If the ex gf did not tell them to rob her then she can't be charged with capital murder. And as far as we know. CC didn't know that the ex gf was the mastermind. So if the shooter isn't caught then the ex gf may not get charged with capital murder.
Forgive me, but I can't understand what it is you mean. If the ex girlfriend ordered/arranged something that resulted in CH's death, she will be charged with murder. What is it that you think the ex girlfriend did, exactly? Robbery and murder are two very different things. If there are three parties involved in a murder, they are all responsible for that murder. This means the mastermind, the driver and the shooter are all responsible, under Texas law.
The capital part is what would change, because it would be murder absent the other felony of burglary.

At least two witnesses reported seeing a man, however, and the warrant states detectives corroborated CC's account from witness statements and surveillance video. So that all seems to indicate a male shooter, but who knows. What is not indicated in the warrant, is that CC acted alone. Now could that change tomorrow or the next day? I think we can now take "professional" off the table. Not the brightest bulbs in the box. How do any criminals think they'll get away with it? Most do get caught. And when there's a personal vendetta involved, it is most often solved fairly quickly in addition.
The smart person would understand they will get caught and then not do it. Lots and lots of dumb and irrational people in the world, we sure see evidence of that. Every murderer walking through the doors of prison is someone who thought they'd get away with it.

ETA I guess the teenaged boy's dad is considered a witness by the fact that he heard the shooting, though the articles read to me like only his son actually saw the shooter.
