Judge Jim Goodwin said Boswell’s September 30 hearing is set to start at 9 a.m.

Attorneys are still awaiting analysis of two pieces of forensic evidence from the Tennessee Bureau of Investigation. However, both Boswell’s attorney, Brad Sproles, and state prosecutors would not say exactly what those pieces of evidence are.
Another long wait,...again. The wheels of justice are turning slowly for this precious little one, but at least they are turning.
 
This case breaks my heart. We vacation in Tennessee and ride motorcycles all over Sullivan county and surrounding area. I'm waiting to see who this mom will blame for Evelyn's death by the time trial rolls around. Will it be a drowning in the pool and the grandpa who finally called cops was to blame? Was mom kidnapped by ninjas who killed the baby and threatened to kill the rest of the family? Spin that wheel of excuses, we've heard 'em all. Praying for justice for that little one.
 
It seems like so long to wait for a trial — so she must be planning to plead not guilty, otherwise why not just plea out now?
The May status update was continued to Sept. Since the accused and her defense do not have all discovery yet, it would be premature for her counsel to advise her on a plea. The cause of death has still not been disclosed and/or announced. MB is not going anywhere...

Evelyn's Law now in effect, requires parents to report missing child within 24 hours

SULLIVAN COUNTY, Tenn--More than 30 new state laws will go into effect on July 1st in Tennessee, including a first-of-its kind law, that will protect children in honor of baby Evelyn Boswell.

"We definitely needed this law," said Sullivan County Sheriff Jeff Cassidy.

Evelyn's law requires parents to report their child's disappearance within 24 hours of them missing.

It's a tool that Sheriff Cassidy believes could have helped them in their investigation.

"This right here will hold individuals who have disregard for the safety of their children, and hold them accountable," he said.

Evelyn Boswell was reported missing in February 2020, even though she hadn't been seen since December.

"We were behind the eight ball in the entire investigation....not knowing the exact timeline of when Evelyn went missing," said Sheriff Cassidy.

The law was approved in the Tennessee House and Senate, and then signed by Governor Bill Lee.

1/22/21 Update: The Sullivan County District Attorney General’s office stated Friday in court that they would be seeking a sentence of life imprisonment without parole should Boswell be found guilty in the death of her daughter, Evelyn. The district attorney’s office will not seek the death penalty against Boswell. Boswell’s attorney, Brad Sproles, stated the defense still needed to go through some recordings that hadn’t been provided to them. The district attorney general’s office is still going through some of the information before sharing it with Sproles. Sproles also said more motions could be filed, based on the evidence. Judge James Goodwin set a status hearing for May 14. 5/12/21: Notice of subpoena of medical records. The court is issuing a subpoena to Celebration Health concerning the defendant's treatment on or about 1/13 to 1/15/20.

Boswell appeared in the courtroom for the first time since the pandemic started for a status hearing Thursday.

Sullivan County District Attorney General Barry Staubus said forensic testing at the Tennessee Bureau of Investigation is still ongoing.

Boswell's lawyer, Brad Sproles, has reviewed 800,000 photographs, 28,000 texts and other pieces of evidence. Sproles has made a motion to reduce Boswell's bond. That will be heard on December 7 at 1:30 p.m.

I've been so frustrated with the amount of time it's taken for things to progress in this case. Until I heard the sheer volume of discovery involved today in the hearing, and the fact that critical forensic results are still not back for review (they anticipate having them by November). I just about fell off my chair. So, I get it now.

They definitely used the time today to get all their ducks in a row; setting aside dates and deadlines. It looks like 2022 is going to be a busy docket for MB.
