In all my years of trial watch, I've never seen a defendant "frisked" in open court. It is protocol to search defendants taken into custody after conviction but again -- I've never seen this occur in court immediately upon delivery of verdict.

I also read ( on here) that Judge Kemp did not like defendants cuffed or shackled in her court room. Perhaps that’s how Judge wants the defendant searched for self harm objects - just casually straighten her hair.
I have no idea. IMO it was no biggie.

MOO

Twas a simple reply to a seemingly simple, single, inference-free question: why enraged.
But, OK. Here's one for you: how many peeps living there went to the wrong apartment, entered the apartment, had enough time to see they were obviously in the wrong apartment, but choice to shoot to kill the person inside?

Well, You didn't answer my question.:)

March Lipscomb testified that he walked all the way down the hall. He even saw a handbag that he knew didn't belong there. He proceeded and walked all the way to the living room before coming face to face with the occupant. Was his mistake a result of preoccupation because he was pizzed. Were all the others preoccupied because they were pizzed.

Marc didn't hear movement in the apartment to alert him before he entered. Had he heard movement, who knows what he would have done.

I just saw this on the local news. My heart broke. That young man . . . another one gone too soon. I believe I heard he was 28 years old which is what Botham would be today. Too ironic and too sad.
Nothing ironic about this at all. The implications are chilling. Everyone should be tripling down on their prayers for peace in Dallas about now.

Amateur opinion and speculation

Honestly, Magnolia, I don't give two diddly-do's one way or another about whether Amber was or was not distracted, and have no interest in debating what for me is ultimately an irrelevant point.

As I've said, repeatedly, and ain't gonna say no more, the bottom line for me isn't about race, or that she was a cop, or whatever the circumstances were that brought her to poor Botham Jean's door.

What matters to me is that Amber chose to open the door, chose to shoot to kill, and chose trying to cover her own arse instead of helping the man she just shot as he lay dying.

The rest, the hair -splitting points, especially post- trial, is just noise.

I disagree that JB was a key witness that helped "put Amber Guyger away." In fact, JB testified that he heard voices between BJ and AG before shots fired -- giving credence to AG's testimony that she gave commands to BJ. JB was yet another resident that also testified he'd gone to wrong apartment (floor) before.

It's indeed tragic that another young man lost his life last night but I don't believe Mr. Merritt or anybody else should be so quick to associate his death with the trial of AG.

Reviews of Atera apartments where shooting occurred cite increased crime at this complex including armed robbery of resident in the parking lot at 6pm.

Joshua Brown was shot in his mouth & chest. He was exiting his car at his apt when he was ambushed & shot at close range. His mother asked my office to help find out who murdered her son. She suspects foul play. He had no known enemies. He worked for a living. We need answers.

Sh't's just getting serious.

Everything about this trial was political (or worst...racial).
She's white, he was the "good black boy"...
Bunch of activists (even some psychopaths like Farrakhan I guess) talked about this case.
When the judge imposed the sentence some of these so called activists said it was a victory for black people in America...
What kind of trial was that?
The sentence as well is ridiculous...this woman found somebody in her place and killed him because she thought he could have been dangerous. Maybe it was a mistake, or if anything, manslaughter. Not murder.
This sentence should be withdrew.
Did you not read anything about this trial? She broke into HIS place and shot him.

The conspiracy theories are out of hand right now, IMO. If retaliation had anything to do with this murder, knock me over with a feather if police are involved. It could be the work of some nutcase who believes Amber was wronged in court. I would be surprised as I don't think the testimony of JB was inflammatory in any way but no accounting for a warped mind and what they are capable of. Maybe just wrong place, wrong time. Or a Social Justice Warrior who felt betrayed by his testimony. MOO. Only theories right now. I think those are the options.
ETA: Could also be personal and have nothing to do with the trial.

ETA: process attempt to copy/paste to bring relevant posts to Joshua thread for edit. need practice. lots of it.

While the 28-year-old gave his testimony in front of a jury Tuesday (September 24), he broke down in tears as he recounted the events that took place in the Dallas apartment complex on September 6, 2018, reports NBC.

Judge Tammy Kemp appeared to get teary-eyed herself after the witness and jury left the courtroom. She was clearly emotional from Brown’s testimony about the night 26-year-old Botham Jean was killed, as shown in a video shared on Twitter by NBC 5’s Larry Collins.

From inside his apartment, he could see Guyger on the phone, crying, and heard her say, “I went into the wrong apartment.”

“I thought it was my apartment,” Guyger could be heard saying repeatedly in the video, NBC reports.

She then replied, “Top Left. Top Left,” when arriving officers asked where Jean was shot. His body can be seen lying on the floor in a pool of blood around his left shoulder.

Officer Lee testified that, at the time, Jean still had a pulse but was unresponsive.

The officer also testified, “If you open a door and realize someone’s inside, you have two choices: Presume you can safely reposition, or shoot and figure it out later.”

“He was really treated like an animal,” the deceased’s mother, Allison Jean, said after she first heard the 911 call in April, CNN reports.

Judge In Amber Guyger’s Murder Trial Gets Emotional After Witness Joshua Brown’s Tearful Testimony
According to the Dallas Morning News, officers arrived on the scene at around 10:30 p.m. to the Atera apartments located at the 4600 block of Cedar Springs Road in Dallas’ Turtle Creek neighborhood.

Per that report:

Police found a man on the ground with multiple gunshot wounds. He was taken to Parkland Memorial Hospital, where he died from his injuries.

Witnesses told police they heard several gunshots and saw a silver four-door sedan speeding out of the parking lot.

The Dallas Police Department (DPD) has yet release information about the victim or the suspect. But attorneys with knowledge of the case and Brown’s family confirmed Brown’s identity via social media on Saturday afternoon.

Dominique Alexander, a Dallas area civil rights activist who is close to Brown’s family, posted about his death on Facebook:

I [have] been notified that Joshua Brown who testified on the stand in the Amber Guyger trial was shot & killed last night, not sure what happen but I will keep you updated on new developments.

Lee Merritt, the attorney for Botham Jean’s family, later confirmed the news in a separate Facebook post.

“Joshua Brown, the next door neighbor of #BothamJean was killed last night after being shot several times by an unknown assailant,” Merritt noted. “Local media has reported on the shooting but have not confirmed Brown’s identity. Because, Brown worked closely with prosecutors just a week ago to ensure Amber Guyger was properly convicted in the murder trial, the DA’s office has fairly direct contact with Brown and his family. An ADA has confirmed that it was in fact Brown who was killed although they have yet to identify a suspect or motive for the shooting. The case is now in the hands of the Dallas Police Department. Brown’s testimony stood out as a fact witness who was approaching his apartment directly across from Botham Jean’s apartment when shots rang out.”

Online reaction thus far has been fierce–with many people terming Brown’s death an “assassination,” “hit,” and/or revenge on behalf of Dallas cops. While the timing of Brown’s death is suspicious, there is at this time no evidence to support that.

Guyger’s keys still hung from the door lock when the first officers arrived.

"Come on chief," Officer Michael Lee repeatedly tells Jean while he and another officer trade places trying to resuscitate the dying man.

Several friends gathered around Guyger as Sgt. Breanna Valentine pulled into the parking garage, dash-camera video showed. Hermus asked Valentine whether the friends, who appeared to be police officers, were members of the Dallas Police Association.

“This investigation from the very beginning treated Amber Guyger differently because she was a police officer,” Hermus said.

Joshua Brown lived across the hall from Jean. He was returning home when he heard loud voices as he walked toward his apartment.

He said it sounded like "two people meeting each other by surprise" but couldn't make out what the voices were saying. After the shouting, he heard gunshots.

Defense attorneys said during opening statements that Guyger yelled "Hands" at Jean when he advanced toward her in the apartment.

Joshua Brown's testimony
Brown testified that he met Jean the day he was killed. He said he was down the hall from his apartment when he heard the voices of two people who sounded like they were meeting by "surprise." The gunshots followed "right after," he said.
Soon after, from his apartment balcony, Brown said he saw Guyger come out to the hallway from Jean's apartment on the phone. She was "crying, explaining what happened, what she thought happened, saying she came in to the wrong apartment," he said.
Through his peep hole, Brown said he also saw the former officer "going back, back and forth on the phone."
"And then, I think she went back inside, then came back out," said Brown, who lived across the hallway from Jean.
During testimony, Brown broke down and wiped away tears with his T-shirt. Jean's family members could be heard crying softly.

Merritt said Brown’s murder “underscores the reality of the black experience in America.”

“Brown deserves the same justice he sought to ensure the Jean family,” Merritt wrote on Facebook. “The Dallas County criminal justice system must mobilized to identify his killer and see that he is held accountable for this murder.”

18 mins · Joshua Brown, the next door neighbor of #BothamJean was killed last night after being shot several times by an unknown assailant. Local media have began reporting on the shooting but have not confirmed Brown’s identity. Because, Brown worked closely with prosecutors just a week ago to ensure Amber Guyger was properly convicted in the murder trial, the DA’s office has fairly direct contact with Brown and his family. An ADA has confirmed that it was in fact Brown who was killed
although they have yet to identify a suspect or motive for the shooting. The case is now in the hands of the Dallas Police Department. Brown’s testimony stood out as a fact witness who was approaching his apartment directly across from Botham Jean’s apartment when shots rang out. Brown was still visibly shaken up from the incident when he took the stand to testify on behalf of the prosecution. His murder underscores the reality of the black experience in America. A former athlete turned entrepreneur— Brown lived in constant fear that he could be the next victim of gun violence, either state sanctioned or otherwise. We have more work to do deal with the constant threats to our community both from within and without.
Lee Merritt, Esq.

I am so horrified. Thoughts go our to his family and a hope for justice for Mr. Brown. Unbelievable.
