Nel is asking the same question over and over when Stander has already explained exactly what Oscar said and why he interpreted it as a "mistake" made by Oscar. There's really not much to undermine Stander on this testimony.
 
S just said:

S: She was an intruder.

N: What?

S: He said he THOUGHT she was an intruder.
 
Nel now getting charge back on track, OP told Stander he thought RS was an intruder when he shot her.
 
S just said he could see OP coming down the stairs clearly, 'with the available light'.

Says his daighter called Mr Divaris. Nel asks where she got phone, he says in the kitchen, it was on a charger.

N: When did you see it?

S: When I walked in - OP was in the kitchen, trying to throw up, bending over the sink....
 
N: Let's put that in timeframe, when you and daughter were first people to arrive, then Dr Stipp, after the parameds, then police?

S: Correct.
 
S trys to explain that the reason he made a mistake in saying OP said "I made a mistake" was because 'in my mind, it was a mistake'.

N: What was a mistake?

S: Because he shot Reeva...fact that he shot.

N: Mr S, let's stick to the facts. How did we get here? What mistake?

S: He thought he shot an intruder.

Minor, we see it differently! I see it as that Nel is pointing out the lesser charge ..... is now firmed up at the least.
 
N: Whilst Stipp was there, were was accused.

S: I couldn't see him, I was outside.

N: When did you see him again?

S: When Stipp said 'Where's he going, he's going upsatirs?

N: Is that when you saw phone?

S: NO.

N: When then?

S: It must have been before police arrived.
 
S says he did not see his daughter use the phone.

N asks if Stipp discussed the injuries with him.

S: No, he just came out and said she had a fatal head wound.

N: And noone told you how many wounds she sustained, not even your daughter?

S: No.

Nel wants an explanation of this. I want to know why you made this mistake. .

Stand. he thought she was an intruder.. all I can say, milady.. I interpreted him as saying he made a mistake.. he said she thought she was an intruder.. that's exactly what he said..

Nel. you saw him walking down the stairs. . there was enough light for you to see the expression on his face/?

Stand. yes.. .there were lights on. yes..

Nel. id you see the accused make a phone call?? do youknow if he made a call from his phone? ?

Stand.. yes..no. my daughter called on his phone. Oscar called mr Divaris..

Stand.. the phone was on the counter, the outside line .. on a charger the outside COUNTER of the kitchen..

Nel. you say.. there was a phone line in the kitchen, and a phone on the charger??

stand. . Oscar was in the kitchen, he was trying to throw up.. I saw the phone then.

Nel. when you arrived, you and your daughter were the first two people in the house..

stand. correct.

Nel. when he came out, Stipp , you and he discussed this??
Stand. no. he just said, she had a fatal head wound.

Stand. No.

Nel. did you know how many wounds she received??

Stand. no. No. I didn't..

Nel. so. you have kept uo with the trial on the tv, etc,. papers, radio?

Stand. well I get the papers delivered every morning. so yes.

Nel. the defence team went back on a few occasions. did you assist them>?

Stand. no.
 
In response to Nel, S outlines how he has followed the trial, reading papers everyday etc. He says he has not helped defence, except holding keys to the house to let people in.
 
Ha, Trooper, glad you managed to get all the 'I made a mistake saying he said he made a mistake' stuff!
 
Nel wants a minute. He seems to have lost his way....
 
Minor or other lawyers...question...what did this witness bring to support the defense? I do not understand with clarity what the thrust/justification of him on the stand was to support them? TIA
 
Nel. when you spoke to Dr stipp. you were convinced he was teling you of the shots.

STand. yes. he said 4 shots, screams and then 4 shots..

Nel. you never discussed this with him again?

Stand. no. I only asked his cell phone in case the police wanted to contact him.

nel.. you phoned Stipp later, to tell him the defence may contact him?? why did you do that.

Stand. If you give me your phone number, its good manners, I had already given Oldwage the phone number.. so I told stipp he may be ringing him.

Maybe I am misunderstanding ...

Am I to believe that OP and Stander had no contact at all even when he was out on bail??? (re. Nel asking him over & over if he ever spoke to OP again after that night)

If so, I'm not buying it for a minute.
 
N: You phoned Dr Stipp later, indicated defence might want to contact him. Why?

S: In my mind it's the right thing to do, good manners if you've given someone's number to someone else...

N: So when you called Dr Stipp, you already gave his number to defence?

S: yes.

Court adjourned for Nel to pull himself together. Says 'I'm getting lots of advice from everywhere, can I just have a minute Milady?'
 
Within one hour of Reeva's violent death, Stander is giving Dr. Stipp's information to Oscar's defense attorney... not the police.

Any question about whose side he is on?
