What are the specific mitigating factors #5 and #6....Not specifically relating to JA...anybody know off-hand?

Defense could ask for a mitigation hearing before sentencing where #JodiArias' family could speak as well as Alexanders.


 
What are the specific mitigating factors #5 and #6....Not specifically relating to JA...anybody know off-hand?

#5 arias suffered physical & emotional abuse.

Anyone else think that JSS has her sentencing statement already written? Well, 3 statements already typed up and ready to go? It's not like she hasn't had 5 months to come up with them...........

Yesterday on the sentencing thread there was discussion and Azlawyer said number 5 and 6 were the numbers of the next two questions. They had asked four questions in the morning. Then the next two were numbers 5 and 6 and that it had nothing to do with the mitigating factors. AZlawyer said number 5 was about them being deadlocked. Judge said she would answer number 6 in writing. (secret).
 
I feel for you~~i Hate snow (& winter)!!!!!! We have been blessed with a beautiful day here in Pacific NW ---- and again not meaning to be bragging. But dangit I'm so over fog and rain!!!! Love sun and heat. Hoping our summer will be nice!! Sometime we get a payback if our winter is nice~~so there is that

Good to see another Pacific N Westerner here! Yes, incredible weather, even for my part of the state for February. Feels like spring is coming, although it is just 27 degrees right now/

Sorry you posted while I was posting so #5 and #6 refer to questions and not to mitigating factors at all....
 
So.... just got back from an 80-mile motorcycle ride with my husband..he biker/me passenger, holding on for dear life. Thought for sure since I wasn't sitting glued to the 'puter that the jury would come back with a verdict in my absence. Usually that works. Not today, I guess. *sigh*

Hi Jane. That would be me. I figure they will come in after lunch when I am at the Dr.'s office! I also have to stop at the store, almost out of food. Count on 3pm. to about 5pm.. that's EST. or EDT~whatever..:lol:
 
I feel bad for all of you experiencing the nasty weather. It is somewhat warm enough for melting, so we are bound to have icy roads later when the temps drop. The poor little boy who catches his school bus in front of my house has had to deal with snow mountains, ice, and water filled patches --- I try to keep it clear for him, but it is a losing battle when the snowplow keeps coming by and pushing it right back where I had it decent,y clear. gahh!

I am set for a verdict today. I worry for the Alexanders. What will they do when their routine gets back to "normal"? Do they even know what normal is any more? Will their grief hit again, when they are finally able to mourn alone?

And I also wonder if the Arias family really cares about the outcome. They seem detached from their daughter already and their appearance is court is more for show than actual support. JMO

How touching/sad that paragraph was for me :frown: I've hadn't even thought about those MAJOR things, because I have been so caught up in this retrial. I can't even imagine what their lives will be like when this is finally over. Life will never be normal for them ever again. I just hope and pray their journey will become a little easier as time goes on and that they can all find the strength to put one foot in front of the other with every day that passes. Heartbreaking for sure.

I don't think anyone in her family ever even knew Jodi as an adult. She detached herself from her own family when she was 17. They were just too low class for HER to EVER be of any importance. I mean, how much grammar can she correct? :smile:

JSS said that "Questions" would be answered via "notes" w/o the jury present during deliberation.

I don't know anything..................:gaah:

Yeah but, Arias will want to read it in private... like in the bathroom in front of the mirror AFTER she puts her makeup on and...The judge won't be allowed in either!!
 
Morning everyone! My car is in the shop today, it died on me on the side of the road yesterday in the pouring rain. So luckily I get to wait impatiently with you all today! I lit my candle already.

You know I am not sure of anything. I went back to sentencing thread and someone posted a tweet from family member or friend of Travis that said jury was never deadlocked and that questions were indeed about mitigators 5 and 6. :(
This scenario is much scarier to me. if they believe she was abused in any way shape or form, they may give her life. :( :(
i hate trial by tweet and I HATE that this judge believes in secrecy!!! I hope she is forever more known as the Jodi Arias judge, much like Judge Ito is known as the OJ judge.

But iF it is true that the questions were about mitigators then why did JSS give them the Allen (impasse) charge? Doesn't make any sense.

Aaaaaahhhgggg: Enuf of #5 and #6......

(sorry, on my last nerve. I can't stop thinking about this jury and its seeming inability to reach a verdict)

Sure, it will say something to the effect of "Ms. Arias, I find you a victim of violence and abuse, and as such, sentence you to life with the possibility of release after twenty-five years".

And to Nurmi and Wilmott, "I did my best to assist with your defense. I wish you both the best.".

And to Juan, "Mr. Martinez, although I was a former Prosectuor myself, I find I am very jealous of how the people in our State love you and how you fight for justice for the victims. It has been my desire to see you fail in your persecution of little Jodi."
