SteveS, can APD file multiple SA charges for each occurrence?
 
I don't see any lack of redaction of her name. In reading the affidavit and arrest warrant, it appears her name is nowhere to be found, and same with media reports. Maybe some are confused, but her name is NOT JENNIFER SMITH. That is only a made-up name for use in the publicly available documents.

I thought SJ was referring to Rand's name being shown?

But he wasn't 18, 19 or 20 at the time. He was a 22-year old man who lied about his age in order to manipulate an underage girl into having sex with him.

Carlos Quintanilla needs to browse the TX penal code & lookup the legal definitions of "child" and "sexual assault".
 
I could not help but smile at this. It is difficult to find descriptors for the sort of behavior EA displays. I think we keep reaching for common terms to describe him because there is accumulating something more scary here than most of us can comfortably deal with. Take the 'ie' off of meanie and we get a bit closer to that scariness. Mean. EA is mean. And then the mind sort of stops a minute, hovering outside of where that meanness could lead and its consequences for Christina (and other possible victims, if there are some). It is a meanness that has utter self-gratification at its core. He wants what he wants when he wants it, and at the same time, he probably does not want to confront what he is, because that means that a surface politeness can be penetrated by others and that he cannot wear the wool of a sheep when he is a predator.

Pretend that meanness marks a point of no return, where beyond it is just him and his victim and his power over her. Now step beyond that point and think of Christina.

What we see -- he lies when it suits him, he shows no respect for the women in his life, he bamboozles his parents and the parents of his girlfriend -- is just the meanness at the gate and beyond that gate is where Christina had to go, to where he did not have to pretend. He could drop his façade. Does you mind want to stop right there? Christina did not get that choice.

I have spent much of my life trying to parse body language and facial expression. On that video of that walk to the garage, he moved behind her ever so slightly. Her back would have been what he was focused on. He did not move so much to the back of her that he aroused suspicion, but I believe he moved just as a predator does, sizing up the vulnerabilities of prey.

You may say that I am over-imaginative, but I trust that instinct of mine. I can almost feel his gaze crawling up her back while she texts on, oblivious, focused upon someone else entirely. I think he was angry, I think was dangerous, and I think he formed his intention then.

Reading this thread today, I passed beyond some of my own defenses: I really want to see this guy convicted. I really hope the prosecution can persuade the jury, and that they can see what I already believe. Before, I said I was about 85%-90% convinced of his guilt. I am at a 100% now. I feel a sort of chill. I think this guy is evil.

I saw that ever so slight drop back behind Christina as well and it chilled me. I instantly saw a panther type predator. Panthers (cougars, mountain lions) are such precise killing machines and they attack, unseen, from behind typically. I think he was getting ready, sizing it up, in that clip.

I realize that I'm in the minority on this one, but I'm not going to get too worked up on EA on this charge. IMO, they were in a six month relationship and she was at an age when many girls are beginning to experiment with sex. It was a bad relationship for both of them to be in because of the law, but if it was consensual then I have a hard time calling it sexual assault or rape even though the law does. I'm typically on board with the majority on EA, but not this time.

I'm thinking that LE had to make the charge though, especially if the prosecution wants to tie it in to EA's behavior pattern during trial.

Yes, that is the crux of the matter.
I do, however, have a problem with the term "sexual assault" in this case. (It seems more like sexual manipulation.). Technically it is illegal, but it doesn't register as what I consider assault.
The terminology emotionally exceeds the crime to me.
And, I have believed EA is a predator and 100% guilty in Christina's disappearance/murder since day 1.

I have mixed feelings about cases like this...unless the victim is pursuing justice, alleging rape. Yes, laws were made some years ago that made sexual relationships illegal between people of certain ages...but I really lean toward those laws protecting children, not older teens in a willing relationship. I think it is a bit mixed up that a teen can held responsible for murder and get life in prison but is not old enough to have sex with someone she considers her boyfriend. Jmo

He sounds even more stupid on social media, insinuating that the only reason Enrique is charged is because he is Mexican. I hope the Arochi's will seek a different spokesperson. I don't think he's doing them any favors.

Agree. When I saw his name speaking out about the guy who was killed by the Grapevine cop, I think my eyes rolled in the back of my head. I think a lot of these civil rights personas do more harm than good. MOO
 
I'm confused about how the order of charges will go down in this case. Will it be:

1. Theft.
2. Sexual assault of a child.
3. Aggravated kidnapping.

? or

1. Sexual assault of a child
2. Theft
3. Aggravated kidnapping - doesn't this charge have to change to murder at some point ?
 
I believe LE is taking full advantage of the fact that EA is not a US citizen and only here on a work visa to control the situation; just as Mexico does when one of our boys messes up and gets caught in Mexico. Or Amanda Knox in Italy....

When does EA's green card or work visa come up for renewal? How is that going to work?

Narrator: Almost all sex criminals exhibit some type of deviant sexual behavior in their TEENS OR EARLY 20s. Randy lee allen appeared to be one of the few exceptions. I just found it incredibly strange, all of a sudden one day, he woke up and decided to commit such a horrific crime. I don't think that Randy Allen ever considered forensic evidence being something that could link him back to this. I think that because I think he intended to kill his victim.

There had to be more in his background -- we just were unable to uncover anything.

Narrator: Randy lee allen lived in the dallas/fort worth area of texas at the time when a number of young girls were abducted. I feel like there's probably other victims.

Are the prosecutors trying to set up a pattern deviant sexual behavior with EA with the sexual assault charge? I'm just not seeing it with the new charge.
