Right. Any long delay like that between the HEADER DATE of the message and when the recipient received it would be a red flag that the composer of the email had fudged their date on their computer.

The excuse of "servers must have been slow" would not be a good excuse for JA. LE probably looks at recipients actual received dates of when they get their emails.

Its just something to keep in mind because if the DT is just referencing the email header itself, this is how JA could have been trying to lie about things.

It doesn't work for students emailing homework either. ;-) I'm sure the State did a complete e-discovery job with Google and Gmail. There are Russian spammers who might be able to fake email headers, but I highly doubt JA could do it in a convincing way with Gmail. It will be funny if the defense gets busted on something that easy to refute, especially with all of their computer forensics experts.

<respectfully snipped multiquote to explore this single question>

Can he even farm out to a firm that is not licensed for court?

I've been searching and reading, and it looks like license requirements vary from state to state. Most states that require a license for computer forensics examiners roll that license into the private investigator license. Arizona does not require a private investigator license for digital forensics examiners. AZ does require PIs to be licensed, and several computer forensics labs are licensed as such—you can search here: http://licensing.azdps.gov (I entered the letters "comp" in the Agency field, for instance.)

There are lots of certifications that digital forensics examiners can obtain. Most computer forensics expert witnesses have at least one or two of these, I've read*. I don't see any of them listed on BN's site or AZ Computer Lab's web site. This shows me that Nurmi must be more interested in *advertiser censored**ing with Juan Martinez than he is in keeping his client's head out of the noose.

I read this last week and thought of JA, don't know if it applies but this girl did something using a website to send email saying it was from someone else.

http://dailycaller.com/2014/12/18/what-uva-student-jackie-wrote-in-email-about-friend-she-liked/

Thanks. I heard about that case. She is another one who seems to be living in "left field" LOL

Spoofing the sender's email address itself is definitely harder and I have heard of websites that offer that service for a fee. That kind of thing can cause terrible confusion and even get people mad at the wrong people.

My dad got a computer virus once that went through and sent emails out to everyone in his address book and he had a lot of people get mad at him, but it was the virus that did it. When I got the email from him, I immediately suspected it was a virus he had because he could not type that legibly and he used all CAPS normally...LOL

But others got mad at him for it. I told him he should send an apology letter out to everyone in his address book which he did. I then tried to teach him how to install and keep antivirus software running and up to date on his computer but he never fully understood and he finally gave up and just got rid of the computer. I felt so sorry for him but I do understand how some of his generation just never grew up with these things and they are very confusing.

As we age we forget more than we ever knew. I use to be pretty good not anymore. Sad for your father.

Look at the date of the text!. Why didn't we see this email? Perhaps because the defense did not turn it over to Juan? Is this the proof that she doctored her journal? She says there were scandalous texts and videos. Wasn't the date of the phone sex call after this date?

This is from Jodi's journal. She's writing about the May 9th (8th) sex phone call. And having the "conversation" with Travis as if she was the one wanting to stop seeing him, when she's begged him to come to Yreka - twice - and he'd backed out. That is in the cellphone conversation , you know the one on the stolen phone that was found two years later.

Two days later on the 24th Jodi was asked to sing the National Anthem at a car race that Saturday. Travis in an email/text told her he was stressing out about Jodi not telling what she had plans for them to do. Jodi told him she want to "d-stress him, and she meant in sexual way. She went looking for a tree in the woods for them to use. I wonder if she was going to have someone tape it for more blackmail for her to use. A tape sent to Travis's friends maybe, and especially for Mimi She in a school girl costume tied to a tree and Travis having anal sex with her. That was to completed the "fantasy" in the May 9th call.

And the use of impending instead of upcoming. Sounds more like doom and gloom dreading it, while upcoming sounds like hope and happiness and looking forward to it.

Don't tell me she's still incarcerated!

I mean, it's Christmas Eve--wasn't she supposed to be home by now?

Gosh Jodi, what's a girl to do when you can no longer trust the internet trolls who toot your horn?

Yes! The phone sex call was 5/10 according to Dworkin who took it off the phone, and also, she was supposed to have been staying at Travis' before she left to go back to Yreka, she kept telling Flores she couldn't remember the date but it was supposed to have been about the 1st of April but she thinks it was closer to just before the 10th. She either doctored her journals or she doctored the date of the phone sex call.

hahaha

"...can't keep my lies straight".

Gus Scercy would be one person I'd look to doing dirty work for Jodi. He wanted in her pants. He was the "shoulder' Jodi cried upon when she stayed with him for several days, at his double wide mobile home picking the Helio cellphone and Travis was being mean to her. The Helio that recorded the sex phone call. And he started the voice recognition software like Dragon. According to him you can change the voice of to whomever you want them to sound like. So when was Jodi in Yorba Linda in late April early May?

Yorba Linda is only 387 miles - five hours and eighteen minutes - from Mesa and Travis. A straight shot to Mesa on I 10.

DF: Okay. I’ve been focusing on this and going over and over in my mind why this happened… why your phone turns off here outside of Los Angeles…

20:07
JA: ‘Cos I eventually started seeing signs umm for Phoenix, and I was like… and it was several hundred miles away still, like that’s weird, where am I going, ummm… (JA begins to draw a map on paper). So you have California, Los Angeles, and … ummm Nevada... Arizona…Utah, and I was supposed to go somewhere right up here… oops.. I’m a lefty…so 15 kinda' does one of these

and Jodi says she ended up on 40 when she was lost, but she doesn't know where Phoenix and Mesa are.

There's something weird about that sex phone call, in the first trial BN said he was hired to 'enhance' the audio on it because Travis' voice was very difficult to hear on the recording - why would it be that hers was easy to hear but not his? I don't use a cell but in things like replayed 911 calls and such it's easy to hear both sides of those recorded conversations, why would only Travis' voice need enhancement?

Now I wonder why LD wasn't their go to guy this time?

Probably because LD's opinion would not change from the initial trial. Data is Data, it doesn't lie, it cannot be twisted, it is what it is. If I were LD, I would not jeopardize my reputation to serve someone else's purpose as the future of my company depends upon it.

It was a ploy to make TA sound worse than Jodi. I have always said they need to have JA's words on the big screen too. Her "leading" words were just as bad, but they wrote TA's words IN BIG LETTERS. JA's sex talk be written out too!

This is what I don't understand, licensing requirements or not. It seems to me that ANYONE who works on a product that is going to be used in a capital murder case should be REQUIRED by law to appear in court if questions arise. Otherwise, don't bother touching the evidence.

How can the DT give over evidence to a technician and then not expect them to be questioned down the road if a problem arises?

I just noticed something. In Juan's latest objection to the current motion, he says that JA bases the motion on the fact that the defense did not adequately investigate Travis' computer? Am I reading that correctly?

Edited to add a link to Juan's objection:

It appears to me that they never checked the June 2008 copy of the HD? They just asked for it a couple of weeks ago for the first time?

MOO

It looks that way, yes!

I'm not a technical person, but it looks to me like the DT chose to examine the computer itself and make their own image/clone/whatever in 2009 instead of asking to see the PT image on which their expert's report was based. The PT has to disclose the evidence but it doesn't have to tell the DT how to look at it. Since Melendes referenced his clone/image in his report and how he got it, that is all that is required. Lonnie and the DT should have asked for the copy of PT image back in the day.

Three days after finding Travis in his bedroom on his bed masturbating to a picture of a little boy, and Jodi's happy to be back in it.

Jodi journal entry January 24 2008

I`m trying very hard not to be in a state of blame right now, but if it weren't for Travis borrowing all of my money, I`d be in San Diego tonight. I spent $40 on two super Saturday tickets to see Jeff Olson (ph) and visit with my friends that I miss very much, but I've been squeezed dry and then some because of him.

I drained my checking account to put money into his and then was hit with tons of fees, fees that he isn't going to pay, $96 worth. And he has the nerve to tell me to balance my checkbook. Nay, he didn`t just tell me that, he screamed it at me, and then proceeded to say that he wants to get a gun and put it to his head and pull the trigger.

I was crying because it distresses me to see him like that and because I know all too well and first-hand what it is like to be where he is1. So it was with great compassion that I calmly, sweetly, to my best ability, soothingly told him that everything was going to be all right, that, like always, this, too, shall pass, that I promise everything will be worth it in the end.

I wanted to soothe away his worries. He was under more stress than I had ever seen him. He was really despairing today. I lended him another $80. I went to the bank for him to deposit it into his account since he said he doesn't want to step foot in that bank again today. By the time we had parted, things seemed a little better.

True, I could just marry Travis, but as wonderful a guy as he is, I just don`t think we are quite right for each other. I'm a little too sensitive. Although I prefer to think of it as Christ-like. And he is a little too rough around the edges although it is nearly impossible to imagine my life without him right now, he is amazing and he can cheer me up in a snap by singing me songs and holding me close. I like it when we cuddle. That`s the very best. On my bad days he brings me up, but I fear I rely on him too much for that sometimes. He is way too stressed in his own issues. He invariably suggests that we both distress by, well, being naughty. And although it is a temporary relief I think it is causing more problems. Besides, if it is something that I can`t tell my bishop then I probably shouldn't be doing it.

Well, today was interesting to say the least. Highs and lows. Travis was obscenely mean to me, but then he was extremely sweet and apologetic. It`s easy to forgive him when I remember who he is, who I am, and who we all really are, which is divine offspring, children of God.

He`s so hard to say no to. We totally made out afterward. But he was so sweet and kind and attentive the entire rest of the night. It was a long drive back from Las Vegas. Travis was being extremely impatient, but eventually he got over it. So I raced home, freshened up, and headed over there with tootsy pops. He makes me want to be so naughty. And naughty we were. We went all the way again. It was different this time. He was different. He was tender and sweet and loving. He said he had been planning and hoping for this. He said he wanted to savor the moment and make it last as long as possible. He asked me if I felt guilty and I said yes. Then he told me he wanted this because he wanted us to always have something special. Perhaps it was like closure for both of us.

So we know the day the tootsie pops were involved and that they went all the way for the second time. IIRC Jodi tells Travis in the sex phone call that he made her feel like a Goddess the day he had rose petals and candles down the hall to his bathroom and around the tub. I think that is the "first" all the way sex. Jodi said that is didn't count according to Travis because it was underwater.

Wouldn't you be talking about sex acts more recent than four months ago? Jodi always seems to be in control and a saint while Travis is an short tempered and mean to her.

All the way sex after being broke up for seven months -

If you can read all of this on day it is so laughable. Nobody pats them self on the back as much as Jodi and her kind words of wisdom and gentle ways.

I love your whole post. Every time I see the bolded above, I almost wet my pants. Nay. Who talks like that?

Totally O/T but everything on WS for me at the moment is center-justified instead of left justified. Anyone else? Is it me or is it WS?
