The president who nominated him consistently enjoys record-low approval ratings, received nearly three million fewer votes than his opponent in the last election, and may have conspired with a hostile foreign power to win it.

The Senate that confirmed him went to extraordinary lengths to shield Kavanaugh from anything resembling due diligence, even before multiple women came forward with allegations of sexual assault."

PORTSMOUTH, N.H. (AP) — A New Hampshirelawyer led the American Bar Association's committee that gave Brett Kavanaugh a rating of "qualified" for a seat on the U.S. Court of Appeals.

Stephen Tober, who practices in Portsmouth, was chairman of the Standing Committee on Federal Judiciary in 2006 when he authored the committee's statement supporting Kavanaugh's nomination to the federal appeals court.

The Portsmouth Herald reports that Tober's rating was downgraded from "well qualified" to "qualified" because of concerns he was "sanctimonious" and lacked a "breadth of experience."

Tober said it's amazing that a "small-town lawyer from Portsmouth" led the panel.

There needs to be more discussion about why we are relying on the FBI to do this vital job in the first place.

To make the entire confirmation process more streamlined and transparent, the Senate must stop depending on borrowed executive-branch personnel, supplied at the president’s discretion, and develop its own organization to conduct the vetting of judicial nominees — for all levels of the federal courts — pursuant to its independent constitutional power of advice and consent.

The model would be the various nonpartisan institutions that lawmakers already rely on to provide them with objective analysis and advice on contested subjects, such as the Congressional Budget Office for economic and fiscal matters; the Government Accountability Office for audits of government programs; and the Congressional Research Service, a think tank at the Library of Congress with experts on practically every policy question under the sun.

CBO, GAO and CRS have sterling reputations for professionalism and discretion. They employ permanent staff under the ultimate supervision of leaders appointed on a bipartisan basis. The comptroller general, who runs the GAO, serves for a 15-year term, an additional guarantee of independence and impartiality.

It might be difficult to replicate those attributes in a new organization created from scratch amid the current partisan maelstrom.

No problem: The Senate could also borrow personnel from the aforementioned existing bodies for the necessary assistance. Assign the CRS’s American Law Division to draft a balanced assessment of each nominee’s legal record, including judicial opinions (in lieu of the American Bar Association’s input). Send out the flatfoots from the GAO’s special investigations unit — the folks who test airport security undercover and the like — to conduct a background check. Or hire and train new personnel drawn from the retired ranks of the FBI to do the work.

You get the idea. Whatever specific legal and institutional arrangement the Senate chooses, the main point would be to end the separation-of-powers problem that plagues the Kavanaugh investigation: Namely, its scope and duration are at least in part subject to the wishes of the president, who alone can authorize the FBI to aid the Senate — and who has a pretty strong stake in the outcome, to put it mildly.​
 
In its entire history, the Supreme Court has never been apolitical.


Well, if we are all supposed to believe the SC is just another political institution, then perhaps repubs won't tell big lies about perserving the Court's legitimacy & independence when Dems add two justices to the Court to neutralize the votes of Gorsuch, a stolen seat justice, and Kavanaugh the dissembler willing to break the Senate & taint the Court because he felt entitled to a seat.
 
You can easily search Google, USCIS Ninth circuit court.

There are numerous decisions that support my POV. And I wouldn't even have to Cherry Pick either. One, that really blows my mind, I have added, it is a decision regarding the deportation and inadmissability, of an illegal immigrant, who has numerous charges of drug trafficking, possession. The court documents are filled with sob stories about family members.

Did he do the crimes? Yes.
Did the court blow off the criminal activity? Yes.

There are so many, just check it out. The Ninth Circuit LOVES to shut down anything with the name, "Jefferson Sessions".

I was not being "snarky", just honest. There are so many cases, it is mind boggling. I added just one particular file. The Ninth circuit court is why I would back any conservative judge.

If they couldn't respect the conditions that were set forth that allowed them to be there they should found other ways to show their disapproval.
Those women who did the screaming were a bunch of disrespectful worthless fools and no doubt will teach their children and grandchildren to be a bunch of disrespectful worthless fools too.

I think his wife will demand he start treatment - but that can now be complicated for him.

We all shared history together.

I learned a lot about the SC- that I did not know.

Glad I am old!!

Feel for 20 year olds that are gonna have to live in the space being created.

as promised a while back they have to get him locked in tight as bed bug

they all know all the stuff that was buried -- they knew about FOrd before

people had to be deciding what to hide- for months

think about the man hours ($$$) -- you have to have people reading all this stuff to make sure it does not get out

all behavior has meaning there are reasons , for the first time in history it was all hidden.
