If Misty's appeal is considered frivolous, what is Ron's after he got a deal and reduced sentence?

I think the reason they consider it frivolous is because here in Florida there are soooooo many drug dealers and doctor shoppers and none of them are doing the time these peeps are and most of them have sold more dope.



What i cant seem to understand is why do they have to do so much time and others dont? I really think if they get the right lawyer they will get out.
I dont want these ppl out on the street but

It would be interesting if you show us where others don't get the same. Every case I've seen they are charged alike. The judges hands are tied..they must serve the minimum.

It is the judges discretion to sentence...however; the drug trafficking laws are set in stone. There is a minimum....four of the five got the lowest allowed. tommy is the only one who could possibly win an appeal.

Trafficking laws and penalties are all the same in Florida. No one is getting less than the minimum allowed. I think people get trafficking and possession confused. Traffickers will not get any better than the minimum. There are mandatory minimums for trafficking. It ranges from three to life...all dependent on the amount/weight of the drugs.

Do not know what this Motion to Compel could be about, but it is not Ron's motion, it's the SA's motion.

It looks weird the way it copied. It is not a motion to compel the apellee to do anything...it is a motion to compel filed by the apellee (the SA).
 
So essentially, if I'm reading this correctly, the state is compeling RC to provide sufficient discovery evidence in order to back up his claim? Any thoughts? (or help here...TIA)

I think it means the next thing we probably see is Ron withdrawing his appeal, lol.

I'm sorry lil'momma but I'm not much help here either. I just wanted to help keep Misty's court docs up-to-date. When I noticed the recent action, I posted it.... I'm sure one of our other gifted & talented WS members will come to the rescue!

Misty's atty had filed a motion to supplement the record and that motion was granted by the court. An order was issued to the lower court to send those records. They have complied and now the appellate court has received the supplemental records. This would include documents pertinent to Misty case, her plea, conviction and anything that had been considered in imposing sentence.

At least I think that's what it is. I have some legal background but my experience is limited to procedures in my state, which is not Florida.
