There is nothing here yet to indicate she was talking on her cell - only that she peeked at her cell phone - still not the right thing to have done if against the class rules.

We need more video in order to elaborate and speak with authority on all that she did. Making things up or jumping to conclusions is no better than some media attempts to inflame. Jmo.

He clearly tosses over the desk and then drags her and the desk, effectively dragging her OUT of the desk. I think the correct words were used.

Maybe she should have left voluntarily when asked by three separate authority figures.

It does not even matter what she did or didn't do beforehand . The teacher and vice principal asked her to leave the class. She refused. The Deputy asked her to leave the class. Again she refused. She is a senior in high school. Surely she understands that a Deputy has the authority to ask her to leave the class room.

IMO there's nothing she could have been doing in class that would justify his behavior. I certainly didn't see anything on the video that explained his overreaction. Was she resisting arrest, threatening anyone, brandishing a weapon? He's the adult, the professional, the grown up, the one hired by us to protect and serve. JMO but I don't hire cops to treat kids in school like this.

And why has he been placed on leave? For being correct in his behavior?

Whatever happened to just plain old "respect"? None of this is ok on any level IMO. The "peeking" of the cell phone caught the teacher's eye so I guess The student was Doing more than peeking, which I am sure she knew better than to do. There are rules for everybody and if there was more respect shown and less entitlement exemplified, things like this would not happen. Ridiculous.

If she was resisting arrest was this justified?

JUST NOW on CNN Sheriff Leon Lott said there is a 3rd video that shows the girl punching the officer---

I would like to point out the teacher, administrators and the officer all are servants of that student and her parents and every other student in that school and all the tax payers in that community.

It is not a crime to be on your cell phone. At the most the girl could have been trespassed off the sxhool grounds and that in most jurisdictions requires an administrator and in some cases even the school board depending on the truancy laws etc....

There was never a law being violated that required a LEO to place his hands on another person. Just because a cop has a badge if dis not grant him the right to assault or batter someone.

Did you never get caught whispering or passing notes in school, or daydreaming while looking out the window?

Yes. THIS. I wish more people understood this.

Exactly. we are all taxpayers. And if my kid was a student in that class, I would want them to have some learning time. If the teacher asked a disruptive student to leave, that student should do so.

It is not a crime to be on your cell. But it is against class rules. A teacher has the right to confiscate the phone. And a teacher has the right to ask a student to be removed from class.

Sheriff Leon Lott just now said on CNN, that the student punched the officer and there is another video showing that.

And if he attempted to touch her first she has the right to defend herself.
The cop had to have an actual law being violated before he claim someone was under arrest.

Resisting arrest is not a legal claim on the first condition.

No. She does not have the right to punch him.

She was asked to leave the classroom. He has the right to remove her.

So if he touched her first and she attempted to defend herself he wouldn't be able to say she was resisting arrest, but then could he put her under arrest for assaulting a police officer?

This is pretty interesting. So now that we know she did punch the officer, it is going to be called self defense? LOL

The courts have been very clear on this. A police officer has to have reasonable articulable suspicion the person has committed a crime or is about to commit a crime before they can detain or arrest you.

The courts have also said a person must have reason to believe they are under arrest for any resistance to arrest to be made.

Since she was not committing a crime that I know of, and she doesn't appear to think he had cause to place her under arrest it means she could not have been resisting in the first place. Everyone had the right to self defense even against a police officer.

You can also strike first in defence if you are in fear of your own safety.
