10:06 Martinez is taking Horn through a number of x-rays. The first ones are of the head which show where the bullet lodged in his left cheek, then of the chest. Now, photos of his hands are shown. There is some mummification of the hands but there are injuries to the hands–right thumb has a cut down it. An incision is a cut that is longer than it is deep as opposed to a stab wound which is deeper as opposed to longer. Another photo of right hand is a clearer view of the thumb. Sidebar called by Willmott (which means she’ll conduct the cross examination of Horn).

9:48 Nurmi says Mesa PD had the opportunity to analyze the Helio phone which was disclosed to them in 2010. “For whatever reason, they didn’t analyze it.” Nurmi: If cautionary instructions are not provided and a mistrial is denied, then we want to call Martinez to the stand to ask him questions about it. Martinez: I take no issue with the recording. The telephone was never turned over to Mesa PD. They’ve had it all along and they have no duty to turn it over to us.

The defense is really getting desperate.
