Judge delays Elisa Baker's drug trial

"A federal judge has agreed to postpone the drug trafficking case against Elisa Baker, who has also been charged with second-degree murder of her 10-year-old stepdaughter, Zahra. A new hearing date has been scheduled for Nov. 7 on the federal charges that include possession and distribution of prescription drugs.

The federal indictment says Baker distributed a mixture that contained painkillers oxycodone and hydrocodone, and the anti-anxiety drug alprazolam from at least May 2006 to October 2010.

Federal prosecutors allege Baker distributed the drugs from her homes in Granite Falls, Hudson and Hickory, where she lived with Zahra and her husband, Adam.

The drug indictment brings the first federal charges against Elisa Baker, who also faces more than 20 additional charges - including bad checks and communicating threats - unrelated to Zahra's death.

If convicted on the drug charges, Baker could face up to 20 years in prison for each separate charge. Second-degree murder is punishable by between eight and 30 years."

DA's office seeks files from Elisa Baker's attorney

"The district attorney’s office is asking that Elisa Baker’s attorney hand over any documents, photos or other evidence relating to her felony cases as required by state law.

In motions filed Tuesday morning, the district attorney’s office states it’s given its discovery to Baker’s attorney, Scott Reilly, and is asking for reciprocal discovery. The motions are filed in Baker’s second-degree murder, bigamy, obstruction of justice and obtaining property by false pretenses cases in Catawba County. They are also filed in her Caldwell County charges for two counts of obtaining property by false pretenses and two counts of financial identity fraud."

"“I think it’s a little premature because the state hasn’t finished giving me there discovery, from what I understand,” Reilly said."

"The motion also asks for the defense to tell the state if it plans to try a defense of insanity, alibi, automatism, diminished capacity self-defense, accident or voluntary intoxication within 20 days after it is scheduled for trial..."

Elisa Baker, the North Carolina woman charged with killing her stepdaughter, will not face federal drug charges until at least November, a judge has ruled.

At a hearing Wednesday, the judge scheduled a new hearing Nov. 7 in Statesville, N.C., on the drug charges, the Charlotte Observer reported. Baker is charged with peddling a mix of prescription painkillers and an anti-anxiety drug between 2006 and 2010 and the case had been scheduled to move forward in September.

Elisa Baker’s trial on drug trafficking charges has been delayed by a federal judge, saying that justice demands it.

The hearing, scheduled for Sept. 6, has been delayed until Nov. 7. Baker's lawyers said they did not have enough time to prepare for the case, and the continuance was granted.

Baker, who is charged with second-degree murder in the death of her stepdaughter Zahra Baker, was indicted by a federal grand jury May 18 on three counts of distribute and possession with intent to distribute a controlled substance, three counts of using and maintaining a residence to distribute a controlled substance and one count of conspiracy to distribute and possession with intent to distribute a controlled substance.

According to the indictment, Baker’s illegal drug activity dated from May 2006 to October 2010 and involves Hydrocodone, Oxycodone and Alprazolam. Oxycodone and Hydrocodone are prescription medications used to treat moderate pain. Alprazolam is primarily used for anxiety.

She faces a maximum penalty of 115 years in prison and a $4.2 million fine if convicted on all charges.

Catawba County residents will not determine Elisa Baker’s fate for a host of felony charges, including the charge of second-degree murder in the death of Zahra Baker.

Superior Court Judge Timothy Kincaid granted defense attorney Scott Reilly’s request for change of venue Monday. Citing the intense media coverage of the death of Zahra and subsequent arrest of her stepmother, Elisa, Kincaid said, “Anybody who doesn’t know about this case has been living in seclusion.”

Kincaid will likely decide on Sept. 12 where Baker’s trial will be held when she is arraigned on the murder charge.

HICKORY, N.C. -- Adam Baker appeared in court today on charges of identity theft and obtaining property under false pretenses.

Baker's lawyers were granted a continuance so they could have time to file for a change of venue in his trail.

These attorneys have known for a long time that they would want a change of venue. They could have presented that earlier but they make more money (court appointed ) by making more trips to court costing the tax payers even more. There is no place in NC (or anywhere else) he can be tried that doesn't know who he is. Everyone knows about Zahra!

HICKORY --
I was blessed to meet Zahra Baker. I was more blessed than most because I got the privilege of calling her my sister.

I am writing this letter on behalf of myself and my other stepsister, Amber Fairchild.

So once again, thank you to this community for everything you have done for Zahra, and for your support for my family while we have endured the absolute worst time in our lives. I would also like to make clear that I do not support Elisa Baker (Zahra&#8217;s stepmother and my biological mother), or her attorney in any way. I have not cooperated with her attorney and have no plans of doing anything in this case other than being honest and getting justice for Zahra.
 
Judge delays hearing for Baker hearing until Thursday

HICKORY, N.C. -- Channel 9 reporter Dave Faherty found out through two different sources that Zahra Baker&#8217;s biological mother wanted to be in Hickory for Elisa Baker&#8217;s court appearance.
Because the mother lives in Australia, the judge has moved everything to Thursday.
While District Attorney Jay Gaither met with top law enforcement in Hickory, Faherty spotted Elisa Baker&#8217;s attorney leaving the Catawba County Detention Center.

News (WAXN TV 64) Just gave a "snippet" and said they have learned about an exercisim in the Zahra Baker Case.

Hopefully they will tell it at 6 or 11.
