The closing arguments and conclusions of the parties were the focus of the last session of the trial for the murder of the pilgrim Denise Pikka Thiem.

The Thiem family lawyer has demanded a three-year increase in the prison sentence that they seek for the defendant.

According to counsel for the prosecution, Miguel Ángel Muñoz Blas committed a murder with cruelty causing the suffering of the family by controlling the time needed to discover the location of the body. "This was unnecessary," they said. For this reason, they have requested an increase in the sentence from 20 to 22 years.

They also claim that the crime of robbery with violence on Denise Pikka should be elevated in its punishment from 4 to 5 years.

For his part, the lawyer of the confessed murderer has withdrawn the request for subsidiary assistance for the impaired perception of his client.

The closing argument presented by the prosecutor of the case has called for "coherence, common sense and responsibility". The prosecution believes that "there is evidence" to declare the accused guilty of murder and robbery. This midday the last session has ended in the trial for the murder of the American pilgrim Denise Pikka Thiem, that took place in the year 2015. In the same session, the closing arguments have been presented and the accused, Miguel Ángel Muñoz, has declined to exercise his right to the last word. Therefore, the jury will begin their deliberation without having heard him since he also refused to testify in during the hearings.

This Tuesday the jury will be given the questionnaire for preparing the verdict. Their deliberations will begin tomorrow at noon.

After more than three weeks the trial for the crime of the American pilgrim Denise Thiem has gone through its last day on Monday. A session that was used by the parties to present their final arguments. The private prosecutor has taken advantage to raise his request of penalty of 24 to 27 years. They have decided to request the maximum penalties contained in the Penal Code for the crimes of murder, 22 years, and violent robbery, 5 years. Attorney Fernando Santocildes explains that they have made the decision because they consider that there is an aggression of the accused towards the victim's family. His lack of collaboration and the delay in the handing over of the pilgrim's corpse, he argued, caused unnecessary suffering to Denise's parents and brother. He also absolutely trusts that the jury will issue a guilty verdict.

For their part, the Office of the Prosecutor maintains the demand for a sentence of 24 years in prison. The defense has insisted to the jury on the lack of evidence that justify that the defendant committed the crime. In fact he went as far as to request that the jury be dissolved for lack of evidence of responsibility, something that the president of the Court rejected.

In November 2015, the forensic investigations had been terminated, and the remains were ready to be handed over to the family. Then the defense requested another autopsy, but in the end that never happened. The family were made to wait for Denise's remains until February 2016, all for nothing.

So the private prosecutor wants him to pay for that - an amazing request IMHO and it would be great not only for the Thiem family but for all victims and their surviving relatives if the jury agreed.

"Coherence, common sense and responsibility" is what the Prosecutor's Office requested of the members of the jury yesterday when they issue a verdict on whether or not Miguel Ángel Muñoz Blas Is guilty in the trial of the American pilgrim Denise Thiem.

In the last session of the hearing, the State prosecution maintained its initial sentence for Muñoz Blas, 20 years in prison for murder and 5 years for violent robbery, while the private accusation of Cedric Thiem, brother of the victim, wanted to increase the request in two more years' imprisonment, from 20 to 22 years, for the "increased cruelty" towards the family of Denise "because the accused kept the body hidden for six months" which caused "unnecessary suffering" to her relatives. They also raised the petition for violent robbery from 4 to 5 years. For their part, the defense demanded a verdict of "not guilty" because they consider that the evidence does not prove the involvement of Muñoz Blas in the crime. Yesterday the defendant once again had the opportunity to speak but he declined to do so.

The prosecutor asked the members of the jury - eight women and one man who are beginning to deliberate today - to issue a guilty verdict, based on "objective and impartial" evidence. Denise "was brutally attacked," the state lawyer said. He described the victim as "a petite, thin, lonely, and a foreign woman" who was assaulted in an uninhabited area of the Camino and "had no chance to defend herself."

The fact that Muñoz Blas refused to testify during the first session of the trial is, according to the Office of the Prosecutor, an indication of his guilt, like the "silence implies consent" of popular wisdom and he appealed to the assessment of the three statements made by the accused in the process of instruction, in which he first denies the facts, then confesses and finally retracts. In his view, the statement of confession "is the closest to reality" although "does not tell the whole truth" since "there are facts that he hides because they damage him."

The prosecutor noted that all the evidences presented in the trial "are legal, valid and respecting all the guarantees" of the accused. Thus he reviewed the testimonial evidence provided in the process by the police in charge of the investigation and by the witnesses, such as the pilgrim with whom she made friends and who inspired her to visit Castrillo de los Polvazares, in addition to the findings made in the house of Muñoz Blas, the fact that he exchanged dollars in the bank after the disappearance of Thiem and was already investigated for the assault on another pilgrim in 2015. What the prosecutor did point out was a sentence pronounced by the accused in the reconstruction of the facts in which he argued that "the more time passed without finding the body there would be less evidence" of what happened, "anf that how it has been", the prosecutor asserted.

He also aimed to overturn the testimony of the experts presented by the defense whose reports, according to him, "bordered on falsehoods". Also they issued "an autopsy report without performing the autopsy", opinions that they offered "with the aim of confusing" the jury " according to the prosecutor. He also upheld that the accused "does not suffer any type of disorder", despite what the defense claimed.

The prosecution was convinced that if the members of the jury ever walked the Camino de Santiago, "your mind will return to this judgment and in that Camino the memory of Denise Thiem will accompany you."

At 1 pm in the Provincial Court will hear the decision of eight women and a man on whether the man accused of murdering Denise is guilty or not.


The decision, at one o'clock this afternoon. At that time the verdict of the jury that judges Miguel Ángel Muñoz Blas, on trial for the murder of the pilgrim Denise Thiem, will be made public.

21 questions and one decision. The popular jury, composed of eight women and one man, who will decide about the guilt or innocence of Miguel Ángel Muñoz Blas, the only one accused of the death of the American pilgrim Denise Thiem, have been gathered since yesterday at noon, following the procedure of deliberation and verdict and thus the decision on the future of the accused.

After 21 days - the trial started last March 13 - yesterday the magistrate who presides the court gave the last instructions to the members before they were locked up to deliberate. In this line they explained that these "21 days have been intense and enriching, and very solid proof has been put on the table".

For his part, the defense lawyer confirmed yesterday that Muñoz Blas "is waiting" and he assessed that the trial "has been hard and intense" and put on the table that "it is not clear that my client has been the material author of what is imputed to him." The lawyer explained that the decision of the jury "is unpredictable" and referring to the statistics he indicated that " we have little trust ", but also, drawing sports terms, argued that "statistics are there to break them."

It was the most awaited verdict. For the majority, the only possible outcome and the popular jury dictated it. Miguel Ángel Muñoz, the weird local of Castrillo de los Polvazares, is guilty of the death of Denise Pikka Thiem. And he is so by majority (8-1).

There has never been a shadow of doubt. Just 24 hours after starting their deliberations, the jurors have returned to the Provincial Court of León to read the guilty verdict, thus fulfilling the intended script of a trial that has lasted for four months.

It was after 1 pm when Miguel Ángel Muñoz arrived at the judicial offices. There he was waiting for his lawyer who has conducted a practically unsustainable defense after a confession and a reconstruction of the facts that allowed the localization of the remains of Denise Pikka.

The popular jury found no evidence that Miguel Ángel placed the false signals that diverted Denise from the Camino and led her to the vicinity of his home (5-4). Nevertheless they do declare proven that he attacked her brutally with a stick causing her death, and later to burying her.

Also, the popular jury has found that Miguel Ángel does not suffer any mental illness.

In view of the jury's pronouncement, the Prosecutor's Office has requested for the only defendant 25 years in prison that the private accusation, exercised by Denise's parents and brother, raise to 27 years.

The guilty plea for murder has not been adopted unanimously, with eight votes in favor and one against, while the nine members of the jury indeed do consider Muñoz Blas guilty of the crime of violent robbery.

Miguel Ángel Muñoz Blas, 41, who initially acknowledged that he had killed the pilgrim before the judge of Astorga who instructed the case, but later changed his version and now claims that he invented it all because he felt pressured by the police when he was arrested September 11, 2015 in Grandas de Salime (Asturias).

The prosecution maintains its initial petition for 25 years in prison for Muñoz Blas, while the private prosecution raises its request for a sentence of 24 to 27 years. The jury read the verdict according to which the accused Miguel Angel Blas is guilty (majority of 8 votes against one) of having intentionally caused the death of Denise Pikka Thiem in a surprise attack and without the victim being able to see it coming or defend herself. The Jury further declares the accused to be guilty, by unanimity, of having taken and made his own, for the sake of profit, belongings of the victim.

The Jury declares unproven and therefore rejects that the accused, at the time of committing the facts, suffered a serious mental illness that totally annulled, severely limited or slightly affected his normal capacities of knowledge and will. Finally, the jury unanimously issues its judgment against the request for pardon for the accused.

The Prosecutor's Office demands 25 years, the same as the private prosecution and the defense lawyer announced that he intends to appeal.

April 5th 2015 was the last day my sister was seen, two years later on the same day we have the verdict… guilty.

My family has been very fortunate to have received so much support for the last two years. This was the hardest thing we as a family have ever faced and in our darkest time we have received so much love from all over the world. All the hard work, advice, and help people have given will never be forgotten and we are forever grateful.

My sister meant the world to us and today we are given the chance to get some closure knowing that the trust we put into justice system has been well placed. Even though we will never get over having Denise taken from us in such a way, we know we still have each other and together we will do our best to move forward.

We hope that the Camino will never experience something like this again so that people from all over can experience it like it was suppose to. Someday I think I will finish my sisters journey and remember the Camino as a pilgrimage in a beautiful country made up of warm loving people like what I have experienced in my brief time in Astorga.

In 2014 a German woman was assaulted by a masked man in the same area after following arrows that led her off the right path. Police said a Chinese woman also reported being hit by a man with a stick in a location near Muñoz’s home.

The court will sentence Muñoz in the next few days. Public prosecutors have asked for a 25-year sentence for the crimes of murder and theft.

An interesting explanation about the 8 to 9 verdict of the jury.

I found a fragment of the broadcast 'Detrás de la verdad' made on the evening of the day of the verdict.
The usual suspects are gathered together and all speak loudly at the same time. But I manage to catch the question from Paco Abellán. He wonders about the one person who voted not guilty. What was this person thinking?? It beggars belief, at least for Paco Abellán. I agree. The chaotic discussion continues.
Then someone who is new to me, starts answering this question about the one member of the jury. This person, a man, appears to know what he is talking about. (I did not manage to find his name.) And what he says is that it does not matter.
In his opinion, the members of the jury voted, and there was one person who did not understand the question, or who was a bit contrarian, or whatever, and voted 'no'. So the jury ends up with a 8 to 9 'guilty' outcome.

Now, what can they do? The might deliberate for another 3 days to reach a unanimous verdict. Why would they do that? It would not change the outcome of the verdict, but it would take them 3 more days or as long as it would take.
Do they look forward to 3 more days? No, they do not and they decide that this is as good as it gets and return their 8 to 9 guilty verdict.

( When I thought this through a bit, I realized that there may indeed be one juror who was not convinced, but if the person made a mistake instead, there is a chance that he or she is not even aware of that mistake and is wondering who might have been the odd one out.)

Dalia, 69, speaks exclusively to EL MUNDO from her home in Phoenix, Arizona, the home she still expects Denise to return to. "Her father sits down every day in his daughter's bedroom to mourn the loss of her. Her brother Cedric continues to buy her small souvenirs from the places he travels to. It is still extremely difficult for everyone to continue with our day to day life since she disappeared," her mother explains. She does not hesitate to tell that she has lost "the desire and energy to live," that "the pain of losing a daughter is indescribable" and that "a part of me has gone forever."


Q. Why has no one from the family come to the trial in Spain?

A. Both her father, Seng (71 years), and I have a delicate health that has not allowed us to travel. In addition, we would not have survived neither emotionally nor physically the pain that it causes us to relive in detail everything that happened during such a long process. That's why her brother Cedric either did not go either. Our suffering is unbearable. Since we retired, Denise was our support for everything. We have lost the strength she gave us because of her brutal death.

The trip to Spain to walk the Camino de Santiago was the last stage of a longer adventure, that took Denise to various places in Asia before starting her pilgrimage to Santiago. She wanted to close this journey by doing the Camino, "something that she wanted very much since she saw the movie The Way" and that, in addition, was going to help her reflect about the change of life she had planned for her return. "She had decided to move to Oregon when she returned, and before she took that step, she wanted to travel, so she went to Spain to regain energy and meditate on her future, and her belongings were already packaged and labeled for her move before this fatal experience," Dalia laments. She highlights how "talented, determined and successful her daughter was, but above all, what a good and loving daughter she was."

The family can not yet look at the photos of Denise - who did an MBA in International Business and was licensed in Project Management - without something breaking inside again. "She was 41 years old and had many plans for her future," says Dalia Thiem.

Pending the sentence that the judge will hand down to the defendant - the prosecution asks for 25 years of imprisonment and the private accusation 27 -, the family is somewhat "calmer", although they do not feel the peace that they had hoped for, after they heard the verdict of the jury. Her mother only wants "the truth to prevail." "I want justice for Denise," she says.

Before the arrest of Miguel Ángel Muñoz Blas, no one had told them about him, nobody told them that they had him in the radar of the investigation. "I learned of his existence through a video of a Spanish television channel that I saw on the internet and in which the name was mentioned of an individual who had been arrested for the murder of Denise. That was how I found out. The police did not give us any information because, as they explained us, they could not tell anything about an ongoing investigation " Dalia tells with some bitterness. Although she did not know of the existence of Miguel Ángel until she saw him in the press, she believes that he is "guilty of the death" of her daughter because "he is the only one who directed the police to the area where the body was. No one who would not have killed her would have known that place."

These two years have been hell for them, a nightmare they have not yet awakened from. They do not forget thow their heart missed a beat when they stopped receiving news of Denise or all the anguish that came later. This is what they tell.

Q. When did you know that Denise had disappeared? Did you think from the beginning that something bad had happened to her?

A. We had almost daily contact with Denise. As soon as we lost that contact, on April 2, 2015, we knew that something had happened, because she was extremely responsible and organized with these things. She informed her brother about every move she made, every step she took. The siblings trusted each other so much that Cedric had access to Denise's bank accounts and her credit cards and he could see her activity even when she could not call or access the internet to tell us.

Q. How did Cedric's trip to Spain happen to report the disappearance?

A. We were told that in order for the police to open a file on a missing person we had to go in person to make the report. Only then could the local police investigate. That's why Cedric went, to denounce the disappearance of Denise and give the police all the information they needed. Those were very hard days. We were very worried and we could not shake off the feeling that something terrible had happened. We could not stop thinking about it because it was absolutely unlike Denise to lose touch with us. However, we did not imagine for one moment that at that moment she might already be dead.

Q. Four months after Denise's disappearance they asked for help with a letter to former US President Barack Obama, Spanish Prime Minister Mariano Rajoy, and other authorities, such as Senator John McCain. Why did they turn to them? Did they get an answer?

A. Denise was still missing. No one told us anything about her whereabouts nor about the investigation. I could not sit quietly watching the news without doing anything, so the least I could do was try to ask for help. We hoped that someone who might have a clue would help the police. Any citizen can write to the president. That's why we turned to Obama and Rajoy (some letters were published exclusively by this newspaper), but neither responded. Senator McCain did get involved and offered Spain the help of the FBI.

This US intervention has been the focus of the defense strategy of counsel Vicente Prieto, lawyer of Muñoz Blas, who insisted during the trial that his client "had to be charged at all costs," because "there was a lot of interest in resolving this case" (after the offer of the FBI). "After five months without finding anything, when McCain intervened an unprecedented operation was initiated, because, of course, there had to be an explanation for the disappearance of an American woman. The operation was like a movie and now my client must be condemned no matter what," Prieto insisted. Dalia Thiem does not know whether "McCain's mediation helped to prioritize the search for Denise," but she is thankful "for his support and intervention to try to improve our situation."

On September 11, the Police detained Muñoz Blas in a bar in the Asturian town of Grandas de Salime and on the night of that same day the body of the pilgrim was found.

Q. How did you find out about the find?
A. Cedric called me. I felt no relief when I heard the news. All this time I had hoped and whished for her to return to my side.


With the appearance of the remains, the torment of the Thiem family was long from over. It took Denise more time to return, because they could not take the mortal remains home until February 2016. "I do not understand why Denise's body was held up for so long in Spain, further increasing our suffering. I was informed that the delay was due to the defense wanting a second autopsy - which never took place - and to collect additional evidence But I do not understand."

Dalia has words of thanks for all the people in Spain who have helped them during this time and also for the jury, for their dedication and effort. "I hope no parent will have to go through a similar tragedy as ours. I hope no one else will feel this pain." Denise's mother will never be able to heal the wound, but she does want the sentence to end the whole process and that both they and her daughter may rest, at last, in peace.

The Provincial Court of León has sentenced Miguel Ángel Muñoz to 23 years in prison as the perpetrator of the assassination of the pilgrim Denise Pikka Thiem in April 2015. The ruling imposes a sentence of 20 years in prison for the murder and three for a crime of robbery with violence.
