2010.05.13 ~ Werter speaks out ~ another plea?

  • #61
Once again in the class of Defense Attorney 101, the defense attorney's job is to protect his or her client and put them in a better light.
I'll wait and hear it from LE at a press conference before I believe any of it.

Here is another video with JW speaking after court today-looks like Lindsy was there, too.
I spot her standing beside JW at around 1:30.
Article with JW's press release also at link.

Tommy says Joe Overstreet was in Putnam County the night Haleigh disappeared. He says Overstreet was angry about an earlier fight he had with Haleigh’s father, Ronald Cummings. Tommy says Overstreet came over to Haleigh’s home to steal a gun. When he couldn’t find it, Tommy says Overstreet demanded Haleigh, and then kidnapped her.

Tommy did not say this-Misty did in her letter, right? Am I remembering correctly?

Florida's Felony Murder Rule

Florida's Felony Murder Rule A far lesser-known offense is felony murder and its counterpart, attempted felony murder. Felony murder occurs when two or more people commit a dangerous felony together, such as an armed robbery or a burglary. During the course of that felony, a person is killed. Those involved in the commission of the felony may be charged with felony murder - even if they had no role in the killing.

I wonder if Werter explained this to Tommy and that's what made him decide to start talking. Maybe this is the real reason he told FH he's scared.

Grandmaj, I don't think Tommy would hurt a child, either. Old softy that I am, I've got to give him the benefit of the doubt.

I think that Tommy is trying to do anything to keep Lindsey, I think when she filed for divorce that was a major turning point in this case, that got him talking, and now that one is talking they will all be talking, Loose Lips Sink Ships, and I think within the next month we will see that ship sail..

Here's another snip from Werter:

The tape demonstrates how Tommy decided to come forth voluntarily to law enforcement to provide information regarding the evening of February 9, 2009, despite threats made towards Tommy and his wife and three children. It indicates to the public and law enforcement the level of credibility of Tommy’s information.

Tommy has been cooperating with law enforcement since April 11, 2010. We have met with Putnam County Sheriff’s Office and FDLE agents twice for extended periods to review the activities of the evening and early morning of February 9 -10, 2010.

It is this attorney’s position that Tommy Croslin, Jr, has cooperated fully despite his fear for his family. Tommy has no culpability in this crime and wishes justice for Haleigh; again, demonstrated in the aforementioned phone conversation.

Werter says Tommy didn't say anything for over a year because he was afraid for his kids. Didn't he warn Lindsy? I mean, you'd think he'd warn her to watch out for Joe or something! Argh.

Strong wording by JW: It indicates to the public and law enforcement the level of credibility of Tommy’s information.

Well, he did tell FH that Lindsy had heard the story, so maybe he did warn her.

Threats? Are we talking dead rats or what? I'm still not convinced Joe is the perp.

Me either, I can't fathom Tommy being scared of Joe when he is hundreds of miles away in TN-he could have very easily told LE after Joe left FL what occured and he would have been detained right away. Nope, not buying what JW and TC are selling.
And I cannot fathom Misty not telling RC that Joe was responsible for Haleigh missing-Ron would have taken care of him before he ever left FL!

Neither am I, and from where I come from ..... a dead/headless rat doesn't mean ..... Happy Holidays!!! or Good Luck!!! .......or well ....... anything good for that matter.

I just have a hard time believing that the, HE Tommy speaks of is JO.

I do think Tommy is working on some type of deal, I'm just not sure that we heard the same story officially told to LE.

I know. I can't help but wonder if "accompanied'em" means a third person led Tommy and Joe to the river at gunpoint. KWIM.

That is interesting since Misty pointed the finger at Joe very, very early in to this. Maybe Ron is just a talker.

Could be that the third person is TiC; they sure got out of dodge fast. And could explain why CC was calling FH a liar. jmo...

One question.. Is/was the dwelling located at 130 Magnolia occupied by the Croslins on February 9, 2009 referred to as a trailer? JMO

In the strict context of what Werter said, 130 Magnolia is even more so a "trailer". Trailers like the one at 202 Green are more often than not referred to as "doublewides".

That seems to be what Werter is alluding to, doesn't it? I can't get past the forcing Tommy with a gun thing. To me, this is just another story. And since Werter didn't say they are negotiating a plea, I wonder if LE is buying it either.

It's just another story to add to this case that is so messed up with LIES! I have :banghead: so many times I can't get rid of the headache. I just wish one person would stand up and do whats right and tell the truth and let HaLeigh rest. So sad that this has even happened and sader that they can't tell the truth. If any of the in PC ever loved HaLeigh like they say they do then stand up and do whats right.

From Ger's pictures:

I know this is O/T, just wanted to point out that on Art's site he had mentioned that WBG lived on Magnolia as well.

As for Tommy, I will say it over and over. That call to Grandma was not the same story of what Tommy told LE IMO. Grandma was the one who started out with..Is it the story Misty is saying -- Joe?" Tommy says No first, then "but", then yeah. That tells alot IMO. I feel Tommy is afraid for his family, but not of Joe. Of Ron...who is the one with a violent background? Who is the one that threated to kill, put a gun to Misty, and put a dead rat in Tommy's mail box? IMO, Tommy is afraid of Ronald...not Joe. JMO

Hollars asks, "Is it the story Misty is saying -- Joe?" Croslin replies, "Yeah, that's it."
However, no other details about Haleigh were given.
