I don’t know for sure but I would think that any of these would be included in the state’s presentation in the penalty phase. Since it is DP case it is a little different than a typical trial where the victim impact statements are given to help the judge decide on what sentence to impose. The jury will make the decision here so I would think any victim impact statements must be given before the jury goes in to deliberate the penalty.What about victim's statements?
