I'm not saying he didn't do it, I am on the fence. Cause of death hasn't been given, the botanist was thorough but that doesn't point to foul play imo.
I'm just saying that comments here are quite snarky and that doesn't really leave a lot of room for having an open mind.

I've had an open mind all along. Nobody knows what really happened.

Personally I believe he did kill her, probably in a heat of the moment type situation.

Even if I didn't think he did it, I'd still make snarky comments about him because I think he's been proven to be.......of extremely weak moral character and frankly, a real modsnip ;)

I also think that the depths he has sunk to in his defence - destroying the memory of his daughters mother, and trying to paint HIMSELF as a victim, is an absolute disgrace. He does not deserve any respect from the public, IMO.

But, I'm very glad that WS is such a place where we can all have an opinion :loveyou:
 
1:06pm: Among the conditions, Mr Byrne explained, was that Mrs Baden-Clay would check her husband's mobile phone each night to monitor his calls, text messages and emails.

"It was a kind of routine where he'd hand the phone to her ... and not get it back until the morning."

The court has previously heard Mr Baden-Clay's mobile phone was connected to a charger at 1.18am on April 20, 2012 and disconnected about 6.18am.

He reported his wife missing at 7.15am.

Mr Baden-Clay has maintained he went to bed at 10pm on April 19, 2012.

He has said he was a heavy sleeper.

People bleed when they get hurt. It doesn't always mean there is violence involved. I heard no theories from either side.

And next week we are going to hear it all again in his own words....I am not a big drinker but tea may have to be replaced by something stronger at certain times next week.
 
Allison told no one of the affair - although GBC seemed to be proud of it and was spruiking it to whom ever he came accross - This behaviour is atrocious and just another demeaning thing for Allison to have to deal with.
In all honesty, I cant understand why she put up with his disgusting behaviour the only reason I can come up with is that he belittled her enough to make her think no one else would want her - when in actual fact it seems she was quite a catch - intelligent, attractive, caring & ambitious.
I am seriously going to hate everything he has to say on the stand because he is attacking her and she isn't around any more to put the actual truth out there.
He is the one on trial - she did nothing wrong and yet everything seems to be focused on the very minor things she seemed to have struggled with....FRUSTRATING!!
 
12:37pm: Mr Byrne has gone on to explain that in 2008, during Mr Baden-Clay's affair, business was good.

The southeast Queensland real estate boom was in full swing.

Mr Baden-Clay bought a Lexus to match his business partner Phil Broome.

"Because it seemed at that point the money would never run out," Mr Byrne said.

"At the peak of the boom they [Mr Baden-Clay and Mr Broome] were each being paid about $5500 a month."

It was against that backdrop that Mr Baden-Clay decided to move his real estate office to a bigger premises at Targina.

Neither of them shared details such as Allison’s condition, whatever it was. They would socialise less and less. She wouldn’t want to go to social functions and that’s what they did. It wasn’t a hiding of it, it was simply the way they were,” he said.

Mr Byrne said Ms Baden-Clay suffered a miscarriage at the end of 2002.

“That did not help her with depression and the ongoing panic attacks. Nevertheless, Allison wanted to have another child and they were both very happy when she fell pregnant (with their second daughter) who was due before Christmas, 2003,” he said.

He said Ms Baden-Clay’s episodes had continued and for the first time in 2003, saw psychiatrist Dr Tom George and was diagnosed with depression, anxiety and “transient suicidal thoughts”.



Mr Byrne said Ms Baden-Clay continued to see Dr George, often with the accused.

“Clearly he had no concept that this was something that was a medical, chemical imbalance. You can understand a miscarriage, or something giving rise to mood swings but he at that stage had not put together that this was a medical condition,” he said.

Mr Byrne said there were relapse episodes but Zoloft “evened out” the effects and helped to stabilise her mood.

“It meant she was rather flat but certainly not depressed. Whilst her condition was managed, they still had trouble communicating and understanding, at least from Gerard’s point of view, what this was and how they would get through it,” he said.

“They decided together they needed further income and they decided on a career in real estate.”

He said the pair joined Raine and Horne at Kenmore and their second daughter was born on the 16th December, 2003.

Mr Byrne said the accused would tell the jury he finished work by 5pm, in time for “the happy hour” to help feed and bathe his children.

He said he opened the Century 21 office after purchasing a franchise.

“Being his own boss, if you like, was the best way for him to manage that,” he said.

Mr Byrne said in the first year of business, the accused’s business won an award.

“Things were going forward from strength to strength but the relationship with Allison was not. If anything, it was deteriorating,” he said.

He said the accused would tell the jury he took one of his daughter’s to meetings, communication was strained and their love life was “non-existent”.

“Allison was suffering, he’ll tell you, from two things: increased libido and weight gain. Both not unknown side-effects from using the drug Zoloft. From this they maintained the outer image of being a normal couple, nothing wrong between them … despite that scenario he will tell you Allison started to desperately want another child,” he said.

“He again will tell you that he didn’t think that was a good idea because of the way things were between them. She wanted, he’ll say, to give her a son. There were no male Baden-Clay’s in the family and she wanted to do that.

“He didn’t go on, he didn’t accept that, Allison became more depressed and Gerard will tell you that in that context and in that background, he had an affair with a person called Michelle Hammond.”

Mr Byrne said the accused would tell the jury he was “ashamed” of himself and got out of it and agreed to try for another child with his wife.

He said his wife was excited about the pregnancy and “things were looking up”.

Mr Byrne said that during the third trimester, Ms Baden-Clay became anxious and she went back to see Dr George.

He said the couple’s third child, a girl, was born on September 15, 2006.

There are so many contradictions. Allison was falling apart, Allison was so strong.

Imo, GBC will plant the idea in jurors mind someone else murdered Allison. :twocents:

I agree. Going to take some Zoloft, and go shopping. This is making me so angry! I pray that Allison has a last laugh, and strikes him down in the box. Sending her love and strength to do this :tantrum::please::blushing::jail:

I bet Toni will not like it being referred to as just a physical relationship – her head and heart were ALL in it.

I hope he will have another three days to think up more stories, maybe assisted during a visit or two from his family.
 
For a sneaky guy I am gobsmacked that he handed his phone over each night and was given it back in the morning! Biggest load of codswallop. No bloke does that. Hard enough to get my kids tl do that! It must have been a decoy phone.
