was so a mistrial will be declared.

This is so far beyond the pale that I hope I’m wrong. But I think a light needed to be shone on this attitude of assuming wrong-doing on the part of 12 good people.

MOO, JMO, etc.

IANAL but I don't think the defense can just go on a fishing expedition like that.

Maybe a real lawyer can weigh in.

It's always felt like there is an untold story here. Still important things we don't know. JMO.

What I want to know is, does his office still stand by its findings that the McStay family voluntarily walked across the border into Mexico of their own free will?

Yes, but I'm wondering how 3 couldn't arrive at the conclusion of the majority. How could common sense have escaped 3 of them?

One possibility is that they believed it was murder but not proven beyond doubt that Adam was the one responsible.

Same.
I get being emotional, but I was disappointed. There were many things that Webb said that were misrepresentations of the facts, but maybe he really didn't think that Webb's closing arguments made a big impact on the jury. In my opinion, Webb went in really hard on Mary and Greer saying that they are making up fiction to fit their own scenario. And he harped on this and repeated it many times, with Mary sitting right in front of him. It might be a good thing that Greer rebutted the way that he did, making it look like "Here this poor family is yet again being victimized by the more powerful". Especially that Pari Zahau was at the plaintiff's table, who was clearly very emotional the entire time the judge was giving directions to the jury.

the $5000.00 and 1 penny suggestion for compensation was very smart on greer's part, because that counters webb's theory that Mary is making anything up possible to prove her own narrative, but they would have to wonder why? $5000.00 annually for her mother is not breaking the bank.

all my opinions

You reminded me of something I was going to mention but forgot: $5000 is just over $400 a month. Some people made it seem like Rebecca was just pouring money to her family from her "rich boyfriend".

If that's how much she was sending on average, it was barely worth a blink of Jonah's eye. He probably spent more on dry cleaning in a month than that!

On the subject of money, in an older article I read on Webb, his hourly rate was back then $700 an hour. I don’t doubt that the defense has by now incurred as much as the sum awarded to the Zahau family. Didn’t the defense try to settle earlier or was that a rumor? If so, it would have made sense to have cut their losses and done so. But this trial was never about money.

A question was brought up last week and I never saw an answer. Was Adam examined and photographed for scratches and abrasions? I know he had a long sleeved shirt on when they questioned him. Anyone happen to know?

It didn't have to be proven beyond doubt, or even beyond a reasonable doubt, in a civil case, however.

I don't know, but given the way the investigation was conducted, I would bet not.

Assuming this is the same guy, by 2015 his hourly rate had gone up to $1335.

Edit: I'm not posting this to derail the thread into other topics. Please don't go there. Thanks.

Can you clarify what you are implying?

I seriously doubt that happens. This case is far from over, imo. I was on a wrongful death jury. After three weeks of trial and a week deliberation the final vote was split. My home phone was ringing when I walked in the door later that afternoon. It was the defendant's attorney's office. I was asked a million questions about what went on in the jury deliberations and went in to his office next day to sign an affidavit.

The judge later declared a mistrial for juror misconduct.

Hi MyBelle, you might have missed it but I asked for clarification on what you are implying. I'm still hoping you will clear things up because my interpretation is that this is a veiled threat of some sort. You are implying something and I think it would be just dandy if you could be more forthcoming on what you are trying to say. Surely you aren't trying to say that you think the jury is tainted or compromised in some way?

Greer is not kidding when he says the verdict is not about money because AS can retire tomorrow and nothing anybody can do about it. He will not lose his home, it's exempt! Case and point: Goldman Family awarded $35M in their Wrongful Death Lawsuit against OJ Simpson. Their award today stands at about $70M and almost nothing, zilch, has been paid to Goldman's on the verdict. OJ retirement, residence, etc. are typical protected assets from judgement.

I really don't want to bring up politics. But it is the same guy?

Ahhhh....some will agree with his actions, and some will disagree... but it’s so blooming divisive....shall we all agree... no politics?

Shall we give a BIG shoutout for the ladies and gentlemen on this jury who put their lives on hold and made a significant sacrifice of time from their ( and their family’s ) lives for the sake of justice...and, in fact, to everyone who serves on a jury in the US.

Real people, who are the heart and soul of America.

Thanks for highlighting this for us BBL, they deserve our recognition.[emoji1360]

...That’s a fact...not my opinion!

I am in full agreement. I posted only to see if it is the same guy (it is) and to document his hourly rate.

More than one grand an hour. Holy moly.

Welcome back JBS! It was NR whose Insurance carrier settled and I believe that's where the rumor rumble hit the boards.

Before the trial, I read the 2015 Engagement Agreement between Winston & Strawn hired to represent Ferguson, MO in it's US Justice Dept Investigation and Dan Webb was designated Partner in Charge normal billing rate @ $1,335/hr. (Rates ranged $725hr - $1250).
