Cricket bat sounds hitting the door, gunshots and screams will be discussed together as they are related to each other
 
OP looks about to break down. Will Judge Masipa adjourn if he does?
 
J: Shortly after 3, various pple heard things they thought were shots and screamed....defense admitted there were shots...cricket bat sounded similar and this was not contradicted

Judge says it became obvious some witnesses mistook 'misinterpretation' of sounds.
 
Masipa has done her stuff. Shots first bats last. But I didn't know the State was in common cause with the defence on that since they placed the shots at 3:17.
 
I hope that does not mean she has to read out loud the thousand pages. :gaah:
 
Wasn't contradicted that cricket bat sounds and gunshots were similar - clear that some of the sounds interpreted as gunshots were actually cricket bat hitting the door.

Not contested that the gunshots were heard before the cricket bat hitting the door.

I think she's going to find that the screaming had to have been Oscar
 
Some of the sounds determined as gun shots could have been sounds of cricket bat striking the bathroom door, says judge.
 
Yep. Judge is def saying witnesses mistook bat for shots etc, and some missed sounds: 'Ms Berger refused to concede...her and husband evidence correctly criticised as unreliable

She goes on to say unfair to accuse them of collusion over statements.
 
Judge says Burger and Johnson were unreliable but not such a big deal that their statements were almost the same. Judge says Burger and Johnson heard the cricket bat hitting the door, not the gunshots.
 
J: They were genuinely mistaken in what they heard...evidence must be rejected in entirety.

She also said they were not dishonest!!!
