Like most, if not all, I lack zero sympathy for MS. I have a poor memory but will attempt to share a few opinions I learned approx 4-6 weeks ago from a podcast. Actually, I think the podcast referral was from someone on this MS/TS thread regarding death penalty. I think it was from a college professor. This professor I believe taught law. He had requested permission with the courts to interview someone on death row and, if I recall, requested to be a witness at time condemned would be executed. Courts declined. Professor asked again. Was approved. After extensive interviews and time spent interviewing the prisoner, professor changed his views on death penalty. Professor ultimately considered death row too easy and way too comfortable. I forget most of the details but do recall how professor learned the prisoner lived a comfortable life of approx 18 yrs behind bars. Prisoner was allowed to roam most days. Could purchase almost anything you and I could buy. Prisoner can literally order any food he wants online (Amazon). Prisoner can order a refrigerator, computer, coffee pot, etc. Prisoner was allowed to receive 3 nude pornographic images mailed per month. Again, professor considered death penalty way too easy and now swears against it. Wish I could recall the podcast. It was very interesting.

Wow! This information is shocking, and DISGUSTING! I agreed 100% with Dexter's thoughts re: death row making MS's prison life tougher, was completely unaware the things stated by the professor existed. *advertiser censored*??? Amazon??? UGH! Do you remember which state the Professor was referring to? Hope to hell this isn't typical of most states!!!

As a retired correction officer of 20 years for the State of Florida, I can assure you that NONE of the above statement is true. No *advertiser censored* is allowed (although it can get smuggled in general population, but not death row). Searches are performed 3 times a day on death row inmates. As far as ordering online, that is laughable. Inmates have absolutely no access to any computer of any kind in any prison in Florida. Prisoners on death row are allowed 1 hour of heavily supervised outdoor activity daily and that is in a very confined area. There are no refrigerators for inmates, they do not even have air conditioning and believe me it gets very hot. The inmates in Florida State Prison do NOT have any of the "perks" you mentioned. I just thought I would clear that up

Now I need the person on this forum that had posted about that podcast to please try and find it and help me not look like I just magically made all that up. To take my poor memory one step further from that podcast. I now remember the 3 pieces of pornorgraphy allowed per month could not show penetration. I don't know enough about death penalty but maybe it differs in each state. Off I go searching

I located the podcast and when they may not be the same in FL they are in many other states. The professor teaches in OH but discusses death row amenities from many states. Very interesting and informative podcast worth a listen. Fast forward to the 18 min mark to start. Fast forward to the approx 45:00 min to learn how slick prisoner on death row snuck $100.00 per week into jail to support an 18 yr crack habit while on death row

I know you didn't make it up. You are correct, the inmate are allowed so called "soft *advertiser censored*" but the mailroom is pretty strict about it. I have confiscated many, many "true *advertiser censored*" magazines from general population inmates. Inmates bribing officers is a major, major problem in Florida prisons and it is the Dept. of Corrections fault. In 20 plus years there I received 2 SMALL pay raises and moral is horrible. Inmates are very slick and can prey on weak-minded officers. HOWEVER, any corrupt officer that does accept bribes is playing with fire, because it puts ALL of the other officers lives in danger and we used to handle some of that in the parking lot . That is for general population. In Florida, (I don't know about OHIO or any other state, death row is very closely monitered,as the prisons in NORTH Florida, the so-called triangle, which includes FSP at Starke. are much stricter with their policies than the rest of the state. If convicted, this inmate will spend his life at Starke. It won't be fun.

Article was edited today to include Mummert's comment:

'Mummert said he wasn't surprised by Kyle's decision, but he plans to appeal it. Given the uncertainty of Florida's future with death penalty cases, he stressed the importance of a second opinion from the Appellate Court. "It's like we're trying to find a destination without a roadmap," he said of the current judicial limbo as the legislature, State Supreme Court and Governor look for a consensus on the best way to try a capital case.

"Nothing against Judge Kyle and it's nothing personal," Mummert added. "But I have to make sure for Mark's sake that the ruling is constitutional."'

Gee, I think MS is just a bit scared of being found guilty and the DP! It was okay for MS to take the life of a beautiful mother and wonderful doctor, but no one should consider taking his life.

Now why is Mummert doing DP stuff? I thought he was not qualified and another lawyer was on the case?! Someone set me straight please. Thanks

Agreed! MS does not appear to think about possible consequences for his actions. Horrible excuse for a man.
I came in late, been following along. Kind of get the feeling I know the Dr. a little. ( I don't but it feels like it..)

I thought there was a decision @DP a little while back. Jury has to be unanimous for DP, not just a majority. I'll hunt for it.

I think the State wants DP as a bargaining tool for him to confess for Life (and life is life in FL, no parole)

ETA: http://www.nytimes.com/2016/10/15/us/florida-death-penalty.html?_r=0

I believe the Florida legislature has to change it's law. The decision will affect a lot of DP verdicts. If FL statute changes, it's a reality for Sievers.

I'm sure AZlawyer will correct if I am wrong, she's the lawyer, I'm not!

Interesting that Mummert used Mark's name instead of saying "my client" - hopefully this is an indication that both Faga and Mummert have fallen under Mark's wicked spell. I think Mark pulling the puppet strings will make for a much weaker defense - at least that is what I hope. Of course, it could be an attempt to humanize Mark to a potential jury pool - but I'm not worried about that as the facts of the case when presented will show him to be the cold blooded killer that he is -

I knew Mark did it once he stayed behind with the kids while with her family and not his. Jmo

Because Mark wasn't that close with them to feel that comfortable with congregating with them without Teresa being there. Jmo

So the you head home and me and the kids will stay behind; Really didn't fly with me in this case.

Also. Why not take the kids to Uncle Curtis wedding in your hometown? Hmmmmmm

So the dad solo on trips with the kids out of state was definitely a little fishy that it happens the weekend that your wife is murdered.

Btw. It wasn't even a weekend alone. She was murdered like 6 hrs after leaving him.

So he definitely didn't want to hang with her family that long.

Because he knew he would be flying home the next day. Jmo

He probably already knew all the flights that left on Monday before the family found out about the murder.

All valid points. I feel pretty confident that this will result in a guilty verdict, but remember this IS Florida. I lost a little wager on the Casey Anthony case so I don't exactly trust Florida juries.

A couple of FYI's to add to the sidebar:

1. I have a friend who works at the jail where MS is at. My friend avoids him but did mention that MS schmoozes and tries to chum up with anyone he comes in contact with, even in jail. What a

2. I was at my doctor's office at a medical center in Bonita Springs the other day and noticed a sign posted in the elevator. "Dr. Petrites will be taking a leave of absence effective November 30, 2016. The office will be permanantly closed." I'm assuming it's the same Dr. Petrites who MS called to check on TS. This isn't exactly big news but he was one of the people involved early in the case so the sign did catch my attention. Also, I don't know why this struck me as odd but "permanently closed" and "leave of absence" seem to be somewhat contrasting terms.

Does MS have another twin or lookalike? I was just at a north Naples restaurant and saw a man with two women (one 40ish, one 70ish), who looked exactly like MS. I know he is in jail, but it was jarring. I tried to not eavesdrop but I felt somewhat confident they were talking about MS's situation. I don't mean to intrude on their privacy, so excuse if this is inappropriate. I just didn't know their was another "MS spitting image" out there.
