Thanks Courtney and Kristi for the update. I'm certain no mention had previously been made of a cell phone missing. I'd be curious to know what all was found in that septic tank. I'm really anxious to see how this all plays out. It just makes me think that whoever put him in that tank (as it seems) really thought he would never be found and it makes me sick, so terribly sick! I doubt seriously that Noah owned a cell phone. I could say so much more here, but I'm going back to biting my tongue...but I'll agree with Luvrosco and say I'm so sorry Noah had the parents he did.
 
Sorry I'm not understanding why his mother's defense is bringing this up. It was in his pocket. How does this help his mother? If anything it makes it seem they wanted to destroy the phone as evidence too.

The mother's defense is requesting evidence be preserved. It may or may not be helpful in her defense, but if it is not preserved and tested, there's no way to know.

I suspect it was an old, inactive cell phone that little Noah put in his front pocket, pretending to be like his Daddy. So it probably wasn't reported missing since it wasn't active.

The fact that LE implied the ME was mistaken and it was a "typo" really bothers me. They're implying the ME is just recycling the same report over and over again and editing it rather than generating a new report for each deceased person?? They're implying the ME is lying about the contents of this little boy's pockets, when every single detail about his death needs to be impeccably investigated and documented to ensure justice??

I understand the importance of preserving the integrity of the investigation, but to think LE is flat out denying the existence of evidence that there is indisputable proof of concerns me greatly.
 
This just gets more and more bizarre. The Roanoke Times says investigators have made no efforts to examine the phone. Why the heck not? I would think they would be thrilled at the potential for more evidence in the case. I think it's unlikely Noah just happened to have the phone, and no one noticed it was missing. I believe someone deliberately put it in his pocket after he died.

Thanks wvsoccermom. I'm lost too with the new development of a cell phone being found in Noah's pocket. What I'm thinking would only be speculation and opinion on my part, so I won't go there. I don't understand why the phone hasn't been examined and investigated as evidence, cvillemegan. I would think it could have very important info on it. Thinking it was deliberately put in Noah's pocket is really disturbing and where my thoughts went too. I'd love to hear that it was an old phone that Noah played with and carried in his pocket as Mzopinion8ed suggested. Hopefully, if/when they do examine the phone, it would show when it was last in use. I feel like if that was the case, it would have been reported by the parents, like the Pokémon cards, for instance. So yeah, I'm stumped too!
 
I also think it could be an old, inactivated phone. We give ours to our kids when we upgrade and they pretend they are real. Iphones can work as Ipods (just w/out phone service), so who knows.
 
I can only speculate also. I will just say that I don't think Ashley is stupid. I think she may be pretty intelligent, knowledgeable about how a murder investigation works and also just a good liar. Again, all speculation on my part. I don't think the cell phones existence or the fact that the defense wants it preserved brings up any question of possible innocence for Ashley. But they will try to prove that there is a shadow of a doubt that she did it....
I have no idea why LE is saying the phone doesn't exist though....

Also....more speculation but...could a cell phone ping be the "tip" that led them to search the septic tank? And if that's the case, could LE be justified in lying about it because it could hurt the investigation? I don't know...just a thought.

Thanks for the updates guys regarding Noah having a cell phone in his pocket when found.
My 6yr old has my old iPhone, to play the games and music but doesn't work as a phone, so it's possible this was Noah's. Surely the parents would have reported it missing if it belonged to them. Unless there was something on that phone that they didn't want anyone to see. :(
I'm unsure what to make of it yet.
But I can't understand why the sheriffs office would deny the phone been found? Why would they hint at the medical examiner getting it wrong? Why haven't they checked the phone out?
Very strange!
 
The article tells who has the phone in his/her possession at this time and also says no attempt has been made to retrieve any information off the phone. Why not? I thought the mother's attorney also said there was a small toy found with Noah. When are the toxicology reports due back? It doesn't seem like this case is moving very fast.

My speculation about the phone:

Ashley or Paul gave Noah their WORKING phone before leaving that morning and showed him how to call someone if their was emergency while they were gone (presumably how to call the other parents phone). Unfortunately something did happen while they were gone but Noah probably couldnt call because he was either unconscious or deceased. Ashley comes home to find him incapacitated in some way. She panics and is worried about getting in trouble. With adrenalin coursing thru her veins, she picks him up and decides on the septic tank. She prays no one sees her. Once she has dumped him in there, she realizes she cant find the phone. Once she decides to report Noah missing, she realizes she cant report the phone missing because somebody will ping it and not only will they know where the phone is, but also her childs body.

As for how this helps the defense, she has already admitted to leaving him home alone, so now she can say, "see? We gave him a way to reach out in an emergency." Plus, she can argue that if she disposed of her childs body, why would she leave her phone with him when its traceable, so therefore, this was just a horrible accident that happened while she drove Paul to work.

I believe the first part happened but not how the defense may use it.

I, too, think this is what happened. Stupid, neglectful, selfish, but not evil.
 
I'm not thinking they were that cautious or concerned. It was early, which is probably why they didnt take the kids- they were sleeping (or at least the baby). The child was born addicted and was almost immediately taken away due to neglect. I don't see *those* parents leaving a child home with an active phone to call in case on emergency. I just don't have that high of hopes for them putting that much thought into the care of these children, unfortunately.
 
IMO the phone doesn't exist. Defense is planting seeds of doubt. Most likely a clerical error.
 
Medical examiners don't type the reports, they dictate them. Whoever transcribed it probably have a program that speeds up the transcribing. Something may have been in pocket butI'm doubtful it was a phone. Toddler pockets are small so a phone would have to be smaller. A play plastic phone... perhaps. JMO .


Doesn't explain why DA wouldn't have gotten that cleared with ME prior to court... But definitely could taint people's perception of LE and the DA as noted on this thread.

I think they would of written down toy phone if it was a toy. I wonder if it was a flip phone. Probably old and he used it as a toy. Was he wearing pjs? Jogging pants have deep pockets.

I still can not picture the mom carrying Noah to the septic tank. Ugh I suppose she could of dragged him, :anguish:
 
I don't think that the parents had the common sense to give Noah their phone in case of an emergency.

I really can't see a medical examiner making false statements, after all they are going to be questioned during trial, until the trial is over I doubt that any of Noah's clothing or other articles found with him will be thrown out or destroyed it will be evidence for trial.

We can only imagine the condition in which Noah came out of the septic tank, the medical examiner's would have to be removing stuff from Noah in layers, as to not destroy any evidance,

It's been many years but I can remember being able to carry my 5 yr old, lots of mom's pick up the sleeping 5 yr old and carry them to bed

This pair just disgust me, what they did to little Noah, they deserve to be dropped in a big septic tank and have the lid closed.
