#MaleahDavis Update: Derion Vence did not appear in court this morning as his bond was set at $45,000 for the new charge of injury to a child causing serious bodily injury. I tried to ask his attorney Dorian Cotlar a few questions. Not a friendly guy.

Maleah's family, on her biological father's side, were in court Wednesday.

TM, a cousin, says they're angry Vence hasn't been charged with murder. TM believes Brittany Bowens, Maleah's mother, should face charges too.

"You left her in that apartment for however many days until you figured out how to move my little cousin and then threw her on the side of the highway like she was trash," Mendoza said outside the courtroom. "You knew what you were doing. That was murder. Period. Murder."

A spokesperson for the Harris County District Attorney's Office said a murder charge carries the same penalty of life in prison, but prosecutors would have to prove Vence intended to kill Maleah.

Mind-blowing. He hitchhiked. Someone with an identical vehicle picked him up. The person who drove him is random - doesn't know DV at all. See video below. :eek::confused:

Wow. Well that finally solves that mystery.
Turned out to be a total stranger. Even Quanell was wrong about that one.

Seems like DV was telling the truth about that part of the story.
I guess his story about getting mad and throwing her in the kitchen turned out to be the truth, too.

I'm relieved to hear about the charges and I'm hoping he will get life in prison.

Who dropped Derion Vence off at the hospital after Maleah Davis' disappearance?

Police tell FOX 26 Vence hitch-hiked his way to the hospital.

They say he did not know the person who picked him and his son up the night he reported Maleah missing.

Police say they had thought he was dropped off in the same silver Nissan he’d been driving. Turns out, it was a car that looked identical, and police say the driver will remain unnamed because they are irrelevant to the case.

“I just feel like there’s no justice. There is no justice being served. Like, you steady resetting court dates. You’re steady lowering bonds. Hell, if that’s the case, just let him out and let the streets deal with it. That’s how I feel," said TM, Maleah's relative.

Prosecutors say if they do get evidence that warrants a murder charge, they’ll file that charge, but right now they have evidence for a charge that carries the same sentence as murder.

Vence’s arraignment on the latest charge has been reset for September 16.

In arguing for the higher bond, the Harris County District Attorney's Office said Vence showed "violent tendencies" when he allegedly beat Maleah earlier this year. The injury to a child charge doesn't explicitly allege that Vence killed Maleah; it claims he caused her serious bodily injury by either hitting her with his hands, hitting her with a blunt object, causing her to fall to the floor or causing her to strike a blunt object.

After ordering Vence's bond at $45,000, Jones told prosecutors in court that the lower amount was appropriate for the allegations.

"If it's a murder, file it as a murder," Jones said.

I recall a similar argument when the Judge lowered DV's bond (without a motion) to $45k when he was initially arrested.

He's not going anywhere -- hasn't made $45k bail thus far.

Just catching up.

Thank goodness a more serious charge has now been filed. I do not understand a $45,000 bond where it is a more serious charge than the first one--the first one has up to 20 years in prison, this one has up to life if I understand it correctly. The bond seems low, although I have seen lower for murder/homicide in different areas.

Reading the court document and knowing how her remains were most likely as to condition, I wonder where the knowledge comes from that first he struck her with a hand, next he struck her with a blunt object, next she was knocked to the floor and finally she hit a blunt object. This seems pretty specific and it is difficult to believe it could have all come from autopsy.

I think about these specific statements and wonder if the brother saw some of this. I sure hope not.

This child went through so much it is horrific. Like most of us, I would prefer a murder charge but if one is not forthcoming, I at least hope he gets the maximum sentence and that the sentences are consecutive otherwise.

I am not buying this story. But since her body is so degraded, this is probably all they can prove. And really, they just need to "prove" that DV is too stupid to actually call for help to save this baby. That won't be too difficult for the defense.

Disgusting. And of course, BB, the true culprit, who left her daughter with an abuser, is free.

The only bonus, is that Maleah is free from abuse. And Karma will catch up with DV and BB.

Is there anyway you can copy and paste the section that details what happened? I am confused about the wording...for eg he struck her with a hand and a blunt object. I think we need a legal expert to explain if a hand is also considered a blunt object or if the document means he "either" struck her with his hand "or" a blunt object. I've seen the word either in media reports but the actual court document would be helpful as a start to understanding the wording. TIA

I believe the DA has it covered. I read the Complaint to include the following:

....striking the Complainant with his hand.

...striking the Complainant with a blunt object.

....causing the Complainant to strike the floor.

....causing the Complainant to strike a blunt object.

To me, it sounds like they mean each of these things occurred but I suppose it could mean just one did.

Basically, the capital murder charge is off the table. Gee, it was just an "accident" that Maleah died. Take a plea, 10 years, out in 3.

DV will take that in a heartbeat.

The charge is a first-degree felony, which carries the same penalty as murder, five to 99 years in prison.

"When all is said and done, if a jury finds this defendant guilty of injury to a child, the penalty range is the same as it would be had a jury convicted him of murder, five to 99 years to life in a penitentiary," KPRC legal analyst Brian Wice said.

Huh? Not a chance in **** would a penalty offer of 10 years ever be proposed and/or considered. :confused:

I'm confident DV will be convicted as charged, and the penalty will be same as murder conviction (5 to 99 years).

(I'm certain of this term having just watched David Temple trial).
