I really do think the escort should be allowed to take the stand in this case. I'd love to hear legal opinion on the judge's decision to bar that witness (at least for today).

I have a sneaking suspicion it may be more to do with the judge not wanting discussion of homesexuality in her courtroom, rather than any legal basis. But I'm no lawyer so I could well be wrong.

She said the other day it was sensationalism, lol, I couldn't believe it.

oh good call newone, I believe you're onto to something there. Maybe, they should continue to offer the service in prison too, lol. The floggings, I mean. But then again, he'd enjoy it too much. :D

I really wish the disclosure SD made to the escort was ruled admissible. From watching US legal dramas, what I thought would happen is that it could be heard in the judge's chamber and then ruled admissible or otherwise. Is that not the case in SA?

Tongo is shaping up to be a witness of questionable reliability. That he thought there were two women is very strange indeed, even if he'd only met Anni once or twice.
 
I'm waaaaaaaaaaaaaay late getting back to this trial so forgive me if the question I have has already been asked/answered.

In the final posts on the previous thread, VZ told/asked Sneha that Dewani had been in the hospital with food poisoning and was soiling his bed (implying that was the reason SD didn't want Anni and Sneha to visit.)

Did anyone subpoena his medical records? If so, did they just ask for the medical records or the medical records and the shadow files?
(Most people are unaware that there are often files - particularly for the rich - that are not kept with the regular medical records that contain the true/accurate information. If a lawyer requesting records doesn't specifically ask for the medical records AND the shadow files, they will only be given what they did ask for, the "medical records."

Judge not convinced by state's argument regarding Leisser's evidence. Asks for written evidence.

As I wrote earlier today, I'm waaaaaay behind BUT if it were a hetero couple and a mistress was involved who had information similar to this, would the judge question the relevance of the testimony>

In the US, unless I'm dreaming, the "other woman" often testifies against her lover who is on trial for killing his wife.

If it's the same in SA and she doesn't allow it, can that be grounds for appeal??

(If we could see/hear this judge I's have a better sense of what I thought about her but from the tweet posts, here, she's starting to get on my nerves.)
 
Mmm...isn't it strange that ZT already stated earlier that when he picked up Dewani at the airport he wasn't alone and his wife was with him. But then he said 'The gentleman came out with a lady, a beautiful one'. The way he said it was as though he had never met her before. Well of course he had, but just seemed an odd thing to say.

It may be odd that he said it but maybe not odd WHAT he said:

- The night they arrived she might have looked awful after traveling - no make-up, messy hair, jeans, t-shirt, what have you. Oops, I'm describing myself after air travel!!

- The next time she was all dolled up and probably looked like a beauty queen.

Plus, maybe SD was nasty or offish on the plane and now he had been nice.

So, in that sense he may not have met her before.

Also, when they first arrived, ZT said only SD spoke so maybe he had no reason to look at her very closely, and she just hopped out the cab and went into the hotel.

The night of the murder, ZT thought he was meeting a woman business associate, yes? When I think of women business associates, I don't think of elegant beauty queens, which, I'll admit is a bias on my part from another generation.
