Question for AZLawyer- can you shed any insight into how JM goes about planning his cross examination? I'm curious if he has a broad plan in advance, and then fills in specific details/questions based on how the questioning of the witness goes in court?
He always seems to have the details committed to memory, and he asks his questions quickly... I am just curious what sort of planning he must go through, and how he decides which angle(s) he wants to take against the witness. I feel he has many different angles at which he come at Dr F with... and I wonder how he chooses.
Perhaps there are specific goals he needs to accomplish in the cross of this witness (and he then plans his questions around those goals)- what do you think those would be during the penalty phase of a DP trial?

I plan a cross lol. I don't know how JM does it. I have a broad plan based on what I know of the proposed testimony. I normally plan to argue 3-5 "gotcha" areas, as the jury begins to zone out after that. I normally ignore anything I can't absolutely decimate, unless it's really critical to the case. I fill in details as the direct exam is going along, especially trying to find areas in which I can use the witness's own words or approaches against him or her.
The goal with Dr. F is to make her look like a biased fool who would take absolutely anything and twist it into evidence of pedophilia and abuse.
Nurmi turned over the HD to the court, not his expert, if he ever had such a thing this fall. So yes, Nurmi had the HD.
I don't think anyone turned the HD over to the court. The court wouldn't normally ever have custody of a HD. I think JM said the defense turned it over to him, but he would say this whether Nurmi handed it to him in court or the expert's office sent a courier to the prosecutor's office.
Reviewing the professionalism of the DT's original computer expert is what sent me to Dworkin's testimony. IMO, whoever pulled this latest screw up/delaying tactic? It wasn't Dworkin. He seemed extremely buttoned up when holding/tracking evidence in his possession. Could be wrong, but -- IMO -- LD would not risk his reputation by mislaying evidence and failing to follow computer forensics SOPs.
I've known Lonnie for 15 years and I agree 100%. I would be shocked if he mislabeled anything, including the containers in his freezer lol.
I'm confused. Why was this Tony's computer with the DT to begin with? How did the DT get their hands on it?
I'm sure the convicted murderers hands are all of this, but im just curious how it was in the possession of the DT to begin with.
JMHO the DT is doing everything they can to make Mr. Martinez to run around putting out fires just to delay and delay.
The defense expert likely has multiple HDs in his/her possession from various cases.
What expert? We don't even know there was one. We only know for sure that her PI took possession of the HD.
I don't give Nurmi a free pass on anything relating to this HD, and no, I don't believe he was so careless as to turn over a HD that JM demanded after N's accusation without knowing something about it.
I think we do know there was an expert. I think JM and Nurmi both referenced an expert in their recent filings. I don't think we know that the PI ever had possession of the HD. But I'm totally open to correction if you've seen something different.
I think if Nurmi told his expert to send the original HD over to Juan's office, he certainly wouldn't check it to make sure it was the right one. You don't even want to turn on an original HD if you're trying to preserve evidence on it.
Hey Tart, I'm behind so you may have gotten your answer. There are several DP cases that have "joined together" so to speak and filed a motion to rescind their DP sentences. Nurmi filed a motion to allow JA to add her name to the list. AZL could do a much better job explaining this.
