Will Casey Testify?

I have believed that she would INSIST on taking the stand -- despite her attorneys telling her NO WAY !

And ICA's attorneys canNOT stop her from taking the stand ...

I didn't interpret it that way. He said he would make an inquiry into whether it is her decision and her decision alone NOT to take the stand, and she nodded to say that yes, it was HER decision not to take the stand. There has probably been some issues with her attorneys not wanting her up there, so he wants to make sure they are not preventing her from taking the stand if she wants to. I don't think she will testify.

Okay, I heard the jury dismissed, heard the jail officer testifying about Casey's demeanor..was that to prove she's stable enough to testify?

I also missed and can't make heads or tails of it...was she asked "is it your decision TO testify" or "is it your decision NOT to testify?"

I must have misunderstood. I thought she nodded her head in agreement to Judge Perry saying that it was her decision to NOT take the stand. Most of you understood it differently.

I read the nod today to mean: "Yes, I understand it is my choice." Looked to me she was considering it.

I thought that the weekend psych evals might have been sought by the DT because Casey was insisting that she wanted to testify. DT knows it's a big mistake - HUGE - and were hoping that Casey would be declared incompetent and, therefore, unable to testify in her own defense. jmo

Okay... I just rewound the DVR and HHJP said,

"... whether or not if the Defendant chooses NOT to testify. I will have to inquire to make sure it's her decision and her decision alone." She shakes her head affirmatively.

I guess that leaves it ambiguous, but my interpretation is that she most definitely will take the stand. Taking into consideration her propensity to think she can persuade anyone of anything.

can agree to be prepped by them or not-she can lie to them (big surprise) and tell them she's not testifying and then at the last minute, change her mind. It's all completely and solely up to her. I can't decide becasue I don't know how delusional she is about her own abilities-I give it 3 to 1 odds that she will, perhaps just because she can and she's sick of hearing everyone else talk and she wants to take center stage for the last time.

One of the TH on WESH yesterday said that he checked the jail records and saw that Casey hadn't had visitors in a while. He maintained that her lawyers would be visiting every day to prepare her to testify if that were going to happen. That's the most compelling evidence I've heard for either side of the "will she/won't she testify" argument.

Based on the competency motion and casey's look when HHJP talked about making sure the decision not to testify would be casey's, I am pretty sure she really, really wants to (liars feel they can always explain away anything) and they do not want her to. I never thought she would go against her attorney's advice. I know they don't want her testifying. But she just might. It would be incredible and it would likely destroy her. I can't wait to see what happens.

Maybe the DT slipped that officer standing behind Casey all day five bucks to grab onto Casey's ankles if she tried to take the stand. LOL

I have thought that ICA would take the stand regardless her DT's advice not to do so from the very beginning. Sociopaths are manipulative people with egos larger than the moon. I sincerely believe that she is certain she can pull off one last whopper and sell it to the jury. ICA believes that she is infallible. She feels like she can get in there and be charming & irresistible, play coy and cry playing up the emotions. And lastly of course sell the jurors a whopping lie of a story! When you look back ICA went toe to toe with some of Fla.'s top LE and did not even quiver.

I am on pins and needles waiting to see if she is actually going to go through with it too. It would be so incredible, and LDB would certainly follow up and destroy her completely.

Without a doubt JA would rip her apart, but ICA loathes JA & LDB. The looks of disdain she has when she looks at them are enough to make my skin crawl. ICA has sociapathic tendencies and she believes that she is smarter than both of them combined and can get on the stand and lie, lie, lie and make their case fall apart and make the jury believe her. I believe she'll take the stand. JMOO

IF they are still going with the sexual abuse theory, she is gonna have to take the stand. They aren't going to get it in any other way. Dropping little hints - not going to do it for the jury. I think that's why they may be backing off of the OS.....they don't want her to take the stand.

No, she was nodding in agreement when HHJP stated that he would have to inquire, should she not testify, as to whether it was her decision or not. Given the competency issue, her rage attack the other day and the signs I am getting from HHJP, based on having watching him all these months and kind of knowing the signals judges give out when they can't say something on the record, my feeling is she really wants to testify but her team really doesn't want to. She is affirming that they better do what she wants because the judge will know if they are preventing her from taking the stand. They now know that she will be asked if it is her decision or not and so if she wants to talk, they better let her.

The judge would have no reason to make this statement at this time, since it is par for the course, unless there was some issue here.

I never thought she would testify. But it looks like, unless her team can really convince her, she just might. They have a few days, they better work on her intensely.

Or LDB. I kind of think she may be a better fit for cross. She can get testy with a female defendant in a way that would not alienate the jury. And she is good. Not as good as JA, but she's good.

I never thought she would take the stand but a couple of reasons have made me change my mind

1 - I think she is so egotistical and enjoying the attention and really wants to take centre stage

2 - I heard a specialist talking about the case on the radio and they mentioned that Casey comes across as a cold, hard person with no personality to the jurors...what she REALLY needs to do is to show her human side so they dont vote for the DP (which is her only chance). The only way to humanise herself is to take the stand. Even though she will still not be believed she will have the chance to show that shes a person

No its common that the judge will ask that. He needs to make sure that she is making that choice... not her defense team. Don't read too much into it. IMO, she isn't going up there.

Yes, it has to be asked, but they all know that. HHJP did not need to make that announcement today. The fact that he did, his tone when doing so and casey's reaction make me think something is up.

She's a coward, I don't think she will. ICA likes everyone else to do her bidding at this point. If she does JA may as well do the cross as I believe the jury is as sick of her by now as I am and would thoroughly enjoy it. LDB will need a break after taking CA apart on rebuttal I hope.

Hey, if she wants to testify, she testifies. I think her defense team has done all they can for her. Despite all the bozoisms, she HAS gotten a defense. She didn't really give them anything to work with.
