BBM~ I trust Juan whole-heartily. I just don't know what the jury is thinking since you know who.

No reason to panic whatsoever. A stipulation is nothing. Does anyone really think this jury is going to allow JA to walk out free because of a stipulation that says she didn't have the gun or knife *in her hand* the moment 1 picture (and that's only 1 picture) was taken? The state conceded this because it's a throw-away that costs them nothing. This prosecutor has practiced nearly 30 years and knows exactly what he's doing.

Don't know why he's not trusted. This case is a slam dunk for conviction. For goodness sakes the perp admitted the killing AND failed to prove self-defense. It doesn't get better than that; it's a slam dunk!

What is your favorite "Juan-ism?"

Please share your favorite Juan line! I'm making a word/phrase cloud cross-stitch & need your help!

Hope I am not too late, these threads move fast!
More Juanisms:
"She lived in a shack, right?"
"Do you want to spar with me?"
"Snow White has no power, right?"
wouldn't be complete without
"You don't have any memory problems, do you?"

"Right. You wouldn't see it that way, because you have feelings for the defendant, right?"

Thought you guys over here would appreciate this too. My tutorial today w/ Beth Karas:

Well as you know, there wasn't a whole lot going on this afternoon. A whole lotta sitting in the hallway and waiting for a whole lotta nuthin special.

But I made the most of my time in the hallway with a pretty substantial little chat with Beth Karas about how things are gonna go down from here on out, the penalty phase, timing etc.

So, I'll share that.

Ok so it looks like tomorrow will start rebuttal with Juan (yay).

It's expected he will go all of this week and next week.

Then immediately, without delay will be closing arguments. First Juan, then Defense then Juan gets up for one final closing remarks.

Then it goes to the jury for the GUILT decision. Depending on what charges land, they will decide GUILT for first degree or any lesser charges. No one will be surprised to guess what I think will happen in this phase: GUILT ON FIRST DEGREE MURDER

Ok so now if that conviction comes in (which I believe it will), we go to the Aggravation Hearing.

The Agg. Hearing will decide one thing and is guided by Martinez. It's decided whether the crime meets the criteria for "cruel" as defined in the statute which qualifies it for the Death Penalty (again I think by now everyone knows where i stand here--I believe it does and believe it will qualify). I put the legal definition for "especially cruel" on the next page here.

THen the jury deliberates again on this and comes back with a decision: cruelty met or not.

If the criteria for cruelty has been met, then we go to the Mitigation phase. If it's not been met then there will be no mitigation and it's decided LIFE will be the sentence and it's handed to the Judge who then decides whether it's Life WITH or WITHOUT Parole.

I don't think this will occur though.

The Mitigation phase will last longer probably than the Aggravation Phase because witnesses will be called and the entire point of this phase is to try and save Jodi Arias' life (which I do not believe will be successful). I'm sure family will testify and others (ALV was purportedly slated for this which I seriously doubt will happen now). Jodi herself may make a statement , not for cross examination but just a statement which I suspect she will during this phase.

THen it goes back to the jury again to decide whether or not the aggravating circumstances outweigh the mitigating circumstances and will come back with a recommendation of LIFE or DEATH (which I believe the latter is secure imo).

Once that decision is reached and declared, the jury is discharged and it now goes to the Judge to impose sentence in 30-60 days and there will be another hearing where sentence will be imposed. The jury's finding of DEATH , if they do, will be binding, meaning the Judge can't go down. If it is LIFE, she decides LWOP or LWP. It's then when Victim Impact Statements will be read. And Jodi will find herself transferred to her new abode which imo will be on AZ Death Row.

HLN will cover the entire trial until the jury is discharged. It's unlikely they will be there for the final handing down of the sentence but surely local media will film it and cover it on a live feed.

Beth predicts a verdict on or by May 3.

Then we go in to the Aggravation phase which, she thinks will be immediate and no breaks to prepare.

I hope this helps! I found it extraordinarily instructive and many thanks to our wonderful Beth Karas who is so open and willing to share her vast knowledge!

Hey you can look at the picture like this: I think that's even creepier, but I think you can read anything into it....

When this case goes to the jury, how many days do you think the jury will deliberate before reaching a verdict?

If they start early in the day I say they're back with a verdict on Day 2 around noonish. If it goes longer then 2 days it does not bode well. If Day 3 comes and goes, well it's gonna end bad, as in Hung Jury.

Death Row in AZ..... she won't be next years Prison Idol. :rocker:

All male and female inmates on Death Row are classified as maximum custody. All inmates are single cells which are equipped with a toilet, sink, bed and mattress. Each Death Row inmate has no contact with any other inmate. Out-of-cell time is limited to outdoor exercise in a secured area, two hours a day, three times a week, and a shower, three times a week. All meals are delivered by correction officers at the cell front. Limited non-contact visitation is available. Death Row inmates may place two ten minute telephone calls per week. Personal property is limited to hygiene items, two appliances, two books and writing materials, which can be purchased from the inmate commissary. Health care is provided at the Health Unit; medication is passed out at the cell front. Clergy contacts are provided at the cell.

Given all that, seems like the twitter days are numbered.

Hint: we never were and never will be privy to what any jury is thinking in cases until a case is over and they talk (if they talk). And: this jury is not that other jury. Different people altogether. Every jury is different.

I don't know but it will nail biting and darn right stressful. I'll probably be eating endless amounts of Lays potato chips till the verdict is reached.

I didn't have the program to outline the right pic.

That's what I mean! I see her face as in the photo on the right. :rocker:

This makes more sense than the other picture, for sure, because my first question was--Didn't Jodi say she was squatting? I can't see how he could see her whole body like that with the camera at the height. But if Jodi was that close, as she'd indicated, then your interpretation makes sense. Except--where you have a thumb--that's a weapon, because she's taking the picture with the other hand, her right hand.

I can't believe the expert with his fancy equipment can't see a face there.

So the "eye guy" said Travis had "a tear" in his eye in that pic, is that correct?

He'd either been stabbed prior to that pic being taken or had a weapon held on him and was told he was going to die - why else would he have a tear in his eye?
Hi, there were several earlier posts re Travis' "basal tears;" being the lazy pants that I am, easiest to find & repost was my own...my link failed (again) but The quote is accurate:

Repost
Re did they say Travis was crying: Well, they didn't use the c word; the expert referred to his "basal tears." Basal tears naturally clean & lube our eyes & are also produced in times of awe, surprise, sadness, etc. (Thank you, Wikipedia). For whatever reason, tears were there & caused the reflection but how sad & unfortunate the family had to hear about Travis' Tears.

It's up on Youtube all ready, in the likelihood I mess up the link:

36.00: expert describes how he does what he does; then,
Nurmi asks expert, so isn't this what he did here with TA's pic.

37:00 "No.....it was impossible to do actually what you would do with uh Mr. Alexander is you would actually have to map the eye to get uh an exact curvature because uhhh what you've got is basal tears which cover the cornea causing the reflection...."
