I agree that No. 9 will not be a mitigating factor. She created the tumult in their non-relationship with her stalking, sneaking, and recreational sex.

Yes, and IMO JM is on his way, step by step, to disproving this allegation--in fact, he is not very far from flipping the script, instead proving she was the one who brought chaos and deception into the relationship, and that they were ****** buddies (brilliant move on JM part to call into question whether they were ever exclusive or not) but she believed she could get him to want her as his wife and when he wasn't giving in to her charms she became a jilted lover with a lethal obsession.

and today in the metroplex a woman is going on trial for killing her boyfriends two year old little girl. She said an intruder broke in and placed duct tape over the little girls mouth. I did wonder briefly if it was zanny the nanny on the lose again. OBTW the little girls father had broken up with the woman earlier in the day.

I wouldn't mind. But here in the french part of Switzerland it just started snowing and it's actually only the third time this winter.
I love it when the snow stops the hectic urban life... There's less noise, everybody is anyway too late so people calm down, start paying attention and talking to each other...

I agree. That was my first thought - who, that is so damaging to the defense, are they trying to exclude. Someone they definatly don't want the state to present. Someone we know will help seal the sinking of the DT.

Warms my heart to know they're afraid of JM's new witness, whoever it is. Bet it is Abe too.

The great advantage JM has is that there are probably literally hundreds of folks willing and eager to show their faces in court to testify for and about Travis. As you sow, so shall ye reap.

I think it could be just about any witness we can think of that JM decided he needed. Aside from Abe, there's Chris/Sky Hughes since heresay is now admissible. There are problems with Chris and/or Sky for any number of reasons.

Been through a few blizzards, even in Northern VA. It is a nice, quiet time, but finding and digging out the car can be a pain. Same holds for clearing driveways and sidewalks. So far, we will only be getting rain and above freezing temps.

I have a question for AZLawyer, or anyone else who may know the answer:

IF a member of JA's family were to testify, would that person take the stand, with direct and cross examination?

--OR --

Would the family member make a statement to the court without any direct or cross examination ?

I do not know which is correct, and before I make a comment, I would like to know which procedure is followed.
