Virginia Beach shooting victim couldn't defend herself in gun-free zone

Kate Nixon talked with her husband the night before the shooting about "whether or not she should take a pistol and hide it in her handbag," attorney Kevin Martingayle told WHRV. She chose not to since it is against the building's policy to carry a gun, even if someone is licensed to carry.

"The night before it happened they had that discussion," Martingayle said. "So there was obviously something big going on."

Julie Hill, a Virginia Beach city spokeswoman, told the Virginian-Pilot she was not aware of Nixon’s concerns, but all aspects are being looked into.

"We are going to make sure that we cover everything that is a part of that ongoing investigation," she said

Virginia Beach tries to dispel "rumors" about mass shooting

Officials in Virginia Beach pushed back on Thursday against what they described as “rumors, innuendo, conflicting theories and speculation” about last month’s mass shooting in a municipal building.

But police in this coastal city of nearly half a million people were also no closer to offering a possible motive behind the nation’s deadliest mass shooting in 2019. And the family of one the 12 people who died is demanding an independent investigation.

The statement outlined police efforts, including plans to interview 240 people, but it also sought to rebut misinformation about a tragedy that remains particularly inscrutable and ripe for conjecture.

The city’s statement also addressed what it said were “suggestions” about one of the victims, Kate Nixon, an engineer who worked with Craddock.

Officials said Nixon did not receive Craddock’s resignation email, which he had sent on the day of the attack, and said Nixon “was not a supervisor in the shooter’s chain of command.”

Kate expressed to her husband concerns about this individual in particular, as well as one other person,” Nixon family attorney Kevin Martingayle told WHRV's "HearSay with Cathy Lewis" radio show Monday. “In fact, they had a discussion the night before about whether or not she should take a pistol and hide it in her handbag -- and decided not to, ultimately, because there's a policy apparently against having any kind of weapons that are concealed in the building."

The night before Kate was murdered on May 30, she sat Jason down at the table and told him she wanted to take a gun to work because a disgruntled co-worker was being fired and was threatening.

"She said, 'Jason, I have an eerie feeling. We are letting this guy go, and he is supposed to be police escorted out," Jason recalled.

"He has made comments he wants to shoot up the place, and I said, 'Well, you can take my gun and put it in your purse, and if nothing happens at least you will be a safe," he said.

That coworker didn't end up being the shooter that took the lives of Kate and 11 others, but Kate's intuition of a fateful Friday rang true.

Craddock used a .45 caliber handgun and brought multiple extended magazines that were emptied by the time officers shot him. He died a short time later. Virginia Beach and other Hampton Roads communities have been left reeling in the wake of the tragedy.

Craddock spent much of Friday, the day of the shootings, working.

At some point, he emailed a resignation letter. Exactly when is unknown because the city redacted the email’s time stamp. Craddock cited unexplained personal reasons for putting in his two weeks’ notice.

He reported to a job site at the intersection of Haden and King William roads and was there until 2:30 p.m. or 3 p.m., according to sources with knowledge of the meeting.

About an hour later, around 4 p.m., Craddock began shooting his co-workers.

some speculate the time is redacted because it's right before he went on his spree .. and that the person he quarreled with was due to be terminated yet wasn't so he quit instead ..

Not wanting to return to the scene of the shooting, he met with a supervisor Tuesday to talk about the situation and court records say McIvor became agitated and angry, storming out of the office.

The next day, police came to McIvor's place of work and arrested him.

“The allegation is that he was agitated, that he was annoyed and that he raised his voice,” said attorney Taite Westerndorf. “Those things may be true, but they are not criminal. It’s not criminal to raise your voice and it is not criminal to be agitated. I think under the circumstances it is understandable that he would feel that way.”

No one was ever threatened.

“When I read the criminal complaint I was outraged not only as an attorney but as a member of the community to see this is how we are treating the survivors of the tragedy,” Westerndorf added.

McIvor said he simply doesn’t want to go back into Building 2.

This is so strange that he was arrested. Makes me wonder if this was the guy talked about earlier who people thought would be the one to go postal. That's the only thing that makes sense to me.

With 40 plus yrs. in upper management, I can't believe that the "City" approved these charges.

Its all going to boil down to what in the policy manual of the city in this type of situation. You can't make up rules as you go.

Usually hostile employees are removed immediately or met at the door by HR/police the next day.

I see lots of $$$$ coming his way.

JMO and from experience....most private companies pay the employee for the time stated in notice, thank them, help clean out desk and exit the building. Its never a good idea to allow employees to work notice, creates drama with employees, they are leaving for a reason, can sabotage work, steal, the list goes on and on.

I've been in situations where the police were involved in employee termination and have hired private security in one extreme situation. Employers are obligated and liable to protect employees.

Oops, didn't see it was the supervisor and not HR.

JMO...the supervisor should be placed on administrative leave, the City Attorney should appear and represent the employee charged. Only the supervisor can drop the charges.

It's so easy to "take out" a warrant or personally charge a person in VA. You go to the Magistrate, swear to tell the truth, write out the situation, swear to charges and bingo...arrest warrant. Many warrants are obtained as revenge or be vindictive and charges dropped before court. imo and 3 friends that are judges.

What I don't understand is why LE didn't contact HR for the City prior to the arrest? LE knew this was a potential volatile situation, right after shooting, what if he had a gun?

I'd like to say, I can't believe the City allowed this, but can't. Everyday Cities manage by politics or personal preference. It cost Cities millions a year for these kind of decisions. imo

Under VA State Law, employers is required to provide medical care. Was this offered??? Its required that you offer medical care for any injury. Was he offered counseling? VA law requires employer's to make accommodations for injuries employees.

Surely, he was not the only employee who feared going back to this building.

Great points. I can't fathom any of them wanting to go back to building 2. I'm not debating right or wrong in terms of HR protocol, VA law, or what's been offered to the victims by the city. I'm simply stating I can see how anyone who was there that day might now interpret an aggitated employee raising his voice as a serious threat.
