I never thought in a million years that it would take this long for a GJ decision.
Look at KC..............a matter of days! Illinois drags their feet. I like Fla law better!
and Texas just does the death penalty! IMO,it can't come soon enough!
I'm confident that the Illinois grand jury would have indicted DP much sooner if it hadn't been hampered by legal technicalities.
In Illinois, as in most states, hearsay evidence in not admissible in court. Much of the evidence in the Kathleen Savio murder IS hearsay evidence. The evidence that the pastor will be able to testify to - that Stacy confessed to him that she knew that DP killed Kathleen, and the details Stacy told him, and the documents written by Kathleen herself prior to her death in which she stated that she feared DP would kill her, are just two examples of hearsay evidence that would not be admissible in any trial of DP.
Legislation was introduced to the Illinois state legislature to allow hearsay evidence in cases of capital crimes. The Illinois law follows the same law that was passed in California, which was challenged and revised. Basing their law on the revised version of the California law, the Illinois hearsay law will now allow the hearsay evidence to be introduced and heard in any future trial of DP.
It was important to hold off on indicting DP until this piece of legislation was passed and had become law. Otherwise, an indictment prior to this law would not allow the crucial hearsay evidence.
So, we've all had to exercise patience as we all want the prosecution to have all the ammunition they need to get a conviction in both the death of Kathleen Savio and the disappearance of Stacy Peterson.
