Local news is reporting that he is charged with capital murder. However, his booking summary in Tarrant County yesterday says he is charged with just "murder." I suspect this means that no sexual assault was involved, because in Texas, he would have had to have been in commission of one of the felonies specifically enumerated in the capital murder statute. The only possible felonies listed that could apply here would be kidnapping (not applicable, since she went willingly) or sexual assault. If correct, this further supports my theory that this was a sick revenge fantasy about the ex.

Am I right in assuming if there WERE sexual assault it would be difficult to know since they couldn't even identify her easily?

I'm not sure. No details have been released about just how badly her body had been dismembered or burned, other than that she was identified by her fingerprints. But, if you are correct, it would likely be too difficult for the state to carry its burden. which would explain the lesser charge too.

I think you have to have a court order to get someone else's protective order copy, or be the attorney.
 
It doesn't matter if she went with him willingly, as soon as he held her by force, he was guilty of unlawful restraint. I'm wondering if that is a qualifier in terms of capital murder.

Unlawful restraint is a separate crime in Texas. The key to Texas kidnapping is the "abduction" element, which you might be able to argue under these circumstances, but I assume theres not enough evidence to support it. It's more important that the state meet its burden and it can easily with regular old murder. Capital murder would've been risky under these circumstances.
 
So, logically looking at this through evidence, safe to say this guy probably spun out after his previous breakup.
He goes from these two charges/warrants on the 5th of this month (granted, he could have gotten the charges earlier and just now became warrants), to stalking charges, to capital murder.
 
some DISMISSED charges...wonder if its the same Charles D Bryant.....

AND he pled no contest (or paid it) the 17....
 
There is also this...City of fort worth records of accidents, crime etc...this just HAPPENED to be on the Street he lives on (THE BLOCK but they won't put address)
