The defense team hinted during Voir Dire that they may argue that Codi Bigsby is still alive and living in another state with someone else.
They also hinted that Cory Bigsby may choose to not take the stand.
Prosecutors said during Voir Dire that they plan to allege that Bigsby beat his son to death, spread feces over his body, and then got rid of his body.

Bigsby has pleaded not guilty to murder and concealing a body.

Defense attorney Curtis Brown has moved for a mistrial twice, and then moved for Judge James Hawks to recuse himself.

Hampton Commonwealth’s Attorney Anton Bell is prosecuting his first no-body case this week against Cory Bigsby, who is accused of killing his son Codi. DiBiase says Bell must prove both guilt beyond a reasonable doubt and that Codi was even murdered.

“Here, without a body, we don’t know what the manner of death was, or what the cause of death was, and that becomes a real challenge. So, you have to rely on circumstantial evidence,” he said.

No-body murder trials end with convictions (88%) far more often than murder trials with a body (71%), according to DiBiase’s research. He pointed to two possible factors: prosecutors likely only send the strongest of cases to trial, and juries may find it easier to convict when there is a relationship between the defendant and the victim – like in the Bigsby case.

On the third day of the trial for Cory Bigsby in Hampton, testimony is underway.
Jurors are hearing from the mother of Codi, Dina Abdul Kareem after prosecuting attorneys called her as their first witness.
She took the stand and appeared to be struck by emotion — having to identify the defendant and her ex, Cory Bigsby, as well as a photo of her missing son Codi.
They share four children, including Codi, who Bigsby reported missing in January 2022.
In court Wednesday morning, Kareem spoke about custodial disputes with Bigsby. Those ultimately led to what she calls an agreement on co-parenting. Kareem, who moved to DC, testified she handed off their four children to Bigsby at a halfway point from Hampton in November 2020.
From then on, Kareem testified Bigsby, for the most part, ghosted her. She said she didn’t have access to her children, despite her attempts to reach Bigsby.

I'm disgusted by them even attempting to say Codi is alive in another state.i can't even say what I think of defense attorney brown trying to get released as attorney because not even the jury pick was fair for Cory .well what about Codi is him being unalive fair for him. She had been in a relationship with Cory Bigsby for four years, and although they were engaged at one point, they were never married. After she ended their relationship in 2019, she moved to Washington D.C.

She was hospitalized in 2020. She then decided to let Bigsby have the kids and wanted to co-parent. She met Bigsby halfway between D.C. and Hampton on Nov. 1, 2020, with their four kids.

She was never given Bigsby's address, and he was often unreachable.

An email she received from Bigsby in April of 2021 said the following, in part: "[Codi] is still doing the same stuff... He needs to come back to you... I do not want to seriously hurt him to protect my babies." Bigsby also said Codi needed to see a psychiatrist. Kareem said she did not believe the claims Bigsby was making in the email.

She had not spoken to Codi since April of 2021. In the last email she sent Cory on Jan. 15, 2022, she asked him, "Where are my kids? Are they alive?"

Arnold accused Bigsby of killing Codi, claiming, "After [Cory] realized what he had done and after, he put his body in bed with his older brother." Arnold continued to say, "Evidence shows Codi was dead for months before being reported missing.". ................ The hell did Cory put Codi unalive in bed with his brother please tell me I'm reading this wrong

A handler for a tracking dog testified his canine didn't pick up any scent belonging to Codi – despite saying he received a pillowcase from Bigsby that the child allegedly used just the night prior.
However, a handler for a cadaver dog testified his canine alerted to the scent of human decomposition or remains in one of the bedrooms inside the Bigsby home. That cadaver dog, according to the handler, also detected negative results from some rancid animal meat in a mini fridge.

Kareem was shown a picture of Codi ... She said it was the last picture she knows of him and it was in June 2021 — seven months before he went missing, taken at his twin brothers‘ birthdays.

It was that month that prosecutors say Bigsby killed his son, even though he did not report the child missing until seven months later.

The relationship ended in 2019, and a year later, she testified she had major health problems. Kareem agreed that Cory Bigsby could have custody. ...

... She testified that Nov. 1, 2020 was the last time she ever saw any of her children prior to Codi’s disappearance, and that Cory Bigsby refused to give her his home address in Hampton so she could visit.

Kareem testified that Bigsby sent her an email in April 2021, saying “I need to bring Codi back to you, I don’t want to severely hurt him.” ...

I wonder if Amina Matheny-Willard has stepped back a bit and brought Brown, Singleton and Hansen to the forefront because being the public face of the defense of a child murderer might not have the optics she wants in her run for commonwealth attorney.
 

12:30 p.m. — Brother shares last memories of Codi​

Editor's note: We want to warn you that some people may find the details of the boy's testimony that we report here disturbing.
The now-7-year-old brother of missing Codi Bigsby testified that at one point, he wasn't able to wake Codi up. He said he shook Codi, but he never responded, and that his face was red and bruised.
When the child went to tell his father, Cory Bigsby responded with "Nothing is wrong with Codi."
It's unclear when this incident happened.
The defense is in the middle of asking questions to the boy testifying right now. Bigsby's attorney appears to paint the boy's recollection of events as inconsistent.

12 p.m. — Codi's 7-year-old brother gives emotional testimony​

In court, the child described his missing brother Codi as his "best friend," sharing that he nicknamed Codi "Coco."
The boy testified he was four when he last saw Codi. At times, the boy rubbed his eyes while appearing to cry. The jury and court spectators are seeing him testify through a webcam feed.
 
I really dislike bigsby and his lawyers. My heart breaks for codi's sibling testifying and for all his siblings knowing Codi isn't coming back . Just wish Mr bigsby would man up and say where Codi's final resting place. Jmoo and ughh I wish Canada and the USA adopted Australia's law no body no parole just saying
