Denver woman, Kristen Smith, charged in Wisconsin baby kidnapping, repeatedly claimed to be pregnant

7NEWS' interviews with people who know Smith and Colorado court records portray Smith as a troubled woman, who was arrested in Aurora last fall on fugitive from justice warrants in Indiana, where's wanted for forgery, and Texas, where she's wanted for fraud.

On Dec. 6, Smith filed for divorce from her husband, Joseph Allen Smith II, 28, in Arapahoe County court.

In a sworn divorce petition, Kristen Smith checked a box saying she was pregnant. "Petitioner is currently pregnant," the divorce records said.

But Smith didn't divorce her husband. At the request of the couple, the divorce case was dismissed just three weeks after it was filed.

So, she passed through security at the courthouse with a moonbump...

This may have been said, but I didn't read everything yet. Why fake the pregnancy, kidnapping the baby and dump him? I have heard of faking and taking the baby but keeping the baby? Lost on this one. Going to read, but so much here. So happy the baby is safe.
 
In the photo of her in the orange/white striped suit, I can see how she passed those early months of being pregnant. Some larger people don't show until the last months.

I do believe she planned to keep Kayden as her own. What she didn't count on was the Mom waking up so soon, and discovering he was missing. That put her in a position to have to plan something quickly. I'm glad she didn't physically harm or kill him.

I'm wondering how this would have played out had she gotten home, or to a hotel. Would have deleted all SM contacts she had with the Mom, including changing the phone number? She must have planned to cut off all contact, otherwise what was she going to say when they moved there? I don't think the plan for her was to ever move them. With no one really knowing her real name, had she gotten home, or moved somewhere else, the chances of finding Kayden would have been very slim.

Maybe KS planned on trying to collect child support from her husband once they divorced and needed a baby to prove that she was pregnant as she stated she was in court documents.

The thing is, when cases come up here on WS, I try to put myself in the perp's mind. It's not always pleasant, but I think it's the best way to understand a crime and gain insight.

But with this case, once it was obvious that multiple agencies and the FBI were involved, I don't understand why she didn't just admit she had the baby. She could have argued that she thought the parents knew she took him. They were planning on following her to CO a few days later anyway. This was all just a big misunderstanding. If I was a psycho baby snatcher, it's what I would have done. ;)

But that's not what she did. She left that newborn out in the elements to die. I personally think it was a miracle that he survived, but what if he hadn't? She'd be looking at murder I. She is stoooopid!

MOO and all that. I hope her defense attorney doesn't plea insanity, because I can see a jury believing that. She's a psycho that should never be allowed to see the light of day again. What kind of person leaves a defenseless newborn out in the elements to save their own skin?

By that she means she tried to destroy her sister's life. Nice. Kidnapping your sister's child then leaving it to die, where was your concern then?


Sorry I've lost any compassion and sympathy I had for KS. She filed for divorce all the while her and her DH were proclaiming their undying love for one another on FB.

She is a piece of work.

My post a few pages back about my fb friend. She also was declaring on FB her love for hubby (and he was for her) and her happy happy marriage all the while cheating/moving out/divorce was going on. I'm convinced people put their best face out on SM even when its not even really a true face.

Wow I am so happy this baby is alive. I knew that she took him and in my mind I knew she dumped him to get rid of the evidence once she was asked to pull over and stop. I am glad that LE had the same thoughts and were able to find him.

BBM: Yes, this. Bears repeating. She is mentally ill IMO. Or perhaps just really really dumb.
 
Hey all. I didn't check on this thread for many days. Was it ever determined if there was an accomplice who may have had the baby part of the time and moved him? Last I heard there was no accompllice and Kayden had survived the impossible , alone in the elements for over a day . Is that still the story? TIA
 
The accused has entered a not guilty plea. I have posted this article incase anyone wants to read it. I'm still so pleased little Kayden was found safe I hope he and his parents are recovering from their ordeal.

Army discharged Wisconsin kidnap suspect caught in Iowa

(Feb. 20, 2014) IOWA CITY, Iowa -- The woman charged with kidnapping her half sister's newborn this month had been discharged from the U.S. Army Reserve after about a year of service, military officials say.

Kristen Smith served in a Wisconsin-based unit from December 2011 until her removal in December 2012, the Army's Human Resources Command in Fort Knox, Ky., said this week following an inquiry from The Associated Press.

An involuntary discharge that early into an 8-year commitment signals major problems either with one's service or personal life, but the reason for Smith's cannot be divulged under Army policy, said Army Reserve spokesman Lt. Col. Matthew Lawrence. Such discharges are rare and typically done when soldiers fail to complete training, face legal issues or are seriously injured, he said.

"For one that early, there would be probably something administratively that would have forced their hand to discharge her," he said.

Army spokesman Ray Gall said her departure is considered an "entry-level discharge" since she had slightly less than one year of service. He said it was not the result of a crime or a court martial, but that he could not elaborate under Army policy.

Smith was federally indicted Wednesday in the Feb. 6 kidnapping of her newborn nephew. Investigators say Smith took him from a southern Wisconsin home where she was visiting her half sister, and then left him in freezing temperatures in Iowa. Police say the newborn was found alive 29 hours later.

Smith enrolled in the Army Reserve in Milwaukee and was assigned to the 102nd Military Police Company in Fond du Lac, Wis. Her contract was supposed to run through 2019.

After her unsuccessful military career, public records in Colorado and Texas showed that Smith nonetheless continued to falsely claim she was employed by the Army.

She's charged with forging Army documents that said she'd been ordered to duty in Kuwait so that she could break her apartment lease in Fort Worth, Texas. When she was arrested last year in Colorado, booking records show she listed her employer as the Army's military police.

After her discharge, Smith moved into a Fort Worth apartment complex in early 2013. By April, she'd opened bank accounts under two different names and Social Security numbers in Westworth Village, a town 7 miles away, according to a probable cause affidavit obtained under the public records law. She deposited bad checks, draining $6,600 before a bank investigator caught on and called police, the document says.

Westworth Village Police Detective Darren Clark obtained surveillance images of Smith cashing checks and went to the apartment complex. Assistant complex manager Tasha Davis identified Smith in the photos, and said Smith was already moving out after just a few months, the affidavit says.

Smith had recently given Davis two Army documents that ordered Smith to relocate to Virginia and then report to a six-month officer's training program in Kuwait. The documents qualified her for a military exemption in her lease ? saving her from paying $3,033 in penalties.

But Clark determined the documents were fakes after learning of her discharge from the service, and Smith was charged with tampering with a government record. By then, she was gone.

"I would have never thought she would have been that type of person," Davis said.

Investigators say Smith moved to Aurora, Colo., and was arrested there in October. She was released on bond and ordered to appear in court in March to face extradition proceedings on the Texas warrant.

With that matter pending, the FBI says Smith traveled to the Town of Beloit, Wis., to visit her 18-year-old half sister Brianna Marshall and baby Kayden Powell, born Feb. 1.

The FBI says Smith left with Kayden early Feb. 6. Police contacted her as she was driving through Iowa and ordered her to stop for questioning. She denied knowledge of Kayden's whereabouts but was taken into custody on the Texas warrant. Police found the child alive the next day behind a gas station.

Smith, who has not responded to an interview request, faces a maximum sentence of life in prison. She's expected to be transferred from an Iowa jail to Wisconsin before a court appearance Friday.
