http://www.thespec.com/news-story/5264871-accused-gets-two-years-as-accessory-in-figliola-murder/

In an agreed statement of facts, court heard that Di Trapani — at Maria Figliola's request — asked a friend to drive him to the murder scene to see if police had discovered Frank's body. They hadn't found the body by that stage. The information was conveyed to Maria, and she in turn called police to report her husband missing.

Glithero said Di Trapani met the requirements of the accessory charge because "he agreed to assist Maria Figliola to try and better her position in terms of potential liability for the murder of her husband or her part in that."

Maybe, CN "only" looked for something to inform DM then?

Sorry, we are just talking about the special Monday with it's excitements in court. :blushing: But I don't know how to manage it, not to lose this point re CN. :blushing:

New trial date set:
"The original trial date was “vacated” and a new date set for Jan. 11, 2016. The Spec has previously reported the trial is expected last up to five months.

The delay seems to be the result, in part, of a longer window for pretrial motions, which will continue on April 30 and May 1 and carry on again Sept. 28."

"Documents from Monday also confirm that Deepak Paradkar and Ravin Pillay, the Toronto defence team that has been representing Millard, have not yet been retained. Glithero expects to be “advised of progress in completing (the) retainer of Mr. Paradkar and Pillay” on April 30, the documents say."

I wonder what makes this so complicated that the judge is expecting only a progress report in 2 months.

DM applies for legal aid: now there's a controversy!

Could it be the trials for LB and WM will come before TB's case? This is the reasoning behind moving TB's trial into 2016? MOO.

No they will be meeting again April 30, May 1 and Sept 28 so they had to move the trial back to accommodate those dates.

Interesting politics over on Wikipedia about the case. Several people are moving to have DM's page deleted as he is not yet a convicted murderer. The argument in part is that is more relevant to have a page that describes the murder of TB, or TB...but if you search on TB you are redirected to the entry for DM, effectively wiping out any trace of TB's story.

Of course if DM becomes convicted in 2016, no doubt he will be granted a small entry.

Noticed that CN hadn't graduated yet

I'm surprised because you would think she would only have to make up that one semester when she was arrested, where she missed some of her exams. Do you think that the charges against her will prevent her from being awarded a professional degree? Sometimes that happens...

She was only released in August. How do you know she got right back into York in September? How do you know she was in her final year? Those are the only two things that would have allowed her to have graduated already, I believe.

Her lawyer, Paul Mergler, thanked the judge for granting Noudga bail and said his client hopes to resume her studies at Toronto's York University before her trial.

Noudga is “anxious to pursue her university education and move on the best she can.”

The source also says Noudga, who is in her fourth year of university, wrote an exam in the morning and was arrested in the afternoon.

ETA: Just want to add, you don't have to reapply for admission once you have already been accepted into a program, so I don't see how CN would have been prevented from returning to school unless being accused of accessory to murder is a deal breaker in the uni community.

Thanks. Everything I found just said resuming studies, nothing about fourth year.

So you think she paid her September registration, while she was in jail, just on the chance that she got bail in time to go back?

Students who fail to maintain continuous registration, including payment of applicable fees, will lose their status as full-time or part-time graduate students and will be withdrawn from their program of study. Students who have been withdrawn as a result of failure to observe registration requirements may petition for reinstatement.

No, the Spec story mentions 4th year and she's 22 now, I think 21 is when most graduate?

She's just have to show her intent to return by registering. You don't have to be paid in advance...and people are always having loan delays and other issues that may delay payment far into the semester.

Could be taking a full year course, or a course only offered in the winter in order to graduate...she'd be done then by April 24 in that case.

In my city, you do have to pay in advance. Not the entire amount, but you have to make a deposit regardless if your loan is delayed. If you choose to only make a payment while waiting for the loan, there is an automatic interest rate charged on the tuition and the next payment is still due before school starts. She was in jail from April until August, so I don't think it's a safe assumption that she started school again right away in September. If her course is available for the summer session, she could have enrolled for that, which I believe starts in April.

At york if you withdraw within a week of the start of classes you get a full refund

Yes, I believe that's true at most, if not all, universities and colleges. I'm a little confused about what that has to do with when she may have decided to continue on with her studies though.

There was nothing stopping her from going back in September?
