These were the best statements from a family, and the judge was fanastic! Go, Judge Evans! We need you for JA, And a happy ta-ta to Bobby.

Can someone explain the jury questions to me, I don't understand them. Where they good questions? Anything to worry about?

It sounds like there's an IT person on the jury. But..........I think the jury isn't going to factor it much, if at all, in their decision, CMJA didn't even get to any "child *advertiser censored*", or computer related stuff in her testiphony, so they just might be scratching their heads, thinking "What was THAT all about?"
Here's the Q & A, with my IMO about JS's answers. (Kinda got them from Beth's site since the tweets where all over the place)

Q1: In 2009, it shows there was modifications and also history, like it was recently used to search the web. What was searched and by whom?
A: We went over the info run in 2009. We just went through the web activity. It was not accessing the internet--just pulling up local files on the computer. No internet activity. (JS does not answer "WHAT" was searched or by "WHOM")

Q2:
Were all of the modifications done using the cleaners only or were there manual mods?
A: The cleaners deleted internet cache and maintenance files. There's a easy way to determine if it was spybot or manually. For the most part, it was manual, not cleaners. (JS should have said "BOTH")

Q3:
Can the initiator pick what areas to clean?
A: Absolutely. Some were malicious and some not.

Q4:
Can these cleaning programs be done when computer off?
A: No.

Q5:
How many modifications occur on average when computer is turned on or out of sleep mode?
A: 1800-2000 files are modified during the boot up process but each operating system is different. There's really no set number. (SO what about this particular operating system? We're not talking about Win 95, XP, or Win 7/8!)

Q6:
Please explain if overwritten how information can be gotten back.
A: If overwritten, you're less likely to get it back. If deleted, easier to retrieve.
There are some tricky processes to recover overwritten but mostly we're talking about deleted files.(OK, once again "If over written, how can be gotten back?" JS is sooooo vague/evasive)

Q7:
On the search bar, if you can't tell if there was an internet search, how do you know the person searched an actual topic?
A: T
he search terms were typed in by humans and not automated. (But HOW do YOU know?)

Q8:
Do things attach to other files like spam and virus?
A:
There are viruses and malware that attach themselves. They embed themselves into the operating system and can inject themselves.

Q9:
Was there any evidence of virus on the 2008 or 2009 images that required cleaners?
A:
Yes--both had 10 to 12 active viruses.

Q10:
Is it possible that malware redirected the browser to *advertiser censored* sites?
A:
It is possible that it happened but in this case it was human interaction. (See Q7)

Taking an educated stab, yes, an IT person or weekend computer geek.....some of those questions sounded like someone knew their computer terms.
I think a good question would be "How do you protect the computer from updates/downloads/installs, and modifications when the computer is in "sleep mode" and it has to be "turned off"?
Being in "Sleep Mode", touching ANY button would have brought up the last screen(s) before it went to "sleep". That includes hitting the "power" button. Clicking the "Shut Down" option would have brought up screens to "Save/Cancel" any programs you were working on, and any updates that would automatically be downloaded. If TA's computer was asleep, it would have checked/received any incoming emails over the last 6 days if his email program was one of the screens that were asleep and woke up. Depending on the battery in the laptop, you could pull the power adapter and the laptop would STILL have enough juice to stay asleep for literally days.
When the juice was finally gone, the computer would have a "hard shut down". When it was re-connected to a power source, internet browsers would say "return to previous tabs" (something like that) but nothing else would prompt you to open where you last left off in non-internet programs. Any updates downloaded would automatically install if that option was checked.

Win Vista was a PITA for me. Entire platform crashed twice on me, constant problems with viruses, spam, trojans, malware, gah! My computer tech refused to touch Vista platforms, took 4 days just to re-install via internet because Windows did NOT give you a Vista back up disc. Speaking of which, I wonder if anyone tried to find a "system restore" point? It would take your computer back to it's setting on a particular date.....but all the "infections" probably would have prevented that........and I hate talking 'puters.

Wouldn't Det. Flores gotten into deep do do if he HADN'T pressed a key, and just packed the laptop in an evidence bag?

Can a defendant REALLY tell the attorneys what to do and expect them to follow his/her orders even when they know it is wrong?

Up-thread someone said the appeals are going to be limited because they have already filed and received answers for a lot of what may have been an appeal issue. (paraphrased by me) It sure seems that way. And the fewer appeals she has, the better I like it.
I'm positive the attacks against Juan and Mrs. Flores are being directed/ originating from Jodi. They are just too petty to be thought up by Nurmi & Wilmott. The misconduct allegations against Flores are a different story. Those I believe were Nurmi & Wilmott's ideas.

Isn't CMJA's blood money going into a "Trust"?
Who's the "trustee"?
Since donations are NOT tax deductible (according to what I've heard about CMJA's trust), is the "Trust" paying the taxes?
What happens if there ARE no appeals? No refunds?

I'd like to see the legal paperwork on it...........I've been in 2 different trusts and any assets that were converted (ie, sold) to cash during the "life of the trust" had to have the taxes paid before the moneys were put back into the trust.
So I don't get it.

BBM: She had a little help from her crew on JAII. Sounds like they had a hotline to JW and MDLR.

True, but I could just imagine Jodi saying "Juan's a pervert, he just wants to look at nude pictures of me!" Like everyone hadn't already seen all of her in all her glory!!! She had no embarrassment in front of Flores when he confronted her, "Oh, it looks like me"

Do you think the Alexander's will be able to speak directly to the murderer on the day of her sentencing?

I love the way Judge Evans said- yelled- "Take him out, take him out!!!!".

And there nothing we can do about them... Take care!

Rule 31.5. Appeals by indigents:

...b. Contribution by the Defendant. The trial court may order an indigent defendant to contribute to the costs of appeal and services of counsel in the manner prescribed by Rule 6.7(d).

Rule 6.7. Compensation of appointed counsel:

"..d. Contribution by the Defendant. If in determining that a person is indigent under Rule 6.4(a), the court finds that such person has financial resources which enable him or her to offset in part the costs of the legal services to be provided, the court shall order him or her to pay to the appointed attorney or the county, through the clerk of the court, such amount as it finds he or she is able to pay without incurring substantial hardship to himself or herself or to his or her family..."

Rule 6.4. Determination of indigency:

"...b. Questionnaire. A defendant desiring to proceed as an indigent shall complete under oath a questionnaire concerning that defendant's financial resources, on a form approved by the Supreme Court. The defendant shall be examined under oath regarding defendant's financial resources by the judge, magistrate, or court commissioner responsible for determining indigency."

Thank you for answering my question. So it’s possible the State could make her contribute to the defense costs. That said, does an irrevocable trust bar the State from making her contribute any of money in the trust?

Supposedly donations made to the JAA Appellate Fund are going into an irrevocable trust. Money being sent to a PO Box in Oregon. Revenue from her junk art sales are kept separately from the JAA Appellate Fund so that the trust remains absent of any monies that might be considered Jodi’s. This was done to ensure that donations received into the trust remain protected from potential lawsuits against Jodi. If this is true, doesn’t that mean that if the Alexander family files a civil lawsuit for wrongful death and are awarded damages, they cannot access any money from the Jodi’s trust.

The trustee is Sue Allen Halterman, missy's :jail: aunt

"...WHAT HAPPENS TO THE MONEY IF APPEALS ARE NOT PURSUED OR IF THERE IS MONEY LEFT OVER AFTERWARD?

A9: First, appeals will be pursued. Second, given that Jodi’s legal defense fees cost taxpayers over $2 million the first time around, it is unlikely that there will be any money in the fund remaining. However, on the off-chance that there is, it will be split down the middle and given to two nonprofit organizations. One helps disabled children, and one is a no-kill animal sanctuary. These instructions are built into the trust...."

According to her website:

"...Q3: IS THE TRUST MONEY VULNERABLE TO CONFISCATION BY THE ALEXANDERS OR THE STATE?

A3: No. The Alexander-family attorney has publicly announced to the media that the Alexanders will be suing Jodi. A wrongful-death lawsuit is a vehicle by which the Alexanders will seek to get as much money as they can from Jodi. The money in the Legal Defense Fund does not belong to Jodi. The trust is not in her name, she does not control it, and she does not have access to it.

In the state of Arizona, attorneys for the state may also try to take any money from Jodi. But again, the Legal Defense Fund does not contain any money belonging to her.

The trust was carefully structured so that the funds may only be distributed for the purposes for which it was created – legal defense and appellate costs. The money cannot be taken out for any other reason."

If she thinks all that murder money (as RBMB so succinctly puts it) is actually going to make to an appellate attorney, she better think again. I bet a box of doughnuts that Auntie Sue takes the money and runs. Assuming one of those other scammers doesn't get to it first.

They set up an irrevocable trust but I wonder if it's even under Jodi's name. If it's not under her name, bye bye money. And if she gets the DP, the State will be footing the bill for her defense so I don't see any valid reason for her to raise money for her Appeal. I smell SCAM

Thanks again for answering my questions. So the trust monies are protected. The only revenue the State can go after is the sale of her art junk.

I don't know about her art sales. I did read this on The Jodiland Wars- that the art fund is a 'business": (stated in missy's:jail: "butt-out" letter to George Barwood, a supporter)

"...Art by Jodi Arias is not a publically (sic) traded company, it is a private business. Therefore, where the revenue goes is nobody’s business but my family’s....

Private businesses don’t answer to investors. You wouldn’t ask the owners of a small shop what they do with their money. If you did you would be considered a rude customer. Butt out. Seriously.

The only ones harming art sales are you and Jason—people who’ve attacked my art. Only a hater does that. Rest assured that my family can log into the PayPal account they want and monitor ever

transaction from the first to the last..."

https://spotlightonlaw.wordpress.com/2014/10/12/the-jodiland-wars/

So, to me, it would seem that the State/the Alexander's/IRS may be able to go after the funds.

ETA: BUT if her art fund is not in her name- even tho' she drew/traced the pics, she could just "give" the artwork to whoever and they would sell it for her. I think nothing is in her name, so....

ETA #2:

Read this for more info on her art fund:

ja says that she IS operating a business out of the Maricopa County Jail

BBM - I hope they do. Too bad the jury can't be privy to the correspondence written by the killer to her minions. She sure doesn't sound like the romantic, shrinking violet from her journals, more like a woman who is ALWAYS in charge and too bad for you if you don't like it. It also doesn't take much for someone to be on the 'outs' with the killer, because apparently even Aunt Sue is out of the inner circle. When was the last time she was in court, anyway?

So if the murderer get the DP she can have visitors? I wonder how often, and I wonder who will come visit her?
