The motion argues that South Carolina law requires three elements for a preliminary injunction to be granted– (1) that the plaintiff would suffer irreparable harm if the injunction is not granted; (2) that the plaintiff will likely succeed in the litigation; and (3) that the plaintiff has an inadequate remedy at law — yet the order freezing the Murdaughs assets “only addresses one of these three requirements.”

Lawyers for the Murdaughs also argue that the appointing of co-receivers is a “drastic remedy” and is unwarranted under the given circumstances.

As co-receivers, they will have the authority to locate and oversee the dispositions of all the assets controlled by both Murdaughs.

What possible senario, related to the double murders, can either AM or his cousin Eddie give LE that can blame the other yet keep themself clean?

Even if AM's lawyers want to work out a deal for their client to proffer information, if it has anything to do with cousin Eddie and paying massive amounts of money to him right after the murders, I doubt LE will accept any offer squealing on Eddie before he gets to have his say about it all too.

What a tightrope SLED is walking. I sure hope somebody at lower levels, maybe a "Cowboy" or two, comes clean about what they know. Someone knows besides AM and his "drug courier." AJMO

While attorneys said they could not release the exact amount of the settlement, Bland, speaking on behalf of himself and his partner, Ronnie Richter, added that, not only has the Satterfield estate resolved its differences with Palmetto State Bank, "We've recovered in the aggregate an amount in excess of $6.5 million from a number of sources."

Those sources, he added, include Westendorf, Fleming, Moss, Kuhn & Fleming, several insurance companies and PMPED.

Bland stated that, after Murdaugh allegedly stole the Satterfield heirs' settlement, one of Satterfield's sons was struggling financially and lost his family home to repossession.

"Alex knew about this, and let it happen, and it was absolutely despicable," Bland said. "This caused Brian, the vulnerable adult, to be pushed out onto the street. That fact alone keeps my oven hot every day."

Wow! The way I read this, Bland and partners recovered more than $6.5 million in just two months time. That seems like astonishing fast legal results. Did I read that correctly?
 
BBM……my God, AM allowed GS’s son to lose his home & he knew the son needed the settlement $$ so badly to save it! What a selfish a$$ AM is. This infuriates me.

Truly horrible, the lowest. Unfortunately, its not an unusual attitude for many today. It's too easy to think that people who meet misfortune and disaster in their lives somehow "deserved" it. It's victim blaming by the people who victimize them and bystanders who watch and do nothing.

I've been waiting to hear news of a Grand Jury convening. It seemed the most likely option, allowing GJ members to remain anonymous and the prosecutors to have a hands-off approach to avoid any repercussions, political, professional or otherwise. OTOH, it also offers the opportunity for the GJ to, for lack of a better term, "filter out" any evidence or testimony that could cause problems for other "leaders" in the community.
 
1) Related to the earlier discussion on Judge Newman declining AM bail for a second time, I agree he probably knows more than he can offer publicly as reasons for keeping AM in jail. But I think the most compelling reasons are that Elleck has to be a flight risk even with a surrendered passport, and more important, I don’t think AM is safe. In his dark drug world I’m sure there are some who would be inclined to bump him off in a heartbeat before he leverages all he knows about who and where to LE. Whether it’s the cowboys or boll weevils, he seems to be connected to some extremely dangerous characters. The goal is to get AM to trial on all charges current and future! MOO, MOO, MOO.

2) Reading that GS’s dear Brian lost the family home because an educated and privileged man who he and his brother were trusting, (still allegedly) embezzled their money from the wrongful death settlement makes my blood boil. Could there possibly be anything else worse that we are going to learn about this unscrupulous man? A pure evil arrogant compassionless narcissist! MOO, MOO, MOO!

ITA and although in theory GJ members are to be anonymous, in that area of influence by AM and family I suspect that GJ members will be known. They won't be mentioned in MSM but they will be known to the locals. Who knows then how they will vote on the evidence presented. I believe that the proceedings will remain unknown but I have no confidence in the results. One hundred years of influence and coercion doesn't go away just because the conversation takes place behind closed doors and the promise of anonymity. MOO MOO MOO MOO

so where are we now?? Would anyone who’s followed mind filling me in?? My big Qs are

1- what happened in the double murder? My impression is MM was the target, presumably to stop her divorce proceedings & the financial misdeeds that would be uncovered, & PM involved himself & became collateral damage …. MOO based on headlines etc - is this the general consensus??

2- what on earth was AM up to all these years? What was he embezzling all that money for? what was he doing with his life if not working to earn all those funds he brought home ??

on this Q we have the suggestion of a decades-long opiate addiction … you do hear about people slow-rolling full lives into the gutter over addiction … but could one man’s addictive use possibly demand THAT much money ? and still not be revealed in his behavior (EG by an OD)?

The murders seem to have been relegated to the back burner while we go down other roads that lead to nowhere. There was a big FITs podcast last night that was pumped as “Double Murder” but I wouldn’t be surprised if the murder victims barely got a mention since I haven’t seen any breaking headlines.
I don’t spend time on these theft and drug stories but rather focus on what brought us here from the start.
 
In reference to my above post, after reading the latest FITs report, I found 1 sentence in the entire article that mentions these murders as it goes off on the housekeeper, his alleged drug use, and money crimes. C’mon FITs, let’s get back to what’s important. The media is handing these citizens the same bags of garbage that LE is when it comes to the murders.

1- I believe you are correct. Maggie was the target and Paul may have been at the wrong place at the wrong time, although I think we will later find out efforts were made to make it appear that Paul was the intended victim in an effort to mislead investigators. News broke yesterday that a grand jury is convening to examine evidence regarding the double murders, so hopefully we will see indictments soon. I believe the receivership was the impetus to get Alex and Eddie talking. They can see where all that money went and who it went to.

2-I can’t imagine what Alex would have done with the millions of dollars he stole, but I do not believe it all went to his recreational drug habit. My personal opinion is that it went towards bribery and intimidation, and I think many judges, attorneys, investigators and others could potentially be exposed.

3-I think they’ve got both guilty parties right where they want them, and one of them has at least given enough information/evidence that the prosecution felt they could take it to a grand jury. I also think, as Eric Bland said in Mandy’s latest podcast, Judge Newman is aware of the evidence and grand jury proceedings, and this knowledge factored in to his decision to deny Alex bond.
 
The plaintiff made no showing that she has an inadequate remedy at law, and accordingly, the court failed to make any such finding;
The plaintiff failed to make any showing that she is likely to be successful on her claims against the Murdaugh defendants, a necessary element for imposing a temporary injunction, and accordingly, the order failed to make any finding in this regard;
The possibility of inadequate assets to ultimately pay a judgment that has not been rendered is not “irreparable harm”;
The court erred by not requiring plaintiff to post a bond, despite the risk of significant damage to the Murdaugh defendants;
The order erroneously appointed a receiver even though the lawsuit does not involve a dispute over the subject assets;
The order failed to identify any law or “existing practice” supporting the appointment of a receiver in this case;
The order erroneously grants the co-receivers the authority to sell the subject assets, which amounts to the unconstitutional taking of the Murdaugh defendants’ property;
The order improperly allows the co-receivers to exercise control and change locks on property that is co-owned by individuals who are not party to this action and deprives those parties of their interest in their property;
The court erred in failing to provide for some of the subject assets to be made available for the support and maintenance of the Murdaugh defendants. The order fails to provide for the Murdaughs to continue to maintain themselves through the course of this litigation, despite there being no adverse findings against them in this or any other civil or criminal action. Under the current order, Murdaugh cannot make bail or pay for attorneys despite his constitutional right to defend himself in both civil and criminal actions. Furthermore, Murdaugh cannot pay for medical treatment that he currently needs or pay for ongoing necessary and routine expenses, including food, groceries,or COBRA insurance. Similarly, under the current order, Buster Murdaugh has no place to live and no money for daily living expenses, such as groceries or basic utilities.

My opinion is that the courier alluded to in the other grand jury investigation of the $200,000 payment and potential related drug operation is Eddie. I posted my theory up thread regarding how I think he might be involved in the murders as well.
