He does not have to be mirandized for the statement "I did it", to be allowed in as evidence. It is considered an excited utterence. Which means the person has stated something in regard to a crime or criminal act in which they are not being questioned about. Once a person is detained and a direct line of questioning is conducted in regards to a crime or criminal act then the officer must mirandize the person in order for the statements to be admissable in court.

I agree. I think this excited utterance is the least of his concerns anyhow. He says "it" before even questioned what "it" was I believe. In that context they could attempt at least to say he was afraid of a ticket for a traffic violation when pulled over and just admitted he did "it".

The recorded interview where he was read his rights is what he needs to be very concerned about along with the evidence. So long as he did not ask for an attorney at any time and understood his rights in the Miranda, I do not see where the confession on interview can be thrown out.

I am absolutely no expert though--and I am sure there are maybe more reasons or technicalities that can be used than us average people know (which are pretty much that one has a right to ask for an attorney, and if one cannot afford one, one will be appointed, and one must be mirandized/read their rights). I just do not see though if the defense does not try to get the confession thrown out what defense they could possibly use. They have a huge obstacle to overcome with that, it leaves them little to work with insofar as I can see.

Insanity? His actions show he very clearly knows right from wrong which is the standard and that this was premeditated as well.

I get why some feel they will at least attempt to challenge the confession. It is a pretty big obstacle standing in the way of almost any defense.

If this goes to trial, we will see the video interview if the trial is shown on TV, we know media will probably only give us parts otherwise. I wonder though if it contains any responses pertaining to what occurred in Douglas County exactly how that would be handled. Perhaps that portion would be blocked... I would welcome hearing from an expert on that. It is a big part of the case so it would be used I know that, just not sure how they would handle parts of it. Maybe two different interviews were conducted with regard to Barron and then Douglas...? Or something like that...

wow. because it is radar, i am taking my time and processing. and then going to reread and try to see between their often sensational and misleading statements.

Yes, that remark bothers me. And what is bringing up the brother and puppy along with that remark. Get a puppy to keep her happy? Way back when someone remarked on I thought puppy pads and dog toys... Is he hinting at the brother knowing and being around...

The “ha ha” after he describes going from doing nothing bad to doing the worse makes my blood boil!!! And what’s he “sad” about-that he got caught.

That struck me too big time. The fact he is still being supported by family as well even though he does not "deserve" it was another part that struck me, no big appreciation or thanks over it, of course he was writing a letter to who knows who so maybe not so odd. I am trying not to overanalyze. I even told myself the hearts around Jayme's name was perhaps wishing her well/regret/guilt (tried to look at it another way and tried to be fair--why, I do not know--maybe because it is Radar) but the remarks around that do not lend to that whatsoever. I think it was on the envelope or another page did you notice the cross? Many try that once jailed or in prison... They found Jesus or are "born again"... Just speculation...

I hope that is what he means. I have no doubt with regard to her, just not as sure what it is he is trying to say.

And yes, good for her, without a doubt, it took some real guts to do that.

Yep, too little too late, and NO way will it have any effect on the horrible things you did. I have seen people on even small charges all of a sudden start acting like a holy roller in court. I think judges see it probably quite often... ;)

It may be a stupid question, but I grew up rural. I trampled through the woods each summer off school with my dog and/or a neighbor friend or sibling. I never ever came across a dog just tied out in the woods. Maybe I am overanalyzing but when most of the letter is somewhat generic there are things I wonder about. Including acting like he has a love for animals, never hunted (loves animals?), yet like you say the "ha ha" when it is people... Animals have come up a few times. It came up with the alleged high school gf. It came up with the sister's ex boyfriend.... I would love someone with more expertise in such things to weigh in... Is it possible from the start that there was a known thing with him and abuse of animals that those closest to him knew about?

I am overanalyzing and I know it :eek::rolleyes:o_O

The letter also described how Patterson hated himself for what he did, but he acknowledged his family still supports him. He also reportedly wrote that “not a single” person has sent him hate mail, unless the letters were thrown out by authorities before he could read them.
