If she suffered some sort of mental break, either independently or due to something happening with James, she may honestly believe (or desperately want to believe) that he is safe and happy with some other family.
Yes it's possible but I don't believe that's what is going on here. She or someone else she is covering for hurt that baby and she's lying. That's MOO, anyway.
 
Giving your child to someone and calling it an adoption is not an adoption. Legal adoptions can be done quietly, but there is proof they occurred in the form of a court order approving the voluntary surrender of parental rights, and a court order approving the adoption. She would have proof, the court would have proof, the adoptive parent would have proof.

Even if you adopt a dog from a shelter, you get paperwork.

If she threw away her proof or won't cooperate with sharing that proof, LE can independently verify with the courts that the adoption happened, they don't need her to answer that particular question.

Not to mention that there would have to be a surrender or termination of the father's parental rights, and he hasn't made one mention of that happening. Just because he's in prison doesn't mean he lost his parental rights. If his rights weren't terminated or surrendered, then the child cannot be legally adopted.
I totally agree with your post, sadly, I don’t believe this sweet baby was given up for adoption. Or given to anyone to care fir at all. And that’s the real heartbreaker here, as with many of these cases. So many people, the aunt specifically here, would gladly have loved this child and provided a loving environment. It hurts my heart so much. There are resources available if the parents would only reach out for help.
Admittedly, I’m far removed from from any situation, but would love to counsel these young parents. Not that I have any credentials or much free time for that matter. But I feel that this is so important and would love to be able to help in any small way. Not trying to derail the thread for James, but if anyone can point me in the right direction, I’d love to help.

In the state of Texas if the mother is single she does not need his signature. He is also not on the birth certificate.
A neighbor, but GM has doubts about the Feb 22 sighting.

Young mother, son reported missing from west side | kens5.com

SAN ANTONIO — Police are asking for your help to find a young mother and her son last seen on the west side last month. According to the San Antonio Police Department, the two are listed as missing.

Dlanny Reaneille Chairez has straight, shoulder length brown hair and a flower tattoo on her left back shoulder. She is 4'11" and weighs 210 pounds.

Also missing is her year and a half old son, James Avi Chairez. He has straight, shoulder length orange hair. James is about 2'6" and weighs about 28 pounds.

They were reported missing on February 22 and were last seen in the 7600 block of Southwest Military Drive.

SAPD said the mother is an adult and has custodial rights, but they are hoping she will contact them police to let them know they are both alright.

Mariesol Gomez is Dlanny's aunt. She said she hasn't see the baby since Thanksgiving. The great aunt of the child, fears he may not be alive.

"I have no reason to believe that he is at this point," she said. My heart wants to tell me that he is in good hands with somebody. But, my mind races with different scenarios."

Gomez said the last time she saw her niece was around the end of February. Gomez said since November she had been asking her niece to see James.

"I got tired of hearing that he is asleep, or we are not home," she said. "I would go over knock and she wouldn't answer me."

Gomez said not one family member has seen the 18-month-old since November. The family filed a missing person's report on the baby and his mother just a few weeks ago. Gomez said the mother stopped communicating with the family around that time.

"I would like to find her and make sure she is fine," Gomez said. "And that way I can get the answers that I need to where the baby is. I am not going to give up until I find him."

The Aunt dudnt file a missing persons report until after Dkanny told her that she was going to adopt him out to another couple. The SAPD believes that he James is still alive in the San Antonio area. There are no active searches going on and no missing person reports because I believe they know where he is. Dlanny is cooperating with the LE and even called her Aunt 3 days ago.

If LE knows where the baby is and D'Lanny is cooperating with LE why is she still in jail?

I believe baby James was given to someone for adoption like I believed baby Chance Wash was given to someone for adoption. IOW, no way. I believe baby James met a horrendous, painful death and his mother needs to pay. MOO.

"I told her, 'How do you think we're doing?' You know, how do you think anybody's doing?" Gomez said. "I did ask her, 'in order for me to help you, I need you to help yourself. Please, you know, just say something -- talk, you know, tell us where he is.''

"She started crying. She says, 'I can't, I can't talk about it right now. Tia, I can't talk to you about it. I'm already talking to you against my attorney's advice.'"
